Committee inquired regarding the desired minimum age for a child to attend hearings, appropriateness of repeatedly exposing children to traumatic accounts, presumption of the admittance of others to hearings, language of legislation, and witness exclusion provisions. Chairman Skaug called the meeting to order at 1:32pm. MOTION: Rep. Mathias made a motion to approve the January 19, 2026 meeting minutes. Motion carried by voice vote. Chairman Skaug turned the gavel over to Vice Chairman Alfieri. RS 32876: Rep. Skaug presented RS 32876 regarding human trafficking. Rep. Mathias requested clarification regarding the language and authority of legislation. MOTION: Rep. Hill made a motion to introduce RS 32876 with the following changes: On line 23, strike the words "may, in his sole discretion, prosecute any crimes identified in the investigation." Add in its place, after the word who, "shall have authority, in his sole discretion, to investigate and prosecute human trafficking under this act." Motion carried by voice vote. Committee inquired regarding application to various common head coverings, determination of intent by the justice system regarding the criminal activity, increased level of trauma due to mask use during criminal activity, possible application against Immigration and Customs Enforcement officers, judiciary discretion, and future negative impacts on law enforcement. Lt. Jason Kimball, Nampa Police Department, Daniel Murphy, Sheriff Andy Creech, Payette County, Anthony Oxsen, Moshe Herman, Miguel Deluna, Dan Berger, Robert Brown, and Mark Rich testified in support. Sara LaWall, Boise Unitarian Universalist Fellowship, and David Pettinger, testified in opposition. Committee inquired regarding clarification of challenges of identification of perpetrators by law enforcement officers due to criminal mask use, facial recognition technology currently used by law enforcement, the growing need for surveillance, the difference between committing a crime and attempting to commit a criminal offense, intent, laws in other states, application to felonies alone, and judiciary discretion.
