This legislation adds a new section into Idaho Code 20-629, to authorize a sheriff's office to seek reimbursement for the costs of collecting a prisoner, probationer or parolee from out-of-state. These are individuals who have absconded from the Idaho Department of Correction.

The total annual reimbursement to county sheriff offices is estimated to not exceed $200,000. Actual expenditures will depend on the number of applicable cases and the costs incurred by individual counties.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 684 BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE AN ACT1 RELATING TO COUNTY SHERIFFS; AMENDING CHAPTER 6, TITLE 20, IDAHO CODE, BY THE2 ADDITION OF A NEW SECTION 20-629, IDAHO CODE, TO AUTHORIZE A SHERIFF'S3 OFFICE TO SEEK REIMBURSEMENT FOR COSTS OF RECAPTURE; AND DECLARING AN4 EMERGENCY AND PROVIDING AN EFFECTIVE DATE.5

Be It Enacted by the Legislature of the State of Idaho:6

SECTION 1. That Chapter 6, Title 20, Idaho Code, be, and the same is7 hereby amended by the addition thereto of a NEW SECTION, to be known and des-8 ignated as Section 20-629, Idaho Code, and to read as follows:9 20-629. COSTS FOR RECAPTURE. Whenever any Idaho county sheriff's of-10 fice is required to expend money from its budget in order to travel to another11 state to collect a prisoner, probationer, or parolee who has absconded from12 the supervision of the Idaho department of correction, the sheriff, upon13 completion of the collection of the prisoner, probationer, or parolee and14 the placement of such person in the county jail, may seek reimbursement for15 the cost of returning the person to Idaho from the agency from which the16 person absconded as indicated in court records. Such reimbursement shall17 be sought by submitting an invoice detailing the cost of such recapture,18 including any mileage or travel costs, costs for personnel, overtime costs19 associated with coverage for traveling personnel, or any other reasonable20 costs associated with returning the absconding person to custody in Idaho.21 The Idaho department of correction shall appropriate moneys annually for22 expenses as provided in this section and shall, upon receiving the invoice23 from a county sheriff's office, ensure reimbursement occurs within thirty24 (30) days of receiving such invoice.25

SECTION 2. An emergency existing therefor, which emergency is hereby26 declared to exist, this act shall be in full force and effect on and after27 July 1, 2026.28
