This Concurrent Resolution recognizes that serving in Congress should be a public service, not a career, and joins Idaho's voices to the other states calling for an Article V Convention for the sole purpose of drafting a Congressional Term Limits Amendment to the U.S. Constitution.

Sending a petition to Congress will have no impact on the General Fund or any other political subdivision funds except for administrative costs to draft, print, and deliver the resolution to Congress. If/when 34 states petition Congress to call a convention to draft and propose a Congressional Term Limits Amendment to the Constitution, there may be some cost – to be identified at that time – associated with the selection and participation of Idaho delegates, in the unlikely event that a convention is ever called.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 23 BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE A CONCURRENT RESOLUTION1 STATING FINDINGS OF THE LEGISLATURE AND APPLYING TO THE UNITED STATES CON-2 GRESS TO CALL A CONVENTION OF THE STATES UNDER ARTICLE V OF THE CONSTI-3 TUTION OF THE UNITED STATES FOR THE PURPOSE OF PROPOSING AN AMENDMENT TO4 THE CONSTITUTION OF THE UNITED STATES TO LIMIT THE TERMS OF OFFICE FOR5 MEMBERS OF CONGRESS.6 Be It Resolved by the Legislature of the State of Idaho:7 WHEREAS, Article V of the Constitution of the United States provides8 the states with the authority, upon application of the legislatures of9 two-thirds of the several states, to require the United States Congress to10 call a convention for the purpose of proposing amendments to the Constitu-11 tion of the United States to be ratified by the legislatures of three-fourths12 of the several states; and13 WHEREAS, this power provides the states with the leverage to force Con-14 gress to act when it does not want to; and15 WHEREAS, the Idaho Legislature, a body of citizen legislators, desires16 to restore rotation in office for members serving in Congress; and17 WHEREAS, the State of Idaho and 22 other states have passed statutes or18 state constitutional amendments placing term limits on members of Congress,19 but such laws were ruled as unconstitutional by the Supreme Court of the20 United States; and21 WHEREAS, the Idaho Legislature hereby joins with other states in in-22 structing Congress to draft a term limits amendment and send it to the states23 for ratification; failing this, the states will act on their own.24 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses-25 sion of the Sixty-eighth Idaho Legislature, the House of Representatives and26 the Senate concurring therein, that the Legislature hereby formally applies27 to Congress, under the provisions of Article V of the Constitution of the28 United States, to call a convention of the states limited to proposing an29 amendment to the Constitution of the United States to set a limit on the num-30 ber of terms that a person may be elected as a member of the United States31 House of Representatives and to set a limit on the number of terms that a per-32 son may be elected as a member of the United States Senate.33 BE IT FURTHER RESOLVED that the Secretary of State is hereby directed34 to transmit copies of this application to the President and Secretary of the35 United States Senate, the Speaker and Clerk of the United States House of36 Representatives, and the members of the United States Senate and House of37 Representatives from this state. The Secretary of State is further directed38 to transmit copies to the presiding officers of each of the legislative39 houses in the several states, requesting their cooperation.40 BE IT FURTHER RESOLVED that this application shall be considered as cov-41 ering the same subject matter as the applications from other states to Con-42 gress to call a convention to set a limit on the number of terms that a person43
2 may be elected to the United States House of Representatives and the United1 States Senate, and this application shall be aggregated with the same for the2 purpose of attaining the two-thirds of states necessary to require Congress3 to call a limited convention on this subject but shall not be aggregated with4 any other applications on any other subject.5 BE IT FURTHER RESOLVED that this application constitutes a continuing6 application in accordance with Article V of the Constitution of the United7 States until the legislatures of at least two-thirds of the several states8 have made applications on the same subject. This application supersedes all9 previous applications by this Legislature on the same subject.10
