LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 492 BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE AN ACT1 RELATING TO THE PEACE OFFICER STANDARDS AND TRAINING COUNCIL; AMENDING2 SECTION 19-5102, IDAHO CODE, TO PROVIDE THAT A CERTAIN PERSON FROM THE3 IDAHO ASSOCIATION OF COUNTIES SHALL BE A MEMBER OF THE PEACE OFFICER4 STANDARDS AND TRAINING COUNCIL AND TO MAKE TECHNICAL CORRECTIONS; AND5 DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE.6

Be It Enacted by the Legislature of the State of Idaho:7

SECTION 1. That Section 19-5102, Idaho Code, be, and the same is hereby8 amended to read as follows:9 19-5102. COUNCIL ESTABLISHED -- CHAIRMAN -- MEMBERS. (1) There is10 hereby established in the Idaho state police the Idaho peace officer stan-11 dards and training council. The chairman of the council shall be appointed12 by the governor and shall be a voting member of the council which . The coun-13 cil shall be composed of the following members, and which shall reflect a14 reasonable geographic balance throughout the state:15 (a) Three (3) city chiefs of police or their designees;16 (b) Three (3) county sheriffs or their designees;17 (c) The director of the Idaho state police or his designee;18 (d) A county prosecuting attorney or his designee;19 (e) The attorney general or his designee;20 (f) The special agent in charge of the Idaho division of the federal bu-21 reau of investigation or his designee;22 (g) The director of the department of correction or his designee;23 (h) The director of the fish and game department or his designee;24 (i) The director of the department of juvenile corrections or his de-25 signee; and26 (j) A representative from the Idaho association of counties juvenile27 justice administrators or the Idaho association of counties adult mis-28 demeanor probation administrators association.29 (j) (2) In addition, there shall be advisory to the council, as ex of-30 ficio nonvoting members of the council, the executive directors of the Idaho31 association of counties and association of Idaho cities.32

SECTION 2. An emergency existing therefor, which emergency is hereby33 declared to exist, this act shall be in full force and effect on and after34 July 1, 2026.35
