The purpose of this legislation is to clarify when a U.S. manufacturer or seller of a product that is used in growing food and fiber meets its common law duty to warn consumers or the public and sets criteria for legal recourse.

Amends, repeals, and adds to existing law to provide for the office of administrative hearings and to provide for the billing of state agencies for certain services.
The purpose of this bill is to change the methodology of budgeting for the Office of Administrative Hearings (OAH) to utilize the Statewide Cost Allocation Program model and be able to offset costs to the general fund. This bill requires the Division of Financial Management to prepare an estimate of costs for state budgeting purposes for the OAH for all service fees using statewide cost allocation methods. Specifically, this bill will repeal and replace section 67-5285, Idaho Code, to establish that state agencies will be billed for services provided by the OAH. It will also amend Section 67-3531, Idaho Code, to allow the Division of Financial Management to prepare annual cost estimates for services provided by OAH.

This legislation adds two additional highway district commissioners to the current five for countywide highway districts. One of these two additional highway district commissioners will be appointed by the Board of County Commissioners, whiletheotherwillbeappointedbytheGovernor. Theseadditionalpositionswillhelpprovide for improved coordination with county and state governments.

Amends existing law to revise provisions regarding the public charter school facilities program.
Charter schools are public schools funded by taxpayers. To help established charter schools secure lower interest rates on bonds, the state created the charter school credit enhancement. Twenty-one charter schools have used the tool, resulting in annual interest savings of $11.8m, or a projected $112m over a fifteen-year period. However, this tool has hit its statutory cap. This bill would raise the cap on the overall capacity of the tool so more qualifying schools may apply to participate.

This legislation requires the laws of this state to be applied equally so as to not deny the personhood of preborn children.

Adds to existing law to establish provisions regarding certain prohibited actions by pharmaceutical manufacturers.
The purpose of this legislation is to protect and expand access to healthcare for Idahoans, particularly those in rural areas, by ensuring the integrity of the federal 340b drug discount program. The 340b program allows certain qualified organizations, such as federally qualified health centers (FQHCs), to access discounted prescription drugs. These savings are reinvested into expanding healthcare services and providing discounted medications to uninsured individuals. Recent restrictions by pharmaceutical companies have limited access to 340b drugs in rural areas, contrary to the program's intent. This legislation prohibits pharmaceutical manufacturers from interfering with the delivery of 340b drugs to contract pharmacies or imposing unnecessary conditions on 340B program participation. It also ensures that safety-net clinics in rural Idaho can partner with local pharmacies to distribute discounted medications, safeguarding affordable healthcare access for underserved communities.

Amends existing law to revise provisions about the dig once policy and rights-of-way for broadband.
This legislation updates and amends Idaho’s Dig Once Policy by expanding its application to single county-wide highway districts formed pursuant to chapter 14, title 40 Idaho Code. Expanding Idaho’s Dig Once Policy will further encourage the cost-efficient, orderly, and coordinated expansion of broadband services by requiring the districts to consider the appropriateness of including the installation of broadband infrastructure during roadway construction and maintenance projects. Additionally, requiring districts to develop nondiscriminatory and competitively neutral rules, standards, and policies consistent with Idaho’s Dig Once Policy encourages further investment in broadband infrastructure by reducing installation costs and providing service providers with a fair, transparent, and predictable process. This update to Idaho’s Dig Once Policy yields greater efficiency and coordination between utilities, broadband service providers, and transportation agencies to minimize the number of times roadways must be cut and therefore closed for construction. Finally, this legislation protects the long-term integrity and performance of roadways by standardizing the construction specifications and installation methods used to deploy broadband facilities within the public ROW of state or district highways.

Amends and adds to existing law to provide that a fire burning out of control on federal land in Idaho is a nuisance and cost recovery actions related to such fires are subject to a statute of limitations after ten years, and to allow the governor to direct state resources to suppress fires on federal land.
This legislation provides that any range or forest fire burning on any land within Idaho is declared a public nuisance. The bill allows the Governor to declare an emergency exists threatening health, safety, welfare and property directing state resources to immediately extinguish such a fire on federal land. Private and state lands already extinguish fires when they begin. It directs the Idaho Attorney General to recover costs in a civil action.

This appropriation to the State Controller brings remaining activities for Luma on budget, providing additional accountability and transparency in operations. These are costs that were formerly borne by the continuously appropriated Business Information Infrastructure Fund that will be paid from the General Fund going forward. The recommended FY 2026 original appropriation of $40.47 million is 40% less than the office's FY 2024 total expenditures of $67,040,800, which included both appropriated and continuously appropriated funds. This appropriation provides enhancements to the State Controller's FY 2026 maintenance budget that include 7.00 FTP and funding for Luma personnel, Luma operating costs, Computer Service Center charges for Luma, 2.00 FTP and funding for financial specialists, 1.00 FTP and funding for a communications manager, and a level of effort program transfer.

Thisappropriationprovidesanadditional$1,679,800tothemaintenanceappropriationprovidedtoCommunity Colleges found in House Bill 341 that includes additional funding for the enrollment workload adjustment and requires the Office of the State Board of Education to develop an outcomes based funding model for the Community Colleges. Table 1 shows incremental adjustments to the budget found in the bill, of which the ongoing increase is $1,679,800. Table 2 shows the adjustments leading to the FY 2026 Total. The total budget for the Community Colleges is $69,219,700 and provides support to the College of Eastern Idaho, College of Southern Idaho, College of Western Idaho, and North Idaho College.
