STATEMENT OF PURPOSE

The purpose of this bill is to change the methodology of budgeting for the Office of Administrative Hearings (OAH) to utilize the Statewide Cost Allocation Program model and be able to offset costs to the general fund. This bill requires the Division of Financial Management to prepare an estimate of costs for state budgeting purposes for the OAH for all service fees using statewide cost allocation methods. Specifically, this bill will repeal and replace section 67-5285, Idaho Code, to establish that state agencies will be billed for services provided by the OAH. It will also amend Section 67-3531, Idaho Code, to allow the Division of Financial Management to prepare annual cost estimates for services provided by OAH.

This legislation is expected to generate a net positive fiscal impact to the General Fund beginning in fiscal year 2027. The amount of funds recouped into the General Fund will be contingent upon the allowable billing amounts of the OAH and the funding sources utilized by the agencies billed for services.
