Amends existing law to provide that liens for irrigation district assessments have a first priority over other liens.
This legislation amends Idaho Code § 43-706 to clarify that liens for irrigation assessments have a first priority on the property assessed. This amendment will align Section 43-706 with Sections 42-906, 42-2201, and 42-5240, which all place water delivery liens in a first priority position.

Amends existing law to revise fee provisions regarding recreational vehicles and to establish provisions regarding an off-highway vehicle law enforcement program.
This legislation increases the Off-Highway Vehicle (OHV) sticker fee to $20.00 for Idaho residents, $30 for nonresidents, and $30 for rental machines. Funds collected are distributed directly to the Idaho Department of Lands (IDL), county sheriffs, and Idaho Department of Parks and Recreation (IDPR), as in current law. The purpose of the increase is to provide additional funds to support the OHV trail program, to provide additional funding to OHV law enforcement, to adopt an accountability model for use of OHV law enforcement funds, and to increase the fee retained by vendors such as county assessors and retail outlets. In 1972, dirt bike enthusiasts started a motorbike sticker program to fund the construction and maintenance of motorized recreation trails throughout Idaho. The initial fee was $3.00. The trail program has grown to maintain over 1,850 miles of trails annually and support over 200,000 users ranging from dirt bikes, ATVs, UTVs and other off-highway vehicles. The fee has increased four times since inception, with the last increase being in 2009. The 2009 fee increase was to create distributions to IDL and sheriffs only. There has been no sticker increase to adjust for inflation effects to the trails program since 1994. The inflation-adjusted fee from 1972 to present would justify an increase to over $22.00.

Amends existing law to revise provisions regarding prohibiting the final disposition of dead human bodies.
This legislation amends Idaho Code §31-2808 to remove the restriction for employees of mortuary establishments by allowing them to also work in areas of making the final disposition of deceased human bodies for county coroners. Mortuary owners, licensed funeral directors, and morticians and proprietors continue to be restricted.

This legislation exempts certain sensitive information from public records requests, similar to exemptions for law enforcement, to protect medicolegal death investigations. Exempted records could be released with consent of a parent or legal guardian.

Amends existing law to provide for outcomes-based funding.
This legislation modernizes Idaho’s K-12 school funding formula by adding an Outcomes-Based Funding component. It provides a funding framework for school districts and public charter schools to receive funding aligned with statewide student achievement goals, specifically growth and proficiency targets for math (grades 5 through 8) and attaining college and career readiness credentials. This is an important shift in school funding, moving from paying exclusively for inputs and including a component that pays for student growth and achievement.

Amends and adds to existing law to establish a USS Idaho SSN 799 Commemorative License Plate.
This amendment to the Idaho Code establishes a 5-year commemorative plate recognizing the commissioning of the 5th ship in the United States Navy’s fleet named USS Idaho. This plate will be available only until July 1, 2030. Costs for this plate will be the same as the costs for a normal plate where all funds for the plate are collected and used by ITD.

This legislation ensures that harmful material cannot be accessed through web browsing, apps, downloaded content, or other digital workarounds. Furthermore, it establishes clear liability for content creators within application stores and sets reasonable liability for device manufacturers who fail to comply with these protections.

Amends existing law to revise provisions regarding the Office of the State Public Defender and indigent public defense in this state.
This legislation provides beneficial updates and clarity regarding the State Public Defender (SPD). The legislation contains intent language for the development and implementation of a transition plan pertaining to the use of county facilities. It reflects current case law specifying that the SPD pays for transcripts they request. The bill provides for development of workload standards in accordance with certain principles to provide constitutional and efficient representation. This further clarifies the key role of the District Public Defenders and their leadership responsibilities in managing public defense services in their districts which will promote efficiency and responsiveness at a more localized level. This legislation provides for compensation that is more aligned with the local market and case complexity. It specifies certain office building expenses are the responsibility of the counties and specifies the types of cases covered by the SPD.

Amends existing law to provide for certain donor disclosures for certain contributions.
This bill will require a political action committee (PAC), which intends to make certain election expenditures, to disclose both direct and indirect individual contributors of contributions of $1,000 or more to the Secretary of State's Office before the receiving PAC may expend those monies in support of or in opposition to candidate in Idaho. If one or more entities that are not an individual or a business (e.g. a PAC or nonprofit entity) contribute(s) to the receiving PAC, the contributing entity's (or entities') contributors of $1,000 or more must be disclosed to the Secretary of State by the receiving PAC prior to the receiving PAC expending the related contribution on an election of a candidate. If one or more entities that are not an individual or business contribute(s) to one or more contributing entities, the contributing entity's (or entities') contributors of $1,000 or more must also be disclosed by the original receiving PAC before expending the monies contributed on any election or measure on the ballot in Idaho until every contributor of $1,000 or more is disclosed.

This appropriation to Community Colleges provides enhancements to the FY 2026 maintenance budget. Thisappropriationprovidesanadditional$1,679,800tothemaintenanceappropriationprovidedtoCommunity Colleges found in House Bill 341 that includes additional funding for the enrollment workload adjustment and requires the Office of the State Board of Education to develop an outcomes based funding model for the Community Colleges. Table 1 shows incremental adjustments to the budget found in the bill, of which the ongoing increase is $1,679,800. Table 2 shows the adjustments leading to the FY 2026 Total. The total budget for the Community Colleges is $69,219,700 and provides support to the College of Eastern Idaho, College of Southern Idaho, College of Western Idaho, and North Idaho College.
