MINUTES SENATE HEALTH & WELFARE COMMITTEE DATE: Thursday, February 05, 2026 TIME: 3:00 P.M. CONVENED: Chair VanOrden called the meeting of the Senate Health and Welfare Committee (Committee) to order at 3:02 p.m. RS 33228 Relating to Rural Health Transformation. Senator Cook explained this legislation was very similar to an RS the Committee reviewed a few days ago. The only difference was the number of appointees to the Rural Health Transformation Program Committee was changed to three senators, three representatives, and one non-voting member appointed by the Governor. DISCUSSION: Senator Lenney asked what the number of appointees was in the original bill. Senator Cook stated the first bill had two senators, two representatives, and two non-voting members. Senator Wintrow asked if the additional senator and representative were added to allow for a Democrat on the committee. Senator Cook stated that was not the reason for increasing the number of legislators. MOTION: Senator Harris moved to send RS 33228 to print. Senator Keyser seconded the motion. The motion carried by voice vote. RS 32891 Relating to Petroleum Clean Water Trust Fund Act. Senator Blaylock stated this legislation ensured that state laws were streamlined, up-to-date, and essential for the citizens of Idaho, while best serving public health, safety, and welfare. The Legislature approved the Idaho Code Cleanup Act, 2025 H 14 and submitted sections of Idaho Code were reviewed for repeal. The Idaho DOGE Task Force evaluated sections of code to determine whether they were obsolete, outdated, or unnecessary. This legislation repealed or updated seven sections of the Petroleum Clean Water Trust Fund Act, Chapter 49, Title 41, Idaho Code. The repeals included sections of the initial appointment criteria, references to fee transfers for money earned prior to August 03, 1995, and other obsolete language. MOTION: Senator Shippy moved to send RS 32891 to print. Vice Chair Bjerke seconded the motion. The motion carried by voice vote. -- 1 of 2 -- RS 33010C1 Relating to Foster Care Placement. Senator Galloway explained this legislation improved Idaho's foster care system by expanding expedited placement eligibility to trusted kin, further ensuring stability for vulnerable children. It also and made technical corrections for statutory consistency. The purpose was to improve Idaho's ability to care for foster youth using the lightest touch possible and accomplished this with no fiscal note. The legislation removed the two month hearing requirement for youth in extended foster care. She explained last year's shift to more frequent hearings helped move children to permanent homes faster. However, it unintentionally applied to young adults age 18 to 23 who voluntarily remained in care. Courts asked for this fix to save time and resources. Since these youth could leave the care at any time, it was unnecessary for them to have the additional hearings. Additionally, the legislation expanded expedited placement beyond relatives to include kin. Kin were individuals with significant family-like relationships, and this addition would help move children more quickly to stable, familiar homes. MOTION: Senator Harris moved to send RS 33010C1 to print. Senator Keyser seconded the motion. The motion carried by voice vote. RS 33161 Relating to Medicaid. Senator Wintrow explained the Medicaid for Workers with Disabilities (MWD) program, Idaho Code §56-209n was health insurance for people who work and have a disability. This program was intended to help people with disabilities work and keep health insurance, to support independent living. She explained many individuals with disabilities wanted to continue working beyond the age of 65 and maintain these benefits. After age 65, individuals who wanted to continue working were no longer eligible for the program and faced higher cost shares that sometimes quadrupled. This legislation directed the Idaho Department of Health and Welfare to identify and evaluate options, no later than December 1, 2026, within the existing federal Medicaid authority that prioritized continuity for individuals enrolled in or transitioning from the Medicaid for Workers with Disabilities program. The purpose was to keep individuals living independently in their homes and avoid the high cost of institutionalization. DISCUSSION: Senator Harris asked if any other states offered this program. Senator Wintrow stated she was not positive, but believed other states offered similar programs. She added there were recent discussions regarding extending the retirement age for all benefits. Senator Lenney asked if Medicare would fill the gap this legislation was addressing. Senator Wintrow explained Medicare did not cover long-term care and she would be happy to provide additional information at the bill hearing. MOTION: Senator Harris moved to send RS 33161 to print. Senator Blaylock seconded the motion. The motion carried by voice vote. DOCKET NO. 16-0602-2501 Foster Care Licensing - Temporary and Pending Rule Jared Larsen, Chief of Staff, Idaho Department of Health and Welfare (IDHW), explained the proposed changes to the temporary and pending rules. He outlined the following changes: 1. Rule 102. Disposition of Applications added subsection 03. Kin-specific License. 2. Rule 108. combined rules 109 and 110. 3. Rule 108.02.h added the language "A clearance from the background check unit does not preclude the revocation of a license under this subsection".'' 4. Rule 201. added subsection 05. Law-Abiding Lifestyle. DISCUSSION: Senator Zuiderveld asked if there had been an increase in program participants with the passage of 2025 H 245. Mr. Larsen explained there had been an increase of participants ages 21 to 23. He had not heard any negative feedback regarding the program which he attributed to the program being entirely voluntary. Vice Chair Bjerke stated he was a cosponsor on H 245 and asked the IDHW to provide additional information on program participation. MOTION: Senator Harris moved to approve the temporary and pending rules in Docket No. 16-0602-2501. Senator Shippy seconded the motion. The motion carried by voice vote. -- 1 of 2 -- DOCKET NO. 16-0613-2501 Emergency Assistance for Families and Children (Chapter Repeal) - Pending Rule Laura Denner, Family and Community Partnerships Administrator (IDHW), explained the program these rules governed was entirely federally funded. The rules in this Docket were nearly identical to the federal law and federal rules governing the program. Therefore, she asked the Committee to approve the repeal of this rule chapter. MOTION: Senator Shippy moved to approve Docket No. 16-0613-2501. Senator Blaylock seconded the motion. The motion carried by voice vote. CONVENED: Chair VanOrden called the meeting of the Senate Health and Welfare Committee (Committee) to order at 3:01 p.m. GUBERNATORIAL REAPPOINTMENT: Committee Consideration of the Gubernatorial Reappointment of Clayton Steele of Lewiston, Idaho, to the Board of Environmental Quality to serve a term commencing July 1, 2025 and expiring July 1, 2029 Mr. Steele informed the Committee he had been working in the environmental sciences field for 25 years, half of that time was spent working for the Department of Environmental Quality in Lewiston. He had served on the Board of Environmental Quality (Board) for two years. During that time he was involved in the rulemaking process and worked in private industry for Clearwater Paper as an environmental manager. Mr. Steele stated he was the air quality manager in Lewiston. DISCUSSION: Senator Harris asked about key challenges faced by the Board in the past two years. Mr. Steele explained the Perpetua Resources contested case was a challenge as was reviewing administrative rules. Senator Wintrow asked what parts of serving on the Board were rewarding and what purpose the Board served. Mr. Steele stated he brought a unique perspective to the Board due to his experience working for the Idaho Department of Equality (DEQ). He understood the process of permitting as well as what it was like to be regulated. He stated his time working internally at DEQ enabled him to explain certain things to other board members. Mr. Steele explained a source of pride was ensuring funds reached local communities through rural grants and loan approvals. He saw clear impacts of this effort in the Lewiston region and across the state. Senator Blaylock asked Mr. Steele his opinion on the Perpetua Resources situation and if there were any updates on the project. She stated the federal government approved it and now they were waiting for state regulation. Mr. Steele responded the case was contested and went to a hearing officer. The hearing officer made a recommendation to the Board who reviewed a high volume of complex records. The Board decided unanimously to proceed with the hearing officer's recommendation and the case had since moved to a different jurisdiction. -- 1 of 3 -- Senator Zuiderveld asked if Mr. Steele ever encountered a conflict of interest working for Clearwater Paper and serving on the Board. Mr. Steele stated he had not yet experienced a conflict of interest serving on the Board. PRESENTATION: Department of Health and Welfare Budget Chair VanOrden stated the Legislative Services Office (LSO) would present the 2027 budget requests for the Idaho Department of Health and Welfare (IDHW) excluding Medicaid which would be covered on Thursday. Alex Williamson, Senior Budget and Policy Analyst for LSO and Morgan Poloni, Senior Budget and Policy Analyst for LSO, presented the 2027 budget requests for IDHW excluding Medicaid (Attachment 1). Ms. Williamson stated the Legislative Budget Book included IDHW's FY 27 budget request beginning on page 2-3. She explained the slides provided to the Committee were for reference and offered to discuss any questions with the Committee. Ms. Poloni reviewed the following divisions and programs that requested no enhancements or supplemental funds and were considered only a maintenance budget for FY 27: • Youth Safety and Permanency • Licensing and Certification • Independent Councils Ms. Poloni reviewed the following divisions and programs that requested enhancement or supplement to their budgets for FY 27: • Early Learning and Development • Family and Community Partnerships • Division of Public Health Services DISCUSSION: Senator Blaylock asked for clarification regarding the Idaho Home Visiting Program budget. Ms. Poloni explained the Idaho Home Visiting Program was a one-time appropriation last year intended to spur IDHW to review the program and request funds in FY 27. It was previously an ongoing appropriation. There were two parts to the requested budget. The general fund transfer of $1 million which would be used as part of the 3 percent hold back and the federal Maternal, Infant, and Early Childhood Home Visiting (MIECHV) funding. The MIECHV grant was part of ongoing federal appropriation. Additionally, the program would be moved to the Division of Early Learning and Development. Chair VanOrden clarified the Idaho Home Visiting Program would be moved to a different division within IDHW, not out of IDHW. Ms. Poloni stated that was correct. Senator Wintrow asked where the 3 percent hold back came from. Ms. Poloni replied it was part of the overall program. Senator Wintrow explained the Legislature appropriated $1 million to the IDHW as pass-through funding to health districts for the Idaho Home Visiting Program. She stated the Legislature voted to make the appropriation ongoing to ensure money was allocated to this prevention program. Senator Wintrow asserted she would like to investigate the 3 percent hold back on this fund because there were no guarantees on the federal funding for the program. PRESENTATION: Ms. Williamson stated Substance Abuse Services requested no enhancements or supplemental funds and were considered only a maintenance budget for FY 27. She added the program requested $150,000 from the Millennium Fund for a recovery center in Idaho. SENATE HEALTH & WELFARE COMMITTEE Monday, January 26, 2026—Minutes—Page 2 -- 2 of 3 -- Ms. Williamson reviewed the following divisions and programs that requested enhancement or supplement to their budgets for FY 27: • Division of Welfare • Mental Health Services • Psychiatric Hospitalization • Indirect Support Services Ms. Williamson also highlighted that Idaho was awarded $925 million from the Rural Health Transformation Program (RHTP) over five years. DISCUSSION: Chair VanOrden stated the RHTP had strict deadlines for submitting a proposals. Once a proposal was submitted the State must use the funds within a two year period otherwise the funds would revert back to the federal government. The first proposal was due in October. Ms. Williamson added the funds that revert back would be redistributed to states that were executing their plans. Therefore, if Idaho was diligent about implementing a plan, obligating funds, and utilizing those funds, there was potential Idaho would receive additional funds over the life time of the grant. Chair VanOrden explained the RHTP included a 3.5 percent allocation to the tribes, who are eligible to apply for additional money through the same process the State would undergo. Senator Zuiderveld asked for examples of operating expenditures because the program allocated $ 294 million, one time, for operating expenditures. Ms. Williamson explained the scope of the funds was intended for access issues, expanding or enhancing services, and technology or infrastructure investments that would have a sustainable impact beyond the life time of the program. Chair VanOrden added there were administrative costs the allocation would cover. Idaho was allocated $185 million and one of the priorities would be bolstering rural Emergency Medical Services to expand health care in rural communities. Senator Lenney stated it would be helpful to have someone from IDHW available to answer questions on the budget requests. MINUTES SENATE HEALTH & WELFARE COMMITTEE DATE: Tuesday, January 20, 2026 TIME: 3:00 P.M. PLACE: Room WW54 MEMBERS PRESENT: Chairman VanOrden, Vice Chairman Bjerke, Senators Harris, Zuiderveld, Lenney, Shippy, Blaylock, Keyser, and Wintrow ABSENT/ EXCUSED: None NOTE: The sign-in sheet, testimonies and other related materials will be retained with the minutes in the committee's office until the end of the session and will then be located on file with the minutes in the Legislative Services Library. CONVENED: Chair VanOrden called the meeting of the Senate Health and Welfare Committee (Committee) to order at 3:01 p.m. MINUTES APPROVAL: Senator Harris moved to approve the Minutes of January 15, 2026. Senator Bjerke seconded the motion. The motion carried by voice vote. PASSED THE GAVEL: Chair VanOrden passed the gavel to Vice Chair Bjerke. DOCKET NO. 16-0308-2502 Federal Welfare Programs (ZBR New Chapter) - Pending Rule. Jared Larsen, Chief of Staff, Idaho Department of Health and Welfare (IDHW) explained the proposed rule chapter was a consolidation of all rule chapters related to federal welfare programs overseen by the Division of Self Reliance. This new chapter combined the Temporary Assistance for Families in Idaho (TAFI) Program and the Low-Income Home Energy Assistance Program (LIHEAP) into one administrative rule chapter. The rules that were duplicative of state statute, federal statute, or federal regulations were removed. Mr. Larsen noted this rule chapter was short as a result of the TAFI Program being primarily federally funded and LIHEAP being entirely federally funded. Eligibility and implementation of both programs were federally regulated. DISCUSSION: Senator Zuiderveld asked if there was concern about the loss of federal funding for these programs considering the direction of the federal government. Mr. Larsen stated both programs were codified in federal statute and would require 60 votes in favor of dissolution in the United States Senate. Senator Blaylock asked if there was a conflict between statute and administrative rule chapter 16.03.08 regarding citizenship eligibility. Mr. Larsen stated 2025 H 135, addressed all individuals over 18 and their citizenship status for any program. Senator Blaylock asked why LIHEAP listed citizenship and residency under eligibility while the TAFI program only listed citizenship. Mr. Larsen stated eligibility criteria for LIHEAP was US citizenship or legal non-citizen status. If the docket does not cover a requirement it was governed by Idaho Code and federal law. Senator Blaylock asked Mr. Lasen to clarify the requirements under Rule 101. Mandatory TANF Household Members. Mr. Larsen explained the rule listed individuals who must be counted, if present, when assessing a household's total qualifying income.. -- 1 of 3 -- Senator Shippy asked about the procedure used to determine citizenship. Mr. Lasen deferred to Kristen Matthews. Kristen Matthews, Division of Self-Reliance Bureau Chief (IDHW), stated the Division used the U.S. Department of Homeland Security SAVE system to verify citizenship status. Senator Shippy clarified that those eligible included citizens and legally present non-citizens. Ms. Matthews stated Senator Shippy was correct. MOTION: Chair VanOrden moved to approve Docket No. 16-0308-2502. Senator Blaylock seconded the motion. The motion carried by voice vote. DOCKET NO. 16-0308-2501 Temporary Assistance for Families in Idaho (TAFI) Program (Chapter Repeal) - Pending Rule. Mr. Larsen explained this chapter was inserted into administrative rule chapter 16.03.08, therefore he asked the Committee to approve the repeal of this rule chapter. Mr. Larsen noted that TAFI and Temporary Assistance for Needy Families (TANF) were the same program. TAFI was Idaho's name for the program and future references would use the federal name TANF. MOTION: Senator Harris moved to approve Docket No. 16-0308-2501. Chair VanOrden seconded the motion. The motion carried by voice vote. DOCKET NO. 16-0414-2501 Low-Income Home Energy Assistance Program (LIHEAP) (Chapter Repeal) - Pending Rule Mr. Larsen explained this chapter was inserted into administrative rule chapter 16.03.08, therefore he asked the Committee to approve the repeal of this rule chapter. MOTION: Senator Blaylock moved to approve Docket No. 16-0414-2501. Senator Harris seconded the motion. The motion carried by voice vote. DOCKET NO. 16-0501-2501 Use and Disclosure of Department Records (ZBR Chapter Rewrite) - Pending Rule. Mr. Larsen explained that this administrative rule chapter was used as an internal manual for processing record requests. The language related to vital statistics was duplicative of Idaho Code Chapter 2, Title 39 and was removed. Language duplicative of the Public Records Act, Idaho Code Chapter 1, Title 74 was also struck. MOTION: Senator Wintrow moved to approve Docket No. 16-0501-2501. Senator Harris seconded the motion. The motion carried by voice vote. DOCKET NO. 15-0101-2501 Rules Governing Senior Services and Older Americans Act Programs (ZBR Chapter Rewrite) - Pending Rule.Judy Taylor, Director of the Idaho Commission on Aging (Commission) explained the proposed rule changes. She informed the Committee that the Commission's mission was to keep older Idahoans in their homes for as long as possible, despite cognitive or physical limitations. The chapter was reviewed to streamline and simplify language in accordance with Executive Order 2020-01: Zero-Based Regulation. No negative comment was received during negotiated rulemaking. MOTION: Chair VanOrden moved to approve Docket No. 15-0101-2501. Senator Shippy seconded the motion. The motion carried by voice vote. SENATE HEALTH & WELFARE COMMITTEE Tuesday, January 20, 2026—Minutes—Page 2 -- 2 of 3 -- DOCKET NO. 15-0120-2501 Rules Governing Area Agency on Aging (AAA) Operations (Chapter Repeal) - Pending Rule Ms. Taylor explained the Commission conducted research and analysis that determined this rule chapter was duplicative of federal law, federal regulations, and contract terms with the Area Agencies on Aging. Therefore she asked the Committee to approve the repeal of this rule chapter. MOTION: Senator Harris moved to approve Docket No. 15-0120-2501. Senator Wintrow seconded the motion. The motion carried by voice vote. MINUTES SENATE HEALTH & WELFARE COMMITTEE DATE: Thursday, January 15, 2026 TIME: 3:00 P.M. PLACE: Room WW54 MEMBERS PRESENT: Chairman VanOrden, Vice Chairman Bjerke, Senators Harris, Lenney, Shippy, Keyser, and Wintrow ABSENT/ EXCUSED: Senators Zuiderveld and Blaylock NOTE: The sign-in sheet, testimonies, and other related materials will be retained with the minutes in the committee's office until the end of the session and will then be located on file with the minutes in the Legislative Services Library. CONVENED: Chairman VanOrden called the meeting of the Senate Health and Welfare Committee (Committee) to order at 3:02 p.m. WELCOME: Chairman VanOrden welcomed the Senators to the Committee. INTRODUCTION: Chairman VanOrden introduced the new Committee Secretary, Madyson Crea and asked her to tell the Committee about herself. Ms. Crea informed the Committee she has administrative experience working with the Idaho Division of Occupational and Professional Licenses (IDOPL). She stated she worked with several health professions boards while IDOPL completed Zero-Based Regulation Rulemaking. Ms. Crea told the committee she was born and raised in Idaho and enjoyed hunting and hiking. INTRODUCTION: Chairman VanOrden introduced the new Committee Page, Finn Mecham and asked him to tell the Committee about himself. Mr. Mecham stated he was a senior in high school and enjoyed snowboarding, tennis, and shooting skeet. He planned to attend Utah State University after high school. He informed the Committee that his father and older brother both went through the Page Program in the Idaho House of Representatives. DISCUSSION: Chairman VanOrden asked what high school Mr. Mecham attended. Mr. Mecham stated he attended Eagle High School. Senator Harris remarked that he attended Utah State and it was a great school. Senator Shippy asked Mr. Mecham if he had one week to do anything what would he do. Mr. Mecham stated he would snowboard at Brundage. INTRODUCTION: Chairman VanOrden introduced the new Committee Page, Cooper Smith and asked him to tell the Committee about himself. Mr. Smith told the Committee that he was from Nampa and enjoyed weight training, football, and traveling. He informed the Committee that he recently moved to Idaho from Europe. He tried to travel as much as he could while living in Europe. DISCUSSION: Vice Chairman Bjerke asked Mr. Smith where in Europe he lived. Mr. Smith told the Committee he lived in Spain on the southern side. Senator Harris asked if he learned any foreign languages. Mr. Smith stated he did not learn Spanish, but he was moving to France to attend university and hoped to learn French. NOTE: Vice Chairman Bjerke informed the Committee they would begin reviewing rules next week. He stated the Secretary and Pages did a great job organizing the Administrative Rule Review Books. -- 1 of 2 -- Chairman VanOrden addressed the Department of Health and Welfare Facts, Figures, & Trends 2025-2026 Reference books on the Committee members' desks. Chairman VanOrden acknowledged that some of the Administrative Rules to be reviewed by the Committee may be difficult. She stated the Committee members should contact her or Vice Chairman Bjerke if they wanted to delay a vote to obtain more information on a specific docket.
