The purpose of this legislation is to effectuate the original intent of the statute allowing licensed Idaho chiropractors, certified in clinical nutrition, to prescribe and treat patients with the limited prescription drug products they are currently allowed under the Idaho law to obtain and independently administer to patients. The Idaho legislature previously passed Idaho code § 54-716 to allow Idaho chiropractors to treat patients with certain, limited prescription drug products, however, currently compound pharmacies and pharmaceutical distributors are not providing access to chiropractors to the products. This legislation will cure that deficiency.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE SENATE SENATE BILL NO. 1254 BY HEALTH AND WELFARE COMMITTEE AN ACT1 RELATING TO THE CHIROPRACTIC PRACTICE ACT; PROVIDING LEGISLATIVE INTENT;2 AMENDING SECTION 54-716, IDAHO CODE, REGARDING THE PRESCRIBING OF3 CERTAIN PRESCRIPTION DRUG PRODUCTS; AND DECLARING AN EMERGENCY AND PRO-4 VIDING AN EFFECTIVE DATE.5
Be It Enacted by the Legislature of the State of Idaho:6
SECTION 1. LEGISLATIVE INTENT. It is the intent of the Legislature to7 clarify the existing right of persons licensed to practice chiropractic in8 this state to prescribe certain prescription drug products.9
SECTION 2. That Section 54-716, Idaho Code, be, and the same is hereby10 amended to read as follows:11 54-716. ADMINISTERING PRESCRIPTION DRUG PRODUCTS. (1) A licensee un-12 der this chapter who is certified in clinical nutrition may prescribe, ob-13 tain, and independently administer, during chiropractic practice, the fol-14 lowing prescription drug products:15 (a) Vitamins:16 (i) Vitamin A;17 (ii) All B vitamins; and18 (iii) Vitamin C;19 (b) Minerals:20 (i) Ammonium molybdate;21 (ii) Calcium;22 (iii) Chromium;23 (iv) Copper;24 (v) Iodine;25 (vi) Magnesium;26 (vii) Manganese;27 (viii) Potassium;28 (ix) Selenium;29 (x) Sodium; and30 (xi) Zinc;31 (c) Fluids:32 (i) Dextrose;33 (ii) Lactated ringers;34 (iii) Plasma lyte;35 (iv) Saline; and36 (v) Sterile water;37 (d) Epinephrine; and38 (e) Oxygen for use during an emergency or allergic reaction.39 (2) The prescription drug products listed in subsection (1) of this40 section may be administered through oral, topical, intravenous, intramuscu-41
2 lar or subcutaneous routes. The route of administration and dosing shall be1 in accordance with the product's labeling as approved by the federal food and2 drug administration or with the manufacturer's instructions.3 (3) The prescription drug products listed in subsection (1) of this4 section shall be obtained from a wholesale distributor, manufacturer, phar-5 macy or outsourcing facility licensed under chapter 17, title 54, Idaho6 Code.7 (4) No vitamin or mineral may be compounded, as defined in section8 54-1704, Idaho Code, by a chiropractic physician. A compounded drug product9 containing two (2) or more of the approved vitamins or minerals shall be ob-10 tained for office use from either an outsourcing facility or a compounding11 pharmacy licensed under chapter 17, title 54, Idaho Code.12 (5) Nothing herein would remove or impact the ability of a chiropractic13 physician who does not obtain a clinical nutrition certification to continue14 to utilize nonprescriptive nutritional supplements.15
SECTION 3. An emergency existing therefor, which emergency is hereby16 declared to exist, this act shall be in full force and effect on and after17 July 1, 2026.18
