The purpose of this legislation is to expand exemptions related to newborn screening requirements. It allows a parent or guardian to claim an exemption for a child based on religious, philosophical, or conscientious beliefs, and maintains the existing medical exemption process certified by a licensed physician.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE SENATE SENATE BILL NO. 1316 BY HEALTH AND WELFARE COMMITTEE AN ACT1 RELATING TO HEALTH AND SAFETY; AMENDING SECTION 39-907, IDAHO CODE, TO RE-2 VISE PROVISIONS REGARDING EXEMPTIONS; AND DECLARING AN EMERGENCY AND3 PROVIDING AN EFFECTIVE DATE.4

Be It Enacted by the Legislature of the State of Idaho:5

SECTION 1. That Section 39-907, Idaho Code, be, and the same is hereby6 amended to read as follows:7 39-907. EXEMPTIONS BECAUSE OF RELIGIOUS BELIEF. The provisions of8 this chapter shall not apply to any child whose parent or guardian: objects9 thereto on the grounds that it conflicts with the tenets or practices of a10 recognized church or religious denomination of which said parent or guardian11 is an adherent or member.12 (1) Objects on religious or other grounds, including philosophical or13 conscientious beliefs; or14 (2) Submits a certificate signed by a physician licensed by the state15 board of medicine stating that the physical condition of the child is such16 that all or any of the requirements of this chapter would endanger the life or17 health of the child.18

SECTION 2. An emergency existing therefor, which emergency is hereby19 declared to exist, this act shall be in full force and effect on and after20 July 1, 2026.21
