MINUTES HOUSE HEALTH & WELFARE COMMITTEE DATE: Wednesday, January 28, 2026 TIME: 9:00 A.M. PLACE: Room EW20 MEMBERS: Chairman Vander Woude, Vice Chairman Erickson, Representatives Healey, Redman, Wheeler, Beiswenger, Burgoyne, Cayler, Fuhriman, Leavitt, McCann, Thompson, Hall (Stone), Tanner(13), Rubel, Egbert ABSENT/ EXCUSED: Representative(s) Beiswenger, Thompson GUESTS: The sign-in sheet will be retained in the committee secretary's office; following the end of session the sign-in sheet will be filed with the minutes in the Legislative Library. Vice Chairman Erickson called the meeting to order at 9:00 a.m. DOCKET NO. 16-0321-2501: Jared Larson, Chief of Staff, Department of Health and Welfare (DHW), presented Docket No. 16-0321-2501, a comprehensive and consolidating rewrite for Developmental Disabilities Agencies. Invited to answer questions, Ms. Fredde Trenkle, Program Manager, Licensing & Certification, stated the physical restraint definition was moved from another chapter. Any use of restraints includes a treatment plan and written confirmation. MOTION: Rep. Healey made a motion to approve Docket No. 16-0321-2501. Motion carried by voice vote. DOCKET NO. 16-0322-2501: Jared Larson, Chief of Staff, DHW, presented Docket No. 16-0322-2501 which consolidates and removes redundant language for assisted living facilities. Mr. Tom Moss, DHW, Program Supervisor, Licensing and Certification, explained the background check occurs after an employee is hired and stipulation is made to assure close supervision while it is being processed. MOTION: Rep. Fuhriman made a motion to approve Docket No. 16-0322-2501. SUBSTITUTE MOTION: Rep. Cayler made a substitute motion to approve Docket No. 16-0322-2501 with the exception of Section 009.03.b because it is important to protect vulnerable Idahoans by assuring those caring for them have passed background checks prior to contact. Responding to a comment, Mr. Larsen said while the current line-of-sight stipulation unduly restricts the supervisor from looking away from the employee, the one-to-one contact maintains the close supervision without any undue visual restriction. For the record, Mr. Larsen said Idaho law requires legislative rule rejection with a finding of facts identifying how the rule is inconsistent with the corresponding Idaho Code. The substitute motion, although dealing with policy, still requires an explanation of how the Department has not complied with Idaho Code. UNANIMOUS CONSENT REQUEST: Rep. Cayler made a unanimous consent request to withdraw his motion. There being no objection, the request was granted. VOTE ON MOTION: Vice Chairman Erickson call for a vote on the motion to approve Docket No. 16-0322-2501. Motion carried by voice vote. -- 1 of 2 -- DOCKET NO. 16-0417-2501: Jared Larson, Chief of Staff, DHW, presented Docket No. 16-0417-2501, a duplicative chapter repeal for residential habilitation agencies. MOTION: Rep. McCann made a motion to approve Docket No. 16-0417-2501. Motion carried by voice vote. Vice Chairman Erickson turned the gavel over to Chairman Vander Woude. RS 33050: Rep. Jordan Redman, District 3, presented RS 33050 to update and modernize the seventeen year-old midwifery statute which is preventing best practice standards of care. The update also allows midwives to safely administer medication within their scope of practice, education, and training. MOTION: Rep. Healey made a motion to introduce RS 33050. Motion carried by voice vote.
