This legislation would update Title 56, Chapter 22 with a new section giving legislative approval for the Department of Health and Welfare (DHW) to submit Medicaid and Children’s Health Insurance Program (CHIP) State Plan Amendments (SPAs) to make available services for incarcerated youth in Medicaid and CHIP as required by Section 5121 of the Consolidated Appropriations Act, 2023. The fiscal impact below is contingent upon legislative appropriation and will not be requested any earlier than for implementation in SFY 2028. While DHW is requesting policy authority this session to proceed with submittal of a State Plan Amendment to comply with federal law, even if the Centers for Medicare and Medicaid approve, the Department will not implement until appropriated funding in a future year.

Estimated fiscal impact would be calculated at rate for Targeted Case Management multiplied by estimated number of youth served. The initial cost estimate for the first year in which the funding is appropriated is $311,400 in state general funds and $634,600 in federal funds. Cost estimates for subsequent fiscal years may increase or decrease based on the number of youth served at that time.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 578 BY HEALTH AND WELFARE COMMITTEE AN ACT1 RELATING TO INCARCERATED JUVENILES TRANSITION SERVICES; AMENDING CHAPTER2 22, TITLE 56, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 56-2208, IDAHO3 CODE, TO PROVIDE LEGISLATIVE APPROVAL FOR A STATE PLAN AMENDMENT RE-4 GARDING INCARCERATED JUVENILES TRANSITION SERVICES; AND DECLARING AN5 EMERGENCY.6
Be It Enacted by the Legislature of the State of Idaho:7
SECTION 1. That Chapter 22, Title 56, Idaho Code, be, and the same is8 hereby amended by the addition thereto of a NEW SECTION, to be known and des-9 ignated as Section 56-2208, Idaho Code, and to read as follows:10 56-2208. LEGISLATIVE APPROVAL -- INCARCERATED JUVENILES TRANSITION11 SERVICES. (1) Pursuant to section 1902 of the social security act, the de-12 partment of health and welfare is authorized to seek and shall submit a state13 plan amendment by July 1, 2026, that makes the services authorized in this14 section available for eligible juveniles who are within thirty (30) days of15 the date they are scheduled to be released from a correctional facility, as16 that term is defined by section 18-101A, Idaho Code, following adjudication.17 Services for eligible juveniles shall include:18 (a) Any screening or diagnostic service that meets reasonable stan-19 dards of medical, behavioral health, or dental practices, as determined20 by the state, or as indicated as medically necessary; and21 (b) Targeted case management services, including referrals for appro-22 priate care and services available in the geographic region of the home23 or residence of such eligible juvenile, where feasible, under the state24 plan or waiver of such plan.25 (2) This section shall not be construed to authorize services beyond26 those that are required by section 1902 of the social security act for eligi-27 ble juveniles on or before July 1, 2026.28 (3) The services included in any state plan submitted pursuant to this29 section shall not commence before July 1, 2027, and are subject to legisla-30 tive appropriation.31
SECTION 2. An emergency existing therefor, which emergency is hereby32 declared to exist, this act shall be in full force and effect on and after its33 passage and approval.34
