Amends existing law to revise provisions regarding the Idaho Commission of Pardons and Parole.

In 2021, the Idaho Legislature passed H.B. 150 which created Chapter 10, Title 20, consolidating all legal authorities and responsibilities of the Commission of Pardons and Parole in a single chapter. This bill corrects two reference errors from that legislation. Further, in 1999 the Legislature passed a bill making the Commission a separate agency from the Department of Correction with separate and independent, leadership appointed by the governor, as well as separate budgets, and rulemaking processes. This bill also cleans up older, confusing references about these separate agencies making sure the separation effectuated in 1999 is correctly noted in all relevant references in code. Though separate, IDOC and the Commission are still required to work together on their parallel missions. See Sections 20-201A(2) and 20-1002(4), Idaho Code.

Amends existing law to revise provisions regarding certain special assessments.

Excessive use fees and special assessments have been a tool that irrigation districts have used to provide proper incentives to water users to follow their water rights and mitigation plans. Over time, the statutory limit of $100 per acre foot of excess water use has lost effect due to inflation and increased commodity prices. This legislation, requested by irrigation districts, brings that limit up to current times and provides a disincentive to overuse of irrigation water.

Adds to existing law to establish the Rangeland Improvement Act.

This legislation directs the Idaho Department of Agriculture to seek funding for and carry out grazing improvement projects statewide through the Grazing Board Central Committee which was originally created by the Taylor Grazing Act of 1934 and reauthorized by the Federal Land Policy Management Act (FLPMA).

This legislation ensures that the requirement for ISDA to inspect plants and plant pests on private land is consistent with the statutory requirements of ISDA for inspecting livestock.

Adds to existing law to provide for agricultural protection areas.

This legislation provides landowners with an additional option when considering preserving agricultural land in the state. The legislation adds a new chapter to the Idaho Land Use Planning Act that would provide the legislative authority for local units of government to receive applications from willing landowners to establish a land use designation, known as an Agricultural Protection Area. The process to review and consider applications is outlined in the legislation.

Amends existing law to require a certain percentage of qualified electors of the district sign a petition for a vote to repeal the district.

This legislation allows smaller communities to enter into an auditorium district and be able to dissolve it.

Amends existing law to provide that a parent or guardian shall not be required to be represented by an attorney at an expungement hearing.

A parent or guardian of a juvenile for whom a hearing is being held pursuant to section 20-525A who is appearing at a hearing for expungement shall not be required to be represented by an attorney.

Amends existing law to revise the definition of “juvenile offender” and to revise a provision regarding jurisdiction for certain juveniles younger than ten years of age.

Currently, in Idaho, there is no minimum age for criminal prosecution. This legislation changes the juvenile offender definition to disallow criminal prosecution of minors under the age of ten (10), except for the crime of murder in the first or second degree.

Amends existing law to provide for annual season setting and to provide for a certain process.

This bill will return hearing from the public on big game management to its 2015 standard of yearly meetings and settings from the current hearings to two years. This will give the public 30 day comment period before. No non-resident tags can be sold until after the season setting process is complete.

This legislation proposes an amendment to Chapter 18, Title 41 of the Idaho Code concerning the "Notice of Lapse or Termination of Individual Life Insurance." It aims to grant the policy owner and any designated third partytheoption, atnocost, torequestthatalllapsinglifeinsurancepoliciesreceiveanoticeoflapseviacertified United States mail with return receipt, ten (10) days before the lapse takes effect. The responsibility for the certified mailing costs would fall on the insurance company whenever a policy lapses due to non-payment, termination, or the end of the term policy.

Amends existing law to provide that a taxpayer's sworn statement that an expenditure was made for an identified deduction is conclusive proof to establish the taxpayer's right to the deduction.

This legislation would clarify that a credit card statement or other documentation from a financial institution, coupled with a sworn statement from the taxpayer to the effect that the expense was incurred for an identified deduction purpose, conclusively establishes the taxpayer's right to claim the deduction or credit.

This legislation ensures that immediate family members are automatically considered essential caregivers; clarifies who may give or withdraw essential care giver status consistent with Idaho code regarding surrogate-decision makers; and resolves a conflict when an individual is in the custody of a peace officer or a state correctional facility.

Amends existing law to provide that certain notice may be given by first class or certified mail and to provide for proof of mailing.

This Legislation amends Idaho Code Section 50-1306A, Vacation of Plats, adding language to allow a municipality to provide certain notices through first class mail, certified mail, or certified mail return receipt. In addition, a new section is added to require the sender of such notice to retain a proof of mailing of such notice, to be produced upon request. This legislation may reduce the cost of mailing notices by certified mail return receipt, as this cost is solely borne by the citizen filing the petition to vacate. Many individuals are now refusing to pick up or accept a certified letter causing undo expenses to our citizens.

Amends existing law to provide limitations on regulation of short-term rentals.

This legislation clarifies existing Idaho law protecting the private property rights of Idaho homeowners by ensuring the right to rent their property is maintained. This legislation protects property owners by allowing local governments to regulate short-term rentals only in cases where it is in the interest of public health and safety. In addition, the legislation calls for safety disclosures by property owners and allows for local jurisdictions to license short-term rentals.

Amends existing law to revise provisions regarding police officer member status.

The purpose of this legislation is to add Peace Officer Standards and Training (POST) certified juvenile detention supervisors, juvenile probation supervisors, adult misdemeanor supervisors, emergency communications supervisors and Idaho Department of Juvenile Corrections to the Rule of 80 retirement plan as is currently conducted with their adult counterparts.
