Amends existing law to revise provisions regarding school board recall elections, vacancies, and quorums.

This legislation provides an exception where if one or more vacancies exist on a school board, the transaction of business can still occur if a majority of members of the board are present. It also clarifies that a vacancy exists on a school district board of trustees if a recall election is successful, and when the election is certified by the board of county commissioners. Lastly, it identifies the time period in which a trustee, subject to recall, is ineligible to vote on any board matters between the period of the special recall election and when the board of county commissioners certifies the election.

Amends existing law to revise provisions regarding commercial driver's license permit fees, eligibility, and renewal.

This legislation has three parts: 1. It allows a commercial driver’s license (CDL) to be renewed for 8 years; currently CDL driver's may only obtain 4-year licenses. The 8-year renewal confers a broad benefit to the Idaho trucking industry. 2. It reduces online renewal fees by five dollars. All license renewal fees are set in statute. Allowing an online discount encourages people to skip the trip and fulfills customer demand for efficient renewal options at a lower cost. 3. It sets up a Drug and Alcohol Clearinghouse check for CDL licenses. Federal statute requires the Idaho Transportation Department(ITD) to check the federal drug and alcohol clearinghouse prior to completing any CDL transaction. The clearing house check process must be in place by November 18, 2024.

Adds to existing law to prohibit the state government and its employees from paying membership fees or dues.

This legislation would prohibit the use of tax dollars by public officers, public employees and subdivisions of government for membership fees or dues to any organization unless required to maintain professional licensure for state employment. This language would only affect the Judicial, Executive, and Legislative branches of government.

The creation of the School Employee Member class moved school employees out of the general class into a class of their own. 59-1352 currently does not include this new defined class. This correction to statute will codify that the School Employee class has access to the same disability retirement benefit they had when they were members of the general class.

This legislation amends Idaho Codes 46-1021(1) & 46-1022 to ensure that Idaho is compliant with the National Flood Plain Insurance Program's (NFIP) regulations. This will allow local jurisdictions the ability to maintain participation in the NFIP and citizens to acquire flood insurance.

Amends existing law to revise provisions regarding a special inquiry judge proceeding and the authority of the Attorney General.

This legislation allows the Attorney General to request a special inquiry proceeding from the judiciary to investigate crime and corruption. The purpose of this legislation is to equip the Attorney General, who has jurisdiction to investigate elected county officials, with a tool already used by county prosecuting attorneys to investigate crime and corruption.

Amends existing law to adjust the desired fund size multiplier.

This legislation adjusts the desired fund size multiplier from 1.3 to 1.2 to temper the increase in unemployment insurance tax rates for calendar year 2024 (Idaho Code 72-1350(3)). Without adjusting the multiplier, a large tax increase would normally occur after three years of frozen tax rates. Reducing the desired fund size multiplier lowers future rates.

Amends existing law to to revise a provision regarding contributions and investment earnings under supplemental benefit plans and to provide for qualified after-tax contributions.

PERSI Choice plan members do not have access to a Roth option under current Idaho Code. To comply with Secure 2.0 catch-up contribution regulations, a qualified after-tax contribution investment option must be available to participate in catch-up contributions. 59-1308(9) needs to be updated to allow for this type of investment option to be in compliance with federal law.

Amends existing law to revise a provision regarding a sale, exchange, or donation of county property.

Thislegislationseekstoclosealoopholeofgovernmenttakingsurplusproceedsinexcessofdebtsowed. When government takes property for outstanding property tax debts, they can sell the property, retain the amounts owed for the debt, and pay the remaining proceeds to the former property owner. A loophole exists in Idaho code where the government could transfer the property to another government entity and consequently not disburse any amount back to the former property owner. Thus the property owner would lose any equity in the property. This legislation prevents a government entity from doing so.

Amends existing law to require notification by school officials to parents of rights regarding immunizations.

Currently, many school districts send notices to parents of school aged children regarding Idaho Code 39-4801, the purpose of this language is to require schools to send communication including Idaho Code 39-4804 any time they send Idaho Code 39-4801.

Amends existing law to create an exemption from licensure for certain subcontractors and to eliminate a class of licensure.

The Division of Occupational and Professional Licenses seeks to amend Idaho Code to allow for an exemption from licensure for subcontractors performing work on a project managed by a licensed public works contractor when the value of the subcontracted work is less than $100,000. It also eliminates the category of Class D licensure. This proposed statutory change would help to align Idaho's licensing requirements with the current business climate and construction market.

Amends existing law to revise provisions regarding when a student can be exempted from certain required English language assessments.

Thisbillupdatesthestatuteaddressingassessmentexemptionsandremoveslanguageregardingassessmentsno longer used in Idaho and include current state-mandated tests. This bill also provides an exemption for English language learning students, who have not been enrolled for two (2) full school years in the United States and who score less than a level two (2) on the state’s English language proficiency test, to be exempted from the Idaho Reading Indicator assessment. Schools must determine which students qualify for the exemption before the fall testing date.

Amends existing law to establish provisions regarding prisoners who secure employment with a private employer.

This legislation applies to Idaho inmates hired by a private employer under the Department of Correction work releaseprogram.
