This bill requires Idaho-based organizations that provide refugee resettlement services to submit an annual audit to the Legislature detailing the scope and outcomes of those services. The audit must include information such as the number of refugees served, and demographic and language data. The bill also prohibits resettlement entities from assisting individuals who are unlawfully present and requires disclosure if such assistance has occurred. An emergency clause provides for an effective date of July 1, 2026.

Employers and organizations that receive government funds are already required to maintain internal accounting, compliance, and record-keeping systems as a condition of receiving both federal and state funds. The requirements outlined in this act rely on existing federal verification processes and employer compliance practices. Therefore, no additional state appropriations or administrative costs are anticipated as a result of this legislation.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE SENATE SENATE BILL NO. 1318 BY STATE AFFAIRS COMMITTEE AN ACT1 RELATING TO THE AUDIT OF REFUGEE RESETTLEMENT; AMENDING CHAPTER 4, TITLE 67,2 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 67-467, IDAHO CODE, TO ES-3 TABLISH PROVISIONS REGARDING AN AUDIT OF THE RESETTLEMENT OF REFUGEES;4 AND DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE.5

Be It Enacted by the Legislature of the State of Idaho:6

SECTION 1. That Chapter 4, Title 67, Idaho Code, be, and the same is7 hereby amended by the addition thereto of a NEW SECTION, to be known and des-8 ignated as Section 67-467, Idaho Code, and to read as follows:9 67-467. AUDIT OF REFUGEE RESETTLEMENT. (1) As used in this section:10 (a) "Entity" means any corporation and foreign corporation; business11 corporation and foreign business corporation; for-profit and nonprofit12 unincorporated association; corporation sole; business trust, estate,13 partnership, trust, and two (2) or more persons having a joint or com-14 mon economic interest; and state, the United States, and foreign gov-15 ernment.16 (b) "Illegal alien" means a person who has overstayed the person's visa17 or entered the United States without authorization irrespective of any18 temporary status the person may have been granted by the department19 of homeland security allowing the person to be present in the United20 States.21 (c) "Refugee" means any person who is outside any country of such per-22 son's nationality or, in the case of a person having no nationality, is23 outside any country in which such person last habitually resided, and24 who is unable or unwilling to return to, and is unable or unwilling to25 avail himself of the protection of, that country because of persecution26 or a well-founded fear of persecution on account of race, religion, na-27 tionality, membership in a particular social group, or political opin-28 ion.29 (d) "Resettlement services" means any service provided by an entity30 that entered into a grant, contract, or cooperative agreement with the31 United States department of state or other appropriate federal agency32 to provide for the reception and initial placement of refugees in the33 United States.34 (2) Any entity incorporated under the laws of the state of Idaho pro-35 viding resettlement services for refugees shall provide the legislature an36 annual audit of such services in accordance with the provisions of sections37 67-466 and 67-705, Idaho Code.38 (3) Such audit shall detail the following:39 (a) The total number of refugees served;40 (b) The nationality and gender of refugees served;41 (c) The language abilities of refugees served;42

2 (d) The successful rate of participation in language remediation pro-1 gramming for refugees served;2 (e) The counties and municipalities where refugees served are housed;3 (f) The housing units taken by refugees served; and4 (g) The vital statistics, including the rates of communicable disease,5 among refugees served.6 (4) Any entity incorporated under the laws of the state of Idaho pro-7 viding resettlement services for refugees is prohibited from aiding illegal8 aliens or released aliens awaiting removal.9 (5) Any entity providing refugee resettlement services that has pro-10 vided assistance to illegal aliens shall account for the names and identi-11 fying demographics of such aliens for the purposes of providing a catalog of12 names that may be matched against federal immigration databases at the de-13 partment of homeland security, department of health and human services, and14 department of state.15

SECTION 2. An emergency existing therefor, which emergency is hereby16 declared to exist, this act shall be in full force and effect on and after17 July 1, 2026.18
