STATEMENT OF PURPOSE

The primary objective of this legislation is to safeguard the Second Amendment rights of Idaho’s citizens. Presently, our preemption law prohibits local governments from establishing more stringent regulations regarding the carrying of firearms in public facilities. Additionally, our laws prohibit the carrying of firearms within courtrooms and courthouses. However, the recent development of county courthouses being created within county offices has resulted in confusion regarding the permissible locations for firearm carrying. This legislation clarifies that in such instances, prohibiting individuals from carrying firearms within a courtroom will be allowed. Nevertheless, our citizens should be permitted to carry firearms when entering city or county buildings for other purposes.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 621 BY STATE AFFAIRS COMMITTEE AN ACT1 RELATING TO CONCEALED WEAPONS; AMENDING SECTION 18-3302C, IDAHO CODE, TO2 REVISE A PROVISION REGARDING PROHIBITED CONDUCT AND TO MAKE TECHNICAL3 CORRECTIONS; AND DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE4 DATE.5
Be It Enacted by the Legislature of the State of Idaho:6
SECTION 1. That Section 18-3302C, Idaho Code, be, and the same is hereby7 amended to read as follows:8 18-3302C. PROHIBITED CONDUCT. (1) Any person obtaining a license un-9 der the provisions of section 18-3302, Idaho Code, or carrying a concealed10 deadly weapon pursuant to the provisions of section 18-3302(4)(f), Idaho11 Code, shall not:12 (1) (a) Carry a concealed weapon in the courtroom portions of a court-13 house or in any area of a courthouse being used as a jail or holding fa-14 cility for the detention of prisoners or any person undergoing trial or15 awaiting sentencing; in a juvenile detention facility or jail; or in16 a public or private school, except as provided in subsection (4)(g) of17 section 18-3302D, Idaho Code; provided that this subsection shall not18 apply to:19 (a) (i) Peace officers while acting within the scope of their em-20 ployment;21 (b) (ii) Security personnel while actually engaged in their em-22 ployment; or23 (c) (iii) Any person who is authorized to carry a weapon by a per-24 son, board, or other entity having authority over the building or25 facility; or26 (2) (b) Provide information on the application for a permit to carry a27 concealed weapon knowing the same to be untrue.28 (2) Any person violating the provisions of this section shall be guilty29 of a misdemeanor.30
SECTION 2. An emergency existing therefor, which emergency is hereby31 declared to exist, this act shall be in full force and effect on and after32 July 1, 2026.33
