Relates to the appropriation to the State Tax Commission for fiscal year 2022.

This is the FY 2022 original appropriation bill for the State Tax Commission. It appropriates a total of $46,355,300 and caps the number of authorized full-time equivalent positions at 443.00. For benefit costs, the bill maintains the current appropriated amount for health insurance at $11,650 per eligible FTP, extends the holiday for the employer's sick leave contribution rate for another year, and restores funding for the employer's unemployment insurance contribution rate. The bill also provides funding for the equivalent of a 2% change in employee compensation for permanent state employees and a 2% upward shift in the compensation schedule. Also included are the following line items: line item 1, which provides $10,000 for a 2% increase for the commissioners' salary; line item 2, which provides $933,600 for FAST Enterprises to host GenTax on its servers; and line item 3, which reduces 5.00 FTP and $180,000 from personnel costs.

Amends existing law to remove provisions regarding confidentiality of statement, forms, or other information relating to compensation.

Currentlyinformationrelatingtothecompensationofanyofficer, directororemployeeofinsurancecompanies, as reported to the Idaho State Department of Insurance, is considered confidential under Idaho Code, Section 41-335. This legislation would delete the confidentiality language in the law and thus make available to the public the information regarding compensation of officers, directors, trustees and employees of any health carrier.

Relates to the appropriation to the Industrial Commission for fiscal year 2022.

This is the FY 2022 original appropriation bill for the Industrial Commission. It appropriates a total of $21,580,500 and caps the number of authorized full-time equivalent positions at 133.25. For benefit costs, the bill maintains the current appropriated amount for health insurance at $11,650 per eligible FTP, extends the holiday for the employer's sick leave contribution rate for another year, and restores funding for the employer's unemployment insurance contribution rate. The bill also provides funding for the equivalent of a 2% change in employee compensation for permanent state employees. The bill funds four line items, which provide $3,232,000 for year 2 of a 4 year IT modernization project; a reduction of $165,300 for a decrease in office lease costs at the Chinden Campus; $100,000 to contract with an attorney to assist with the increase in unemployment insurance appeals reviewed and ruled upon by the commission; and $8,100 for a 2% change in employee compensation for the three commissioners. Section 3 of the bill amends Section 72-503, Idaho Code, to statutorily raise the Industrial Commissioners' annual salary to allow for the 2% increase funded in line item 4. Section 4 of the bill requires the commission to report on the progress of the business and technology modernization funded in line item 1.

Amends existing law to revise provisions regarding professional service contracts.

This legislation involves clarifications to Idaho’s Qualifications Based Selection process (QBS). QBS is a selection process for the procurement of professional services such as engineering, construction management, architecture, landscape architecture and land surveying. QBS has been the law in Idaho for over 35 years. QBS focuses on retaining knowledgeable and skilled professionals with specific experience for complex projects like schools, bridges, roads, municipal water and wastewater facilities, etc. Nearly all of these projects involve publichealth,safetyorwelfareconcernswherequalificationsoftheprofessionalareparamount. Thelegislation helps to make QBS more transparent and provides more guidance on maneuvering through the QBS process.

Relates to the appropriation to the Public Schools Educational Support Program's Division of Children's Programs for fiscal year 2022 and fiscal year 2021.

This is the FY 2022 original appropriation and the FY 2021 supplemental appropriation bill for the Public Schools Educational Support Program's Division of Children's Programs. This division includes programs that provide direct educational or material benefits to children, where funding does not primarily go to paying certificated teachers and administrators. It also includes programs that primarily and specifically provide funding for the separate instruction of identified subgroups of children outside the normal classroom of an Idaho public school. Funding is provided from both state and federal funds. For FY 2022: statutory-based adjustments include an additional $9.7 million for advanced opportunities; $1.96 million for the Idaho Digital Learning Academy; $655,000 for border contracts; and $371,500 for exceptional contracts and tuition equivalents. The bill also shifts certain costs from state funds to federal COVID-19 relief funds for one year and the bill provides federal COVID-19 relief funds for public school districts and public charter schools to address costs associated with the pandemic. Finally, the bill provides a net-total of $20 million for public school districts and public charter schools to address learning loss as a result of the pandemic; these funds are to be distributed by the Department of Education. Uses are outlined in the bill and are at the discretion of the school districts and public charter schools.

Adds to existing law to provide for the post-election audit of ballots.

This legislation would authorize the Secretary of State to order a post-election audit of election results after a general or primary election, using procedures he would provide to county clerks at least 60 days prior to the election. Conducting such an audit would increase public confidence in election results by checking the paper ballots, which exist for each and every vote cast in Idaho, against the election results that counties tabulate and report. If problems are identified with any reported election results, the Secretary of State could order the audit of additional ballots.

Amends existing law to revise provisions regarding construction and maintenance of railroad grade crossings.

Currently Idaho Code Section 62-306 requires railroads to construct and maintain roads and highways at crossings only between the rails and not less than two feet outside the outer rails. Railroads typically possess right-of-way significantly beyond the outer rails and in order to construct and maintain roads and highways within this railroad right-of-way, the state and public road agencies must obtain permission of the railroad, often subject to onerous and burdensome terms and conditions. This legislation makes it the responsibility of railroads to construct and maintains roads and highways at crossings, the full width of their right-of-way.

This bill allows a candidate (incumbent or challenger) for either a House or Senate legislative seat to transfer up to the full balance of an established campaign account for one legislative seat (House or Senate) into the account for a new legislative seat (House or Senate) as long as the total contributions from any one person or entity does not exceed the maximum allowed for either the primary or general election during the same election cycle.

Adds to existing law to prohibit certain discrimination based upon immunization status.

This is a civil rights bill. This bill amends Idaho Code Ch. 59, Title 67 by the addition of a new section which will prohibit certain acts of discrimination based on immunization status or the possession of an immunity passport. The bill makes it unlawful for state and local governments to withhold or deny any person local or state government services, goods, facilities, advantages, privileges, licensing, education, health care access, or employment opportunities. It also makes it unlawful for any employer to refuse employment or discriminate in any way based on immunity passport or vaccination status. Public accommodations may not exclude or refuse to serve a person based on vaccination status. A health care facility is allowed to make reasonable accommodation measures for an unvaccinated employee for health and safety reasons, but not to deny employment. The bill exempts schools and daycares pursuant to existing Idaho statutes. Licensed nursing homes are exempt only if compliance would violate regulations from Medicare and Medicaid services.

Amends existing law to provide that local ordinances shall not apply to state and local transportation systems and essential facilities.

The current law requires land use agencies to “take into account the plans and needs” of the ITD and special purpose districts, which has proven to be inadequate. The statute also creates an exception to the applicability of local land use plans and ordinances for ITD transportation facilities. The purpose of the proposed legislation is to extend the same exception to local highway jurisdictions who have the same essential transportation needs as the ITD in complying with federal and state regulatory mandates.
