Amends existing law to provide a penalty for possession of marijuana in an amount less than three ounces.
This legislation amends Idaho Code section 37-2732 regarding controlled substances. A mandatory minimum fineisaddedforfirsttimeconvictionsofmarijuanapossessionofthree(3)ounces,orless,ofnetweight. Minors are exempt from a minimum fine for misdemeanor possession.
Adds to existing law to provide for the crimes of trafficking in fentanyl and drug-induced homicide.
This legislation adds Fentanyl to the list of dangerous drugs that carry mandatory minimum sentences. It defines the amounts of fentanyl that are required to meet the elements for the crime of trafficking. This statute is not meant to capture the personal user. It is intended to make clear the punishment for those who choose to manufacture, deliver, or bring into the state amounts of fentanyl that meet the quantities listed in this bill. It also adds provisions for the crime of drug induced homicide and the corresponding punishment.

Amends existing law to revise the definition of “drug paraphernalia” to exclude fentanyl testing strips.
This legislation provides that materials intended solely for the detection of whether fentanyl is present (e.g. fentanyl detection strips) shall not be considered drug paraphernalia.
