Stating findings of the Legislature and authorizing the Speaker and the Pro Tempore to engage legal counsel to sue the Biden Administration in federal court to have the vaccine mandates invalidated.
This concurrent resolution authorizes the Speaker of the House and the President Pro Tempore of the Senate to engagecounseltosuethefederalgovernment,tohaveafederalcourtdeclarefederalvaccinemandatesunlawful, and to enjoin the mandates and prevent them from having any effect on Idaho employers and employees.
Adds to existing law to prohibit certain discrimination based upon immunization status.
This is a civil rights bill. This bill amends Idaho Code Ch. 59, Title 67 by the addition of a new section which will prohibit certain acts of discrimination based on immunization status or the possession of an immunity passport. The bill makes it unlawful for state and local governments to withhold or deny any person local or state government services, goods, facilities, advantages, privileges, licensing, education, health care access, or employment opportunities. It also makes it unlawful for any employer to refuse employment or discriminate in any way based on immunity passport or vaccination status. Public accommodations may not exclude or refuse to serve a person based on vaccination status. A health care facility is allowed to make reasonable accommodation measures for an unvaccinated employee for health and safety reasons, but not to deny employment. The bill exempts schools and daycares pursuant to existing Idaho statutes. Licensed nursing homes are exempt only if compliance would violate regulations from Medicare and Medicaid services.

Adds to and amends existing law to prohibit discrimination against persons based on their immunization status and to establish provisions regarding the Sovereign Legal Defense Fund.
Adds to existing law to provide that an employer requiring an employee to be vaccinated against COVID-19 must allow medical, religious, and natural immunity exemptions.
Adds to existing law to provide that an employer who requires an employee to receive a COVID-19 vaccination must allow a personal belief exemption.
Adds to existing law to prohibit proof of vaccination for certain purposes and to provide penalties and exceptions.
OnApril7,2021,GovernorLittleissuedexecutiveorder2021-04whichessentiallyprohibitedthestateofIdaho from requiring proof of vaccination to receive or access state services and facilities. This legislation codifies and expands the Governor’s executive order and provides that individuals will not be required to provide proof of vaccination or negative test results in order to: apply or receive services provided by the state; enter a government venue; or be hired or maintain employment with the state. This legislation also provides for civil penalties for violating this legislation.

Adds to and amends existing law to restrict an employer from requiring certain employee vaccinations.
This legislation prevents an employer from mandating that current employees receive a vaccination as a condition of continued employment. However, this legislation does allow employers to require vaccinations for new employees if required vaccinations are identified at time of hire.

This is a civil rights bill with funds provided for a Federal Overreach Legal Defense Fund in the amount of $2,000,000 transferred from the general fund. Amends existing law to provide that school officials shall provide parents and guardians with certain information in communications regarding student immunizations.
This legislation requires school officials to notify parents or guardians of their right to vaccine exemptions. Exemptions for preschool through grade twelve students exist in Idaho code 39-4802. With the addition of this legislation, any notifications to parents or guardians regarding vaccinations must include a verbal description of their right to exempt their child.
