Amends, repeals, and adds to existing law to provide for campaign finance transparency.
Idaho’s campaign finance laws, also known as the sunshine laws, were originally enacted in 1974 by a citizen initiative to increase transparency regarding money spent on political campaigns and lobbying. This legislation updates and reorganizes the campaign finance laws to increase transparency, simplify reporting, and improve enforcement to better align with increased spending and modern practices in political campaigns. The legislation reorganizes the campaign finances laws by moving the provisions from Title 67, Chapter 66, State Government and State Affairs, to Title 74, Chapter 3, Transparent and Ethical Government. This new chapter separates the reporting requirements and responsibilities into five parts. It also separates the reporting requirements for campaign finance from the reporting requirements for lobbying. Additionally, the legislation makes several changes designed to increase the frequency of reporting, adjust the campaign finance limitations, and improve enforcement by creating an improved fine structure.

Amends existing law to provide for certain donor disclosures for certain contributions.
This bill will require a political action committee (PAC), which intends to make certain election expenditures, to disclose both direct and indirect individual contributors of contributions of $1,000 or more to the Secretary of State's Office before the receiving PAC may expend those monies in support of or in opposition to candidate in Idaho. If one or more entities that are not an individual or a business (e.g. a PAC or nonprofit entity) contribute(s) to the receiving PAC, the contributing entity's (or entities') contributors of $1,000 or more must be disclosed to the Secretary of State by the receiving PAC prior to the receiving PAC expending the related contribution on an election of a candidate. If one or more entities that are not an individual or business contribute(s) to one or more contributing entities, the contributing entity's (or entities') contributors of $1,000 or more must also be disclosed by the original receiving PAC before expending the monies contributed on any election or measure on the ballot in Idaho until every contributor of $1,000 or more is disclosed.

Amends existing law to provide for certain commercial sales to be exempt from certain reporting requirements.
This bill amends Section 67-6610 of the Idaho Code regarding election campaign contributions and expenditures. It exempts certain commercial sales of merchandise by candidates or political committees from individual reporting requirements, provided each sale is under $200, the total sales and cost of goods sold are reported, and the items are generally available to the public. Additionally, it clarifies that such sales are exempt from Idaho’s sales tax laws.
