Relates to the appropriation to the State Controller for fiscal year 2024.
This is an FY 2024 appropriation bill for the office of the State Controller, it funds the impact of House Bill 646, which revises the North-South boundary lines for Benewah, Bonner, Clearwater, Kootenai, Latah and Shoshone Counties. The State Controller's Office will send $10,000 to each of the six counties to fund this endeavor.

Adds to existing law to establish state employee telework requirements and requirements relating to salary adjustments and savings.
This legislation establishes a teleworking policy for state employees in executive agencies. In-office employees with positions that do not require direct contact with the public must work at least 75 percent of their scheduled workdays in a two-week period in state offices and meet the requirements of a state telework agreement. In-office employees with job responsibilities that require direct contact with the public are not eligible for telework. Field employees with day-to-day responsibilities outside of the office or in the field are exempt from the telework policy. This bill also stipulates that any salary increases approved by the Legislature only go into effect as of July 1 in the designated fiscal year, and for the fiscal year 2025; personnel costs cannot be transferred to other categories.
Relates to the appropriation to the Department of Education for fiscal years 2024 and 2025.
This appropriation to the State Department of Education provides enhancements to the FY 2025 budget that includes funding for the suicide prevention, standards review and adoption, providing CTE equipment for rural schools through the career ready students program, the final year of ESSER (COVID-19 relief) funds, and the additional 2% CEC.

Amends existing law to provide that the Governor's appointment of the executive officer of the state board is subject to the advice and consent of the Senate, to revise provisions regarding School District Facilities Fund distributions and School Modernization Facilities Fund distributions, and to revise provisions regarding public charter school financial support and charter school authorizers.
This is a trailer bill to HB 521 this session that makes several changes: 1) It ensures the executive officer of the state board is Senate confirmed; 2) It lightens the minimum days requirement for schools by eliminating the requirement for contract days, delays implementation to 2025 to ensure legislative oversight of board decisions, and provides the state board flexibility to phase in hours or days requirements; 3) It ensures any misused dollars by a local school district are recaptured to the schools facilities fund and distributed to rural schools; 4) It amends to one-time distributions from the school district facilities fund; 5) It restores public charter school facility funds to what they were prior to unanticipated reductions from funding formulas impacted by the passage of HB 292 in 2023; and 6) It resolves a conflict within Section 33-5209A, Idaho Code.

This is a supplemental appropriation to the Division of Vocational Rehabilitation to pay outstanding authorizations for the remainder of FY 2024.

Relates to the appropriation to the Department of Administration for the Division of Public Works for fiscal year 2025.
This is the FY 2025 original appropriation bill for the Permanent Building Fund. It appropriates a total of $174,908,300 to the Department of Administration for the Division of Public Works. The bill includes ten line items, including: construction of a secure mental health facility; utilities connections for the National Guard's Orchard Readiness Center; facility expansion for Idaho State University's physician assistant program; safety upgrades to the Mechanical-Technical Building and Wittman Complex at Lewis-Clark State College; construction of additional residential cottages at the School for the Deaf and Blind; and an insulated bus storage barn at the School for the Deaf and Blind. Four of the ten line items provide additional funding for existing projects, including: a 848-bed female prison; the new Science and Research Building at Boise State University; the Meat Science and Innovation Center at the University of Idaho; and the MOSS Campus at the University of Idaho. The bill also includes $87,448,300 for building maintenance projects to provide alterations and repairs projects for state agencies and institutions; asbestos abatement; facilities maintenance for the Capitol Mall and Chinden Campus; and statewide Americans with Disabilities Act compliance. The bill also includes a transfer from the General Fund. ThebillrepurposesappropriationsfrompriorDepartmentofCorrectioncapitalprojectstopurchaseandremodel the Department of Correction Training and Development Center that is currently under a lease agreement. The bill also repurposes contingency appropriation for previously authorized deferred maintenance projects to provide funding for a 100-bed minimum security dorm at the Idaho Correctional Institition in Orofino and additional funding for Idaho State University's physician assistant facilities expansion. Amends existing law to provide for when pending fee and non-fee rules shall become effective.
This legislation sets a default effective date of July 1 for all pending rules approved by the Legislature. This legislation will also ensure that all rules reviewed and approved this session will go into effect on July 1, unless the concurrent resolution states otherwise.

Amends existing law to revise a provision regarding notice of a solicitation.
Idaho statute 67-9208(2) requires a very specific description of products and services that are being solicited. This change proposes that the sentence in the statute is updated to sufficient detail to apprise the vendor of the specifications or required outcomes property being sought. Also, since solicitations are administered electronically, the requirement for bid closing location is outdated.

Amends existing law to remove minimum dollar amounts for certain campaign contributions.
This legislation amends Idaho’s Sunshine laws for campaign finance reporting. For contributions to candidates and political committees, there is already a requirement that all donations be associated with the name of the contributor. However, currently aggregate contributions less than $50 may be reported to the secretary of state as unitemized. This legislation eliminates that provision, increases transparency and simplifies campaign finance reporting by requiring all contributions to be filed with a contributor’s name and address.

Amends existing law to provide for the crime of domestic terrorism.
This legislation modifies the Idaho Terrorist Control Act to define domestic terrorism and redefine terrorism. This legislation would prevent an Idahoan from being labeled a domestic terrorist or terrorist in Idaho without constitutionally protected due process.

Amends existing law to remove certain exceptions.
This legislation amends section 18-622, Idaho Code, and section 18-8804, Idaho Code, to disallow the affirmative defense to the felony of criminal abortion in the case of incest or rape.

Amends and adds to existing law to clarify the health rights of Idahoans.
This legislation creates a revised section to Chapter 90, Title 39, Idaho Code, relating to Health Rights. The revised section is to be known as Section 39-9004. This section establishes health rights under the law for medical patients, their family members, and legal guardians. This legislation will help ensure fairness of treatment,enhancepatientawarenessofmedicaltreatmentoptions,andinstallpatientsafeguardswithrespectto requirements for informed consent and the use of experimental drugs. This legislation will place necessary and expected restrictions on state and local government as to governmental authority with respect to the advertising of certain types of medicines or vaccines and the imposition of personal restrictions on Idahoans relating to widespread medical situations.

Amends existing law to revise a provision regarding interagency contracts with state institutions of higher education.
Idaho Code 67-2332(A) requires agencies to follow the normal procurement process when seeking to contract with an Idaho university. This change will update the statute to require agencies to obtain quotes/proposals directly from all universities informally instead of through the Division of Purchasing.

Adds to existing law to provide for parental rights during certain child protection investigations.
This legislation creates a new section in Idaho Code to provide for the notification of parents or guardians of their legal rights with respect to child protection investigations.

This legislation repeals section 18-3309, Idaho Code, and replaces it with a new section 18-3309, Idaho Code, that prohibits limitations regarding concealed weapons at public colleges and universities.

Amends existing law to remove a requirement that a notice of hearing be sent by registered or certified mail.
A Notice of Hearing is required to be sent by certified mail under Idaho Code 72-713, making it the only pleadings statutorily required to be served by the Commission in this manner. This legislation retains the requirement that the Commission give at least ten days written notice of hearing to the parties but eliminates the requirement that such notice must be served on the parties by certified mail. The amendment would allow for service of a Notice of Hearing to be made by regular mail, or by email. Pro se litigants are allowed to file and receive pleadings by email, regular mail, personal service or Facsimile transmission.

Repeals and adds to existing law to prohibit cities and towns from supporting certain military companies or organizations and to provide exceptions.
The legislation amends Section 46-802, Idaho Code, that prohibits members of organizations other than the National Guard, unorganized militia, or selected other groups from associating and parading in public with firearms. The legislation supports the First and Second Amendment Rights afforded to Idahoans under the U.S. Constitution.
Adds to existing law to provide for permits.
This legislation would allow certain State grazing leaseholders to apply to the Idaho Department of Lands to convert a grazing lease into a grazing permit for a very narrow set of qualified lands.

Amends existing law to revise provisions regarding an optional retirement program.
This legislation allows employees hired by the Office of the State Board of Education on or after July 1, 2024 who have credited service in the public retirement system of Idaho (PERSI) to make a one time irrevocable election to remain a member of that retirement program. Currently this opportunity is only available to new employees who are fully vested prior to their hire date.

Adds to existing law to allow certain labels to satisfy any requirements for a warning regarding health or safety or any other provision or doctrine of state law.
This legislation amends Idaho Code, Title 22, Chapter 34 and Idaho Code, Title 48, Chapter 6 regarding pesticides and the Idaho Consumer Protection Act. Pesticide labeling is regulated by state and federal laws under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). This legislation clarifies that existing regulations of pesticide labels shall be sufficient to satisfy any requirements for a warning regarding health or safety of such products.

Amends existing law to revise the quorum requirements for meetings of school district boards of trustees.
This legislation amends section 33-510 to change the quorum requirement for school boards. Currently, a quorum is defined as a majority of the members of a school board, and this legislation changes the quorum to a majority of the filled seats on a school board.

Amends existing law to revise provisions regarding electioneering activities near polling places, to provide certain qualifications, and to revise penalties for violations.
To maintain the integrity of elections and to provide voters a polling place free from interference or intimidation, this legislation clarifies and augments the prohibitions against electioneering and related activity at the polls. The penalty for violating electioneering prohibitions is also expanded to include an increased fine amount and a misdemeanor conviction for repeat offenders.

Amends existing law to establish provisions regarding prisoners who secure employment with a private employer.
This legislation applies to Idaho inmates hired by a private employer under the Department of Correction work releaseprogram. Itspecifiestheresponsibilityoftheprivateemployertoofferthesamesalaryrangeandbenefits as other similarly situated employees based on experience, education and other qualifications and clarifies the opportunity for inmates to use the benefits offered.
