Amends existing law to provide for the use of development impact fees for public school facilities.

This bill adds public schools to the list of public facilities and school districts to the list of government entities allowed to use the statutory development impact fee mechanism to fund capital improvements attributable to new growth and development. The Local Land Use Planning Act identifies and specifically names school districts as governmental entities to be notified or considered in mitigating development impacts in at least four sections. To achieve consistency and uniformity in addressing and mitigating the effects of new growth and development, adding school districts to the development impact fee code accomplishes the intent contemplated in the local land use planning act and places statutory limits on the amount of school impact mitigation a local jurisdiction can exact from new development.

DEPARTMENT OF CORRECTION- Relates to the appropriation to the Department of Correction for fiscal year 2023.

This is an FY 2023 supplemental appropriation to the Idaho Department of Correction. The Department of Correction received an appropriation to pay off the lease for its correctional alternative placement facility last fiscal year and an ongoing reduction to the budget for the lease payment. The lease payment was reduced from the incorrect expense class and this bill makes the correction to align the appropriation in the correct expense class.

States findings of the Legislature, expresses concern over the proposed Lava Ridge Project, and supports a no-build option.

Currently, there is an application pending before the Bureau of Land Management to approve the placement of approximately 400 wind turbines in Jerome, Lincoln, and Minidoka Counties. There has been near unanimous opposition to the project by local governments, including counties and highway districts. The short-term build-out impacts will severely impact the local economy. The long-term impact of the public access, agricultural uses and wildlife are of concern to the citizens of the Magic Valley. This Concurrent resolution will highlight the concerns of the Magic Valley and request the Governor and Attorney General to take what legal actions are available to encourage the BLM to select the no build option.

This is the FY 2024 original appropriation bill for the Secretary of State. It appropriates a total of $14,764,600 and caps the number of authorized full-time equivalent positions at 35.50. The bill funds eight line items. Line item 2 provides cybersecurity software; line item 3 provides 1.00 FTP for a customer service representative for business filings; line item 4 provides 1.00 FTP for a voting system specialist; line item 5 provides 1.00 FTP for a campaign finance specialist; line item 6 provides 1.00 FTP for a lobbyist specialist; line item 7 provides 0.50 FTP for a land board liaison; line item 9 provides for publication of the Idaho Blue Book; and line item 12 provides for an elections system upgrade. Also included is a FY 2023 supplemental appropriation of $81,400 and authorization of an additional 2.00 FTP to allow the office to hire three new staff - an executive assistant, elections data scientist, and elections education coordinator.

Amends existing law to revise provisions regarding property tax exemptions for hospitals.

This Legislation amends section 63-602D of Idaho Code by revising language regarding hospital property tax exemptions. For a medical facility to be exempt from property taxation it must meet the definition of a hospital as defined in Idaho Code Chapter 13, title 39. Administrative and medical facilities not contained within a hospital do not qualify for an exemption. Any property losing an exemption will not be included on any new construction roll.

Adds to existing law to provide for the crime of critical infrastructure trespass, to provide penalties, to provide exceptions, and to authorize the attorney general to prosecute certain persons.

This legislation creates a penalty for critical infrastructure trespass. The bill mirrors large sections of existing trespasslaw, includingprovidingformisdemeanorandfelonychargesbasedonthecircumstancesoftheaction. For individuals who plead or are found guilty of a misdemeanor, sentencing may include up to six months in jail and a fine up to $1,000. For individuals who plead or are found guilty of a felony, sentencing includes up to 10 years in a state penitentiary and a fine up to $10,000. A separate fine up to $100,000 exists for an individual or organization that solicits critical infrastructure trespass.

Amends existing law to require that daycare facilities provide citation to the immunization exemption law in communications with parents.

This legislation requires licensed daycare facilities to notify parents or guardians of their right to vaccine exemptions anytime the licensed daycare facilities communicate with parents regarding vaccination requirements. Vaccine exemptions for children attending licensed daycare facilities exist in Idaho code 39-1118. With the addition of this legislation, any notifications to parents or guardians regarding vaccinations must include a description of their right to exempt their child.

Thestatutory update is needed in order to add this category of caregivers as an approved group per FBI requirements.
