Amends existing law to revise provisions regarding a brewer's license.
This bill consolidates the “brew pub” license and “retail” license into one license, a “brewer’s retail” license. This bill also provides that a brewery can maintain their retail privileges should they exceed 30,000 barrels of annual production, provided that it has continuously maintained a physical presence and continuously brewed beer in Idaho for at least five (5) years. The brewery will not lose its ability to operate a pub at its brewery or one remote retail location, provided the brewer has a clean record with no major violations from the Idaho State Police – Alcohol Beverage Control Division, and the Idaho State Tax Commission.

Amends existing law to revise a provision regarding the salary of the justices of the Supreme Court.
across-the-board increase, plus an additional 2% merit-based raise, for permanent employees of the state. Judicial Salaries must be separately established by the Legislature and are set forth in section 59-502, Idaho Code, which also indexes such salaries to a Supreme Court Justice’s salary to avoid salary compression between the four types of judgeships. To accomplish the intent of both the budget process as well as the salary statute, a 3% increase to the current Magistrate Judge salary is first calculated. This calculation results in a $4,296 salary increase, which is then added to the Supreme Court Justice salary so as to maintain the salary differentials currently existing in section 59-502, Idaho Code. This results in a $4,296 salary increase per judicial officer. This bill sets the annual salary of a justice of the Supreme Court at $169,508, which is a 2.6% increase of their current salary. As set forth in Idaho Code, the difference between the salary of a Supreme Court Justice and a Court of Appeals Judge remains at $8,000 (resulting in a 2.7% salary increase for Court of Appeals Judges); the difference between the salary of a Court of Appeals Judge and a District Judge remains at $6,000 (resulting in a 2.8% salary increase for District Judges); and the difference between the salary of a District Judge and a Magistrate Judge remains at $8,000 (resulting in a 3.0% salary increase for Magistrate Judges).

Amends existing law to establish provisions regarding concealed weapons on certain property owned by the State of Idaho.
This legislation concerns the right to carry a firearm on certain public property in the state of Idaho and is intended to clarify the legislature’s policy following the June 2023 decision of the Idaho Supreme Court in Herndon v. Sandpoint. The changes clarify policy regarding property owned by the state or its political subdivisions that is normally and habitually open to the public but is being leased, rented or provided by contract to groups that are holding private, invitation-only events or events that charge admission. In the cases where public property is normally open to the public and concealed weapons would normally be allowed, the only restrictions that may be invoked on that property are when a private group has contracted to use the property for an event that is private and by invitation only, or where a commercial event occurs and there is a price charged for admission.

Amends existing law to revise a penalty for vehicular manslaughter.
This legislation amends Section 18-4007, Idaho Code, by addition of a mandatory minimum sentence for an individual who has previously been found guilty of a violation of driving under the influence and is again found guilty of driving under the influence, along with vehicular manslaughter.

Amends existing law to provide for certain distribution of funds to public charter schools.
This bill restores public charter school facility funds, which were inadvertently reduced by the passage of H. 292 in 2023. It sets minimum funding at $400 per student. From FY 2021 to FY 2023, the per-student amount fluctuated between $389 and $422 per student. This is not intended to increase funding; it simply puts the schools in approximately the same positions they were in before. Additionally, it specifies that future virtual charter schools and school districts that authorize virtual charter schools are not eligible for these funds. It also provides that, if H. 521 passes, a school district that authorizes a virtual charter school and receives funding from the school modernization facilities fund, may not also receive these funds.

Amends and adds to existing law to revise provisions regarding voting machines, certain duties of election officials, and the payment of election expenses by counties and provides for public voting machine accuracy tests.
This legislation will prohibit voting systems in Idaho from being able to connect to the internet, it will also make it so that tampering with any voting system will now be considered a felony, included also gives the Secretary of State the authority to grant access to voting systems. This legislation also requires county clerks to conduct voting system accuracy testing that is open to the public prior to all elections. This bill also updates old, outdated legacy voting system language.

Amends existing law to authorize a school employee who possesses an enhanced license to carry concealed weapons to carry on school property in certain instances.
This legislation requires that schools in Idaho adopt policies and procedures as it relates to school employees and their ability to conceal carry firearms for school safety purposes. Schools shall adopt policies for qualifying and authorizing employees to conceal carry. Prerequisites shall include initial and yearly refresher training in consultation with Idaho’s law enforcement agencies. Requirements are established at the local level by the governing boards of each education agency. They shall work with staff, parents, community members, and law enforcement groups in establishing policy that works best in their school districts and communities. This legislation protects the confidentiality of the employee by ensuring their approval is exempt from disclosure. Policies and procedures regarding the process of authorization will be made available to parents and the public. Additionally, this legislation requires that any “gun free school zone” signs are accompanied with additional signage indicating there are staff who are armed in accordance with the provisions in this statute.
Amends existing law to revise provisions regarding procurement of public works construction, services, and personal property.
This legislation modifies and updates Idaho Code procurement statutes requirements relating to political subdivisions public works bid thresholds. The threshold modifications are a result of the rise in inflation and the increase in the overall estimated costs associated with public works construction projects.
Amends existing law to establish provisions regarding prisoners who secure employment with a private employer.
This legislation applies to Idaho inmates hired by a private employer under the Department of Correction work releaseprogram. Itspecifiestheresponsibilityoftheprivateemployertoofferthesamesalaryrangeandbenefits as other similarly situated employees based on experience, education and other qualifications and clarifies the opportunity for inmates to use the benefits offered.
