Adds to existing law to provide eligibility requirements and to provide for services.
Family should be able to honor their veteran loved ones at the Idaho veteran’s cemetery and utilize the facilities to do so if the deceased is eligible for honors and the facility is available. There should not be a requirement of the Idaho veteran’s cemetery being the final resting place.

Amends existing law to revise a provision regarding the preparation and filing of a budget request.
This legislation creates parity and consistency for budget deadlines in all three branches of government. Currently, only executive branch agencies are required to meet a September 1st deadline to submit budget requests. Aligning the deadlines for all budgets, with limited exceptions, will create efficiency in budget preparation and review for budget development. There is no specific penalty for not meeting this requirement since it is understood that all branches of government are required to follow statutes.

Amends existing law to provide for the reemployment of certain retired members under certain circumstances.
This legislation is to repeal language in Section 59-1356 Idaho Code that deals with first responders and the conditions under which they could retire and then return to work within 30 days with no break in service. S 1054 passed in the 2023 session allowing first responders 50 years of age and older to retire, then return to work within 30 days while continuing to receive PERSI retirement benefits. The practical application of that effort has proved to be contrary to the intent. This legislation simply repeals the language in S 1054 from the 2023 session.

Amends existing law to allow for the establishment of specialty license plates for the benefit of the Idaho State Board of Education and to establish a Don't Tread on Me license plate to generate funds for an existing gun safety education program.
This legislation amends section 49-402 and 49-402D of Idaho Code to provide for the State Board of Education to be a permissible beneficiary of the Gadsden “Don’t Tread On Me” license plate. This legislation further amends section 33-1628 of Idaho Code to establish a firearm safety grant fund and program for the purposes of firearms safety education currently found in section 33-1628 of Idaho Code.

Removing weight limit restrictions for vehicle owners wishing to purchase personalized license plates. Under this legislation, restrictions would remain on disability and dealer license plates.

Amends, repeals, and adds to existing law regarding irrigation and drainage rights-of-way.
Thislegislationupdateschapters11and12ofTitle42andonesectionofTitle18thataddressditchrights-of-way (ROW), operation and maintenance duties, interference and encroachments. This legislation: consolidates provisions that pertain to the same subject; repeals antiquated provisions that are no longer in use, and clarifies provisions based on recent Idaho Supreme Court decisions and contemporary experience: (1) laterals and drains will be added to the chapter 11 statutes that deal with ditch ROW existence, establishment and rights; (2) the circumstances in which a land owner has notice of a ditch ROW will be clarified in 42-1102(3); (3) ditch operation and maintenance duties will be defined in one statute (I.C. 42-1201), rather than five (I.C. 42-1102(3), 42-1201, 42-1202, 42-1203, 42-1204); (4) the following antiquated provisions will be repealed: I.C. 42-1108 (right to cross ditches); I.C. 42-1205 (bridges over ditches); I.C. 42-1206 (repair of community ditches), and (5) the written permission, encroachment removal and “self-help” provisions (as interpreted by the Idaho Supreme Court in Pioneer v. Caldwell, 153 Idaho 593, at 599-600 (2012)) are codified in the ditch encroachment provisions of 42-1102(5) and 42-1209(2), and in the ditch relocation and piping provision on 42-1207(1)(e) (addressing the Idaho Supreme Court’s decision in Hood v. Poorman, 519 P.3d 769 2022, to make it clear that the ditch owner’s “self-help” remedy applies to ditch relocation and piping as well as ditch ROW encroachments).

Amends existing law to provide an exemption for certain violations for licensed children's residential care facilities, registered children's institutions, and behavioral health youth crisis centers that provide emergency runaway services.
This legislation aims to ensure licensed homeless youth shelters and behavioral health youth crisis centers can adequately serve homeless and runaway youth. It modifies Code so that these facilities are not guilty of a misdemeanor violation for housing a runaway child under specific circumstances, where the child consents to shelter, care, or licensed service; the shelter is unable to locate the child’s parent or legal guardian, or the child refuses to disclose the contact information for the parent or legal guardian; and the facility notifies the county sheriff or police of the child’s whereabouts pursuant to local laws and licensure requirements. This legislation also still requires shelters to follow all mandatory reporting processes under Idaho Code.

Amends existing law to provide that a disabled veteran may obtain disabled veteran license plates for up to two vehicles.
This proposal allows disabled veterans to acquire up to two disabled veteran license plates for free instead of only one, in the event a veteran needs another plate for a second vehicle.

This legislation clarifies that the jurisdiction of the Idaho Public Utilities Commission does not include corporations or others owning, controlling, or operating a water system which delivers water to a single entity that is not subject to regulation by the Commission. It also confirms that homeowners associations, cooperative associations and water districts are not subject to regulation by the Commission.

The bill also provides continued funding for the Digital Access for Idahoans Grant, reappropriation authority, and language regarding the accountability of appropriated funds and telehealth facilities.

Amends existing law to provide for the modification of boundaries of divisions in irrigation districts.
When an irrigation district is formed, Idaho law provides that the Board of County Commissioners establish the divisions from which board members are elected. Generally, board members live in the division they represent. In recent years, it has become increasingly difficult for irrigation districts to find qualified individuals to serve on their boards. In some instances, it may be necessary to amend irrigation district divisions. Idaho Law does not include any process for such an amendment. This legislation amends Idaho Code to allow the Board of County Commissioners to amend the division boundaries of an irrigation district.

Amends existing law to provide that certain outfitters shall be provided the opportunity to purchase an additional bighorn sheep, mountain goat, or moose tag.
This proposal allows an opportunity for outfitters who fill wolf tags to purchase additional big game tags in those units where wolves have been taken.
Amends existing law to provide that there shall be no statute of limitations for the crime of incest.
This legislation removes the statute of limitations from the crime of incest.

Amends existing law to prevent a commercially sexually exploited child from being charged with prostitution.
Currently a child under eighteen can be charged with prostitution. This legislation would define a sexually exploited child and provide law enforcement the ability to remove the exploited child without arrest.

Adds to existing law to prohibit entry onto private property by law enforcement and conservation officers unless certain conditions are met.
This legislation will codify the findings of several state supreme courts to protect private property rights and privacy rights of Idaho citizens against unreasonable search and seizure.

Adds to existing law to provide that a counselor or therapist practicing in Idaho shall not be required to counsel a client in support of goals, outcomes, or behaviors that conflict with the sincerely held religious, moral, or ethical principles of the counselor or therapist.
The legislation protects counselors in their fundamental rights of conscience by allowing them to decline to provide services in support of objectives which violate their sincerely held principles without fear of loss of licensure or civil or criminal action. It also provides for declaratory or injunctive relief.

Adds to existing law to establish costs and a timeline for the provision of medical records.
This legislation amends Title 39, Idaho Code, to set a reasonable maximum charge to patients obtaining a copy of their own records from a physician or other health care service. Idaho provides no guidelines, and this legislation is intended to prevent price gouging of a patient in receiving a copy of their own medical records.
Amends existing law to establish provisions for electroconvulsive treatment for children.
Idaho law currently allows for electroconvulsive therapy (ECT) for adults through informed consent to treatment and for children with a court order. ECT has been demonstrated to be effective in treating severe depression and other psychological disorders that are resistant to pharmaceutical treatment and other interventions. This legislation sets a minimum age of twelve (12) years old for ECT and provides parents with the ability to provide informed consent to treatment.

Adds to existing law to establish a medicaid legislative review panel.
This legislation is to amend Title 56 of Idaho Code to add a new section to establish a Medicaid Legislative Review Panel. The panel will be responsible for reviewing contracts related to Medicaid and will be comprised of both House and Senate members.

Adds to existing law to establish the Higher Education Fairness Act to prohibit diversity, equity, and inclusion positions, diversity training, and political loyalty tests in higher education.
This legislation protects the Constitutional right to equal protection under the law in Idaho's institutions for higher education. It creates a new Chapter 68, Title 33, Idaho Code to prevent Idaho's public colleges and universities from establishing diversity, equity, and inclusion bureaucracies. It bars the use of public funds to support diversity, equity, and inclusion offices, officers, and employees. It bans the use of political loyalty tests when selecting candidates for employment or college admission. Finally, it also prohibits mandatory diversity training for students, faculty, and employees at Idaho's public institutions for higher education.
Adds to existing law to allow public schools to display only certain flags and banners on school property and to prohibit schools from displaying certain flags and banners.
The classroom is a place to foster education and to do so, students should be comfortable and free from partisan politics. Personal political beliefs disrupt the classroom and make students uncomfortable, feel unwelcome and open the door to bullying if they are in the minority mindset. Third party flags are an open political statement and do not belong in the classroom.

Amends existing law to establish provisions regarding prisoners who secure employment with a private employer.
This legislation applies to Idaho inmates hired by a private employer under the Department of Correction work releaseprogram. Itspecifiestheresponsibilityoftheprivateemployertoofferthesamesalaryrangeandbenefits as other similarly situated employees based on experience, education and other qualifications and clarifies the opportunity for inmates to use the benefits offered.
