STATEMENT OF PURPOSE

To ensure that state laws are streamlined, up-to-date, and essential for the citizens of Idaho, while best serving public health, safety, and welfare, the Legislature approved the Idaho Code Cleanup Act, H14 in the 2025 Legislative session. Submitted sections of Idaho Code were reviewed for repeal consideration by the DOGE Task Force on the criteria of obsolete, outdated, and unnecessary. This bill repeals or updates two sections of Idaho Code pertaining to State Controller and LUMA. The bill repeals Section 67-1021C that established the Business Information Infrastructure Fund that was used for the implementation of LUMA. The bill updates Section 67-1021A that established the revenue source for the Business Information Infrastructure Fund, which sunset on June 30, 2023.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE SENATE SENATE BILL NO. 1320 BY STATE AFFAIRS COMMITTEE AN ACT1 RELATING TO THE STATE CONTROLLER; PROVIDING LEGISLATIVE INTENT; REPEALING2 SECTION 67-1021C, IDAHO CODE, RELATING TO THE BUSINESS INFORMATION IN-3 FRASTRUCTURE FUND; AMENDING SECTION 67-1021A, IDAHO CODE, TO REMOVE OB-4 SOLETE PROVISIONS; AND DECLARING AN EMERGENCY AND PROVIDING AN EFFEC-5 TIVE DATE.6
Be It Enacted by the Legislature of the State of Idaho:7
SECTION 1. IDAHO CODE CLEANUP -- LEGISLATIVE INTENT. It is the intent8 of the Legislature to ensure that the state laws provided in Idaho Code are9 streamlined, up-to-date, and essential for the citizens of Idaho, while best10 serving the public health, safety, and welfare. In accordance with the Idaho11 Code Cleanup Act, following comprehensive review, the Legislature has iden-12 tified the provisions of this act as obsolete, outdated, or unnecessary.13
SECTION 2. That Section 67-1021C, Idaho Code, be, and the same is hereby14 repealed.15
SECTION 3. That Section 67-1021A, Idaho Code, be, and the same is hereby16 amended to read as follows:17 67-1021A. BUSINESS INFORMATION INFRASTRUCTURE PROJECT. (1) Notwith-18 standing any laws to the contrary, the state controller shall engage in a19 project to modernize and replace the state's aging business information in-20 frastructure, including its financial, payroll, human capital management,21 budget and procurement systems. The purpose of the project shall be to mod-22 ernize the state's business information infrastructure and to consolidate23 duplicative business systems into a centralized enterprise resource plan-24 ning system in order to achieve standardized business practices and greater25 transparency in the state's data.26 (2) The cost of modernizing the state's business information infra-27 structure shall be equitably distributed among and between all state and28 public entities that use the services and functions outlined in subsection29 (1) of this section. On or before June 30 of each year from the effective30 date of this act until and including June 30, 2023, all moneys deposited to31 the indirect cost recovery fund resulting from the assessment of the amounts32 allocated in the annual statewide indirect cost allocation plan pursuant33 to section 67-3531, Idaho Code, shall be transferred to the business infor-34 mation infrastructure fund established in section 67-1021C, Idaho Code.35 Transfers under this section shall occur as requested by the state con-36 troller and no later than June 30 of each year.37
SECTION 4. An emergency existing therefor, which emergency is hereby38 declared to exist, this act shall be in full force and effect on and after39 July 1, 2026.40
