STATEMENT OF PURPOSE

RS33840 / H0957 To ensure that state laws are streamlined, up-to-date, and essential for the citizens of Idaho, while best serving the public health, safety, and welfare, the Legislature approved the Idaho Code Cleanup Act, H14 in the 2025 legislative session. Submitted sections of Idaho Code were reviewed for repeal consideration by the DOGE Task Force on the criteria of obsolete, outdated, and unnecessary. This bill repeals 9 Sections of Idaho Code in Title 42 pertaining to the Idaho Department of Water Resources. Sections include references to groundwater recharge negotiations with the Federal Bureau of Reclamation, the Salmon Falls Creek Water Compact and the Water Conservation and Development Trust Account. The Salmon Falls Creek Water Compact was never adopted. The Water Conservation and Development Trust Account has been inactive since at least 1994.

Be It Enacted by the Legislature of the State of Idaho:17
SECTION 1. IDAHO CODE CLEANUP -- LEGISLATIVE INTENT. It is the intent18 of the Legislature to ensure that the state laws provided in Idaho Code are19 streamlined, up-to-date, and essential for the citizens of Idaho, while best20 serving the public health, safety, and welfare. In accordance with the Idaho21 Code Cleanup Act, following comprehensive review, the Legislature has iden-22 tified the provisions of this act as obsolete, outdated, or unnecessary.23
SECTION 2. That Section 42-232, Idaho Code, be, and the same is hereby24 repealed.25
SECTION 3. That Section 42-1704, Idaho Code, be, and the same is hereby26 repealed.27
SECTION 4. That Section 42-1776, Idaho Code, be, and the same is hereby28 repealed.29
SECTION 5. That Section 42-3307, Idaho Code, be, and the same is hereby30 repealed.31
SECTION 6. That Section 42-3308, Idaho Code, be, and the same is hereby32 repealed.33
SECTION 7. That Section 42-3309, Idaho Code, be, and the same is hereby34 repealed.35
SECTION 8. That Section 42-3310, Idaho Code, be, and the same is hereby36 repealed.37

SECTION 9. That Section 42-3311, Idaho Code, be, and the same is hereby1 repealed.2

SECTION 11. An emergency existing therefor, which emergency is hereby5 declared to exist, this act shall be in full force and effect on and after6 July 1, 2026.7
