To ensure that state laws are streamlined, up-to-date, and essential for the citizens of Idaho, while best serving the public health, safety, and welfare, the Legislature approved the Idaho Code Cleanup Act, H14 in the 2025 legislative session. Submitted sections of Idaho Code were reviewed for repeal consideration by the DOGE Task Force on the criteria of obsolete, outdated, and unnecessary. This bill repeals 30 sections of Idaho Code in Title 38 and Title 58 pertaining to the Idaho Department of Lands and floating timber and Town Site Claims. Transporting logs by floating them down river is no longer common practice. The town site claim framework dates to the territorial era.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 568 BY RESOURCES AND CONSERVATION COMMITTEE AN ACT1 RELATING TO THE DEPARTMENT OF LANDS; PROVIDING LEGISLATIVE INTENT; AMEND-2 ING THE HEADING FOR CHAPTER 8, TITLE 38, IDAHO CODE; REPEALING SECTION3 38-802, IDAHO CODE, RELATING TO FLOATING TIMBER; REPEALING SECTION4 38-803, IDAHO CODE, RELATING TO FLOATING TIMBER; REPEALING SECTION5 38-804, IDAHO CODE, RELATING TO FLOATING TIMBER; REPEALING SECTION6 38-805, IDAHO CODE, RELATING TO FLOATING TIMBER; REPEALING SECTION7 38-806, IDAHO CODE, RELATING TO FLOATING TIMBER; REPEALING SECTION8 38-807, IDAHO CODE, RELATING TO FLOATING TIMBER; REPEALING SECTION9 38-1210, IDAHO CODE, RELATING TO LOG SCALING; REPEALING CHAPTER 8,10 TITLE 58, IDAHO CODE, RELATING TO TOWN SITE CLAIMS; AND DECLARING AN11 EMERGENCY AND PROVIDING AN EFFECTIVE DATE.12

Be It Enacted by the Legislature of the State of Idaho:13

SECTION 1. IDAHO CODE CLEANUP -- LEGISLATIVE INTENT. It is the intent14 of the Legislature to ensure that the state laws provided in Idaho Code are15 streamlined, up-to-date, and essential for the citizens of Idaho, while best16 serving the public health, safety, and welfare. In accordance with the Idaho17 Code Cleanup Act, following comprehensive review, the Legislature has iden-18 tified the provisions of this act as obsolete, outdated, or unnecessary.19

SECTION 2. That the Heading for Chapter 8, Title 38, Idaho Code, be, and20 the same is hereby amended to read as follows:21 CHAPTER 822 FLOATING TIMBER23

SECTION 3. That Section 38-802, Idaho Code, be, and the same is hereby24 repealed.25

SECTION 4. That Section 38-803, Idaho Code, be, and the same is hereby26 repealed.27

SECTION 5. That Section 38-804, Idaho Code, be, and the same is hereby28 repealed.29

SECTION 6. That Section 38-805, Idaho Code, be, and the same is hereby30 repealed.31

SECTION 7. That Section 38-806, Idaho Code, be, and the same is hereby32 repealed.33

SECTION 8. That Section 38-807, Idaho Code, be, and the same is hereby34 repealed.35

SECTION 9. That Section 38-1210, Idaho Code, be, and the same is hereby1 repealed.2

SECTION 10. That Chapter 8, Title 58, Idaho Code, be, and the same is3 hereby repealed.4

SECTION 11. An emergency existing therefor, which emergency is hereby5 declared to exist, this act shall be in full force and effect on and after6 July 1, 2026.7
