LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 838 BY APPROPRIATIONS COMMITTEE AN ACT1 RELATING TO THE STATE BUDGET; AMENDING SECTION 67-3507, IDAHO CODE, TO PRO-2 VIDE FOR THE EXECUTIVE BUDGET DOCUMENT TO INCLUDE CERTAIN INFORMATION3 PERTAINING TO CERTAIN RECOMMENDATIONS AND TO MAKE A TECHNICAL CORREC-4 TION; AND DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE.5

Be It Enacted by the Legislature of the State of Idaho:6

SECTION 1. That Section 67-3507, Idaho Code, be, and the same is hereby7 amended to read as follows:8 67-3507. EXECUTIVE BUDGET. (1) The executive budget document shall9 consist of the following four (4) parts:10 (1) (a) Part I of the executive budget document shall consist of a bud-11 get message by the governor that shall outline the financial plan of the12 executive department of the state government for the next fiscal year,13 describing the important features of the financial plan.14 (2) (b) Part II of the budget document shall present in detail for the15 next fiscal year, as minimum information to be included in Part part II,16 items showing estimates of agency needs based on the governor's recom-17 mendations to meet the expenditure needs of the state from all available18 funds classified by agencies and showing the cost of each major program.19 Part II shall also set forth the governor's recommendations for the cap-20 ital program. All moneys, including federal and local moneys and inter-21 agency receipts received for any purpose, shall be accounted for in the22 budget.23 (3) (c) Part III of the budget document shall consist of the annual per-24 formance plans required in section 67-1904, Idaho Code.25 (4) (d) Part IV of the budget document shall consist of the federal26 funding reports required under section 67-1917, Idaho Code, and the27 disclosures required under section 67-3502(1)(e), Idaho Code.28 (2) If the executive budget document contains a recommendation that29 would require the legislature to pass legislation in order for such recom-30 mendation to be implemented, the budget document shall include:31 (a) A draft of any legislation necessary to implement such recommenda-32 tion; and33 (b) The names of at least one (1) member of the house of representatives34 and at least one (1) member of the senate who are willing to sponsor such35 legislation.36 (3) If the executive budget document contains a recommendation that37 would require the legislature to pass conditions, limitations, and re-38 strictions language in order for such recommendation to be implemented, the39 budget document shall include draft conditions, limitations, and restric-40 tions language necessary to implement any such recommendation.41

SECTION 2. An emergency existing therefor, which emergency is hereby1 declared to exist, this act shall be in full force and effect on and after2 July 1, 2026.3
