STATEMENT OF PURPOSE

To ensure that state laws are streamlined, up-to-date, and essential for the citizens of Idaho, while best serving public health, safety, and welfare, the Legislature approved the Idaho Code Cleanup Act, H14 in the 2025 Legislative session. Submitted sections of Idaho Code were reviewed for repeal consideration by the DOGE Task Force on the criteria of obsolete, outdated, and unnecessary. This bill repeals three sections of Idaho Code pertaining to alcoholic beverages: 23-103, Idaho Code, is a prohibition era law pertaining to individuals who had been convicted of a crime prior to the Liquor Act of 1939. 23-215, Idaho Code, is a provision on price lists furnished by sellers. Price lists are compiled and provided by a third-party on a statewide basis. 23-216, Idaho Code, requires contact information for attorneys that represent businesses interested in the sale of liquors or wines be filed with the State Liquor Division.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 799 BY STATE AFFAIRS COMMITTEE AN ACT1 RELATING TO ALCOHOLIC BEVERAGES; PROVIDING LEGISLATIVE INTENT; REPEALING2 SECTION 23-103, IDAHO CODE, RELATING TO PRIOR OFFENSES AND RIGHTS NOT3 AFFECTED; REPEALING SECTION 23-215, IDAHO CODE, RELATING TO PRICE LISTS4 TO BE FURNISHED BY SELLERS; REPEALING SECTION 23-216, IDAHO CODE, RE-5 LATING TO THE ATTORNEY OR AGENT OF SELLERS; AND DECLARING AN EMERGENCY6 AND PROVIDING AN EFFECTIVE DATE.7
Be It Enacted by the Legislature of the State of Idaho:8
SECTION 1. IDAHO CODE CLEANUP -- LEGISLATIVE INTENT. It is the intent9 of the Legislature to ensure that the state laws provided in Idaho Code are10 streamlined, up-to-date, and essential for the citizens of Idaho, while best11 serving the public health, safety, and welfare. In accordance with the Idaho12 Code Cleanup Act, following comprehensive review, the Legislature has iden-13 tified the provisions of this act as obsolete, outdated, or unnecessary.14
SECTION 2. That Section 23-103, Idaho Code, be, and the same is hereby15 repealed.16
SECTION 3. That Section 23-215, Idaho Code, be, and the same is hereby17 repealed.18
SECTION 4. That Section 23-216, Idaho Code, be, and the same is hereby19 repealed.20
SECTION 5. An emergency existing therefor, which emergency is hereby21 declared to exist, this act shall be in full force and effect on and after22 July 1, 2026.23
