The growth of out of state contributions to Idaho election campaigns has been dramatic in recent years and should concern every Idahoan. During the 2024 election cycle, more money was spent from out of state on negative advertising than from within the state. In light of this, this legislation modifies Section 67-6610D of Idaho Code, which prohibits foreign contributions to elections, and adds out of state contributions and expenditures to the list of prohibited categories.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 719 BY STATE AFFAIRS COMMITTEE AN ACT1 RELATING TO CAMPAIGN FINANCE; AMENDING SECTION 67-6610D, IDAHO CODE, TO2 PROHIBIT OUT-OF-STATE CONTRIBUTIONS AND EXPENDITURES; AND DECLARING AN3 EMERGENCY AND PROVIDING AN EFFECTIVE DATE.4
Be It Enacted by the Legislature of the State of Idaho:5
SECTION 1. That Section 67-6610D, Idaho Code, be, and the same is hereby6 amended to read as follows:7 67-6610D. FOREIGN CONTRIBUTIONS, FOREIGN INDEPENDENT EXPENDITURES,8 AND FOREIGN ELECTIONEERING COMMUNICATIONS PROHIBITED -- OUT-OF-STATE CON-9 TRIBUTIONS AND INDEPENDENT EXPENDITURES PROHIBITED. (1) A foreign national10 shall not make a contribution, directly or indirectly, to any candidate,11 political committee, or measure or make electioneering communications or12 independent expenditures. An out-of-state person shall not make a contri-13 bution, directly or indirectly, to any candidate, political committee, or14 measure or make independent expenditures.15 (2) As used in this section, "foreign national":16 (a) "Foreign national" means:17 (a) (i) An individual who is not a citizen of the United States and18 is not lawfully admitted for permanent residence;19 (b) (ii) A government or subdivision of a foreign country;20 (c) (iii) A foreign political party; or21 (d) (iv) Any entity, such as a partnership, association, corpora-22 tion, organization, union, or other combination of persons, that23 is organized under the laws of or has its principal place of busi-24 ness in a foreign country.25 (b) "Legal resident of Idaho" means an individual who is a citizen of26 the United States and who has resided in Idaho for at least thirty (30)27 days.28 (c) "Out-of-state person" means:29 (i) An individual who is not a legal resident of Idaho; or30 (ii) Any entity, such as a partnership, association, corporation,31 organization, union, or other combination of persons, that is or-32 ganized under the laws of or has its principal place of business in33 another state and does not maintain a physical office in the state34 of Idaho.35 (3) A violation of the provisions of this section shall be prosecuted36 and punished as provided in section 67-6625(2) through (5), Idaho Code. Pro-37 vided, however, any person who knowingly and willfully violates the provi-38 sions of this section is guilty of a felony when:39 (a) The aggregate amount of contributions, independent expenditures,40 or cost of electioneering communications made in violation of this sec-41
2 tion exceeds one thousand dollars ($1,000) in a consecutive twelve (12)1 month period; or2 (b) The person pleads guilty to or is found guilty of a knowing and will-3 ful violation of the provisions of this section for a second time within4 ten (10) years, notwithstanding the form of the judgment or withheld5 judgment.6 (4) If any provision of this section or its application to any person or7 circumstance is held invalid, the remainder of the section or the applica-8 tion of the provision to other persons or circumstances is not affected.9
SECTION 2. An emergency existing therefor, which emergency is hereby10 declared to exist, this act shall be in full force and effect on and after11 July 1, 2026.12
