Adds to existing law to prohibit distribution of certain materials to children.

The Children's School and Library Protection Act requires public schools and community libraries to take reasonable steps to restrict children's access to material that is obscene or harmful to minors. Any minor child who accesses such material in violation of this policy would be entitled to bring a civil action against the school or library.

Idaho Law restricts distribution, promotion, or dissemination of obscene materials to minors. This Bill amends Idaho Code §§ 18-1520 and 18-1521. It will add certain organizations and establishments that the district court has the jurisdiction with regards to distribution of such materials to minors. It also revises the provisions on the enforcement and banning of ordinances, rules and regulations relating to sale, loan, and distribution of harmful materials to minors.

The Children's School and Library Protection Act requires public schools and community libraries to take reasonable steps in restricting children's access to obscene or harmful material. A parent or guardian of a minor child who accesses such material in violation of this policy would be entitled to bring a civil action against the school or library for damages and injunctive relief.
