Amends existing law to revise a provision regarding an application for a marriage license.
In 1999, the legislature added the requirements in Section 32-403(2), Idaho Code, for obtaining a marriage license. The word "department" in subpart (iii) is undefined and it is unclear to county clerks, who issue marriage licenses, which department could add additional requirements for proof of lawful presence in the United States. This bill removes the confusing language but maintains the intent of the policy the legislature adopted in 1999 with the addition of subsection (2) to Section 32-403, Idaho Code.
