Repeals, amends and adds to existing law to provide for a nonpartisan election of county, state and district officers.
This legislation provides for what is commonly referred to as a Top 2 Primary. All political party and independent candidates for a partisan political office will appear on a single primary ballot and the two candidates receiving the most votes in the primary will be placed on the general election ballot. A voter's abilitytovoteforacandidatewillnolongerbelimitedbywhetherheorsheisregisteredtovoteasamember of a particular political party, and taxpayers will no longer be required to pay for individual political party contests in which they cannot participate.

Amends existing law to clarify language regarding exemptions.
Parents or legal guardians may exempt their minor children from obtaining certain immunizations before starting school. This law would clarify that a parent or guardian need only sign a statement of objection in any form and present it to the school.
Amends and adds to existing law to provide that persons with mental or emotional disabilities may be accompanied by support animals in places open to the public.
Amends existing law to provide additional duties of the board to develop a highway access management system based on objective standards that will balance the economic development objectives of properties abutting state of Idaho highways with the transportation safety and access management objectives of state highways in a manner consistent with certain criteria.
Amends existing law to revise procedures and factors regarding the assessment of damage in eminent domain proceedings.
Amends existing law to revise a provision regarding job evaluation and to provide that the annual survey shall contain certain data.
The intent of this legislation is to remove language that could be construed as proprietary and specific to one particular vendor. It will also require any salary and benefit study to show as part of market comparisons data specific to Idaho public and private sector employers.

Adds to existing law to provide that the state Department of Health and Welfare shall make available certain information regarding cytomegalovirus.

Amends existing law to provide that elected officials shall be ineligible for overtime, to provide that certain employees shall be eligible for overtime and to provide that certain employees shall be ineligible for overtime.
Section 67-5303 Idaho Code provides for the application of the state personnel system on certain employees. Section 67-5303 (j) defines those positions which are part of the public educational system and are non-classified employees. The current language in this section includes a definition of officers and professional staff including pay grade and Hay Points which do not accurately align with Idaho's current pay grades. The proposed legislation would update this section to align with Idaho's current pay grades. Section 59-1607(3) and 67-5328 (3) (a) are amended to remove reference to 67-5303 (j) as those employees are not currently covered by the overtime rules of the FLSA 29 USC part 526 nor under the new FLSA overtime rule effective on December 1, 2016.

Adds to existing law to set forth requirements for state agencies regarding the acquisition and sale of certain properties, to provide that under specified conditions state agencies shall be required to receive permission from county commissioners for acquisition of land and to provide that under specified conditions the Fish and Game Commission shall not be required to sell land due to certain land donations.
Amends existing law to provide that a tax preparer who experiences a data breach must inform the Idaho State Tax Commission.
Amends and adds to existing law to provide Idaho Rotary International specialty license plates.

Amends existing law to provide an exception regarding the visibility of license plates.
Amends existing law to revise provisions regarding skills test fees for commercial driver's licenses.
The purpose of this legislation is to allow the free market to determine prices for the Commercial Driver's License skills testing organization with a cap of $190 for the test. This legislation will allow the Idaho Transportation Department to still receive $10 for administrative purposes. So the total maximum fee will be $200.
Amends and adds to existing law to revise provisions regarding procurement by political subdivisions; and to provide that political subdivisions may use a request for proposal process under certain circumstances.

Amends existing law to clarify prohibited actions against employees.
The proposed amendment would make the subsection (2) consistent with the subsection (1) by adding the same language regarding a good faith requirement in protections for employees who participate or give information in an investigation or other listed proceedings or inquires under the Whistleblower Protection Act, Idaho Code § 6-2104. The clarifying language will specify that an employee who acts in good faith is protectedfromemployerretaliationwhenparticipatingorrevealinginformationinaninvestigation, hearing, court proceeding, legislative or other inquiry.
