This legislation would allow wineries and vintners to use customized private labels on wines for hotels and restaurants that are produced by that winery or vintner, and personalized private labels on wines for consumers that are produced by that winery or vintner. Federal labeling standards shall be followed and the label approved by the Alcohol and Tobacco Tax and Trade Bureau of the United States Department of the Treasury.

Amends existing law to provide that capital gains and losses on precious metal bullion and monetized bullion sales be added to or subtracted from Idaho taxable income under certain circumstances.

The framers of our nation established that gold and silver are money, but federal taxing authorities in recent decades have required taxpayers to report nominal capital "gains" and "losses" when exchanging this form of money for Federal Reserve Notes. Idaho already exempts precious metals sales from the sales tax. This bill will exempt the sale of precious metals bullion from being subject to capital gains.

Amends existing law to revise certain supplier violation provisions; to provide that the fact a dealer agreement allows an event, act or omission does not control whether such event, act or omission resulted in a substantial change in the dealer's competitive circumstances; to provide that a supplier shall provide written notice to an equipment dealer of any substantial change in the dealer's competitive circumstances; and to provide for content of the notice.

The purpose of this legislation is to provide clarification of the original legislative intent of the Idaho Equipment Dealer Protection Statute by prohibiting equipment suppliers from substantially changing the equipment dealer's competitive circumstances without good cause. This legislation also adds clarity to ensure that persons interpreting this statute understand that the terms of a dealer agreement may not impact the determination of whether there has been a substantial change in the dealer's competitive circumstances.

Amends existing law to revise provisions regarding exemptions from a vehicle inspection and maintenance program.

All passenger and light truck motor vehicles from 2007 forward are equipped with an onboard diagnostic computer system that checks vehicle emissions and other critical parameters of vehicle operations. The emissions testing application of the onboard computer uses the same ISO standards that emissions testing machines now use for testing in both Ada and Canyon counties. Data shows that emissions testing failures have been significantly reduced on vehicles model year 2007 forward. This bill amends Idaho Code § 39-116B to change the exemption from testing from vehicles that are 5 years old to vehicles of model year 2007 and newer.

Amends existing law to revise certain exceptions for a certificate of competency requirement.

Section 54-5002, Idaho Code, in relevant part, provides exemptions from HVAC licensure for homeowners (54-5002(4)) and certain maintenance HVAC work (54-5002(1)). The exceptions currently allow property owners of a single or duplex family dwelling to perform HVAC work and allow employers to perform alterations, extensions and new construction on the premises of their place of employment using regularly employed maintenance workers without a certificate of competency (license). The HVAC Board and HVAC industry feel the statute should more clearly indicate that a homeowner should be allowed to perform HVAC work on the owner's primary or secondary residence, accessory buildings, quarters and grounds used for non-commercial purposes. They also feel that in places of employment in commercial buildings, maintenance personnel should be allowed to perform repair and replacements of HVAC equipment, but any alterations, extensions or new construction must be done by a licensed HVAC contractor. These statute changes more clearly define the scope of work in both instances.
