Amends existing law to revise provisions regarding reimbursement from the Driver Training Fund.

A portion of every Idaho resident's driver license fee goes into the driver education account utilized by the Idaho State Department of Education to reimburse local education agencies (LEAs) that provide public driver education programs. LEAs receive $125 in reimbursements for each student who completes the program. While that reimbursement limit has not changed since 1996, the cost of administering Idaho's public school driver training program has continued to increase over time. On average, students paid $173.11 to take a driver training course and LEAs subsidized the program an average of $259,994.24. By increasing the reimbursement to$150perstudent,itwillpreventLEAsfromusingdiscretionaryfundstosupporttheirdrivertrainingprograms and decrease the amount students have to pay in driver training fees to sustain these programs.

Consistent with the Governor's Red Tape Reduction Act, this bill seeks to eliminate inactive provisions of law. Section 73-120 consists of local and special statutes passed in the 1919 session of the legislature that were not general laws and were not incorporated into the code. Repealing this section will therefore have no impact. Among the provisions included in this section was the establishment of a wagon road near Neal, Idaho .

Consistent with the Governor's Red Tape Reduction Act, this bill seeks to eliminate an inactive licensing board. Chapter 38, Title 54, Idaho Codes, established the board of cemeterians in 1989 but the board has not been appointed, nor has a license been issued, in three decades since.

This is the FY 2021 original appropriation bill for the Division of Building Safety. It appropriates a total of $15,974,100 and caps the number of authorized full-time equivalent positions at 152.00. For benefit costs, the bill maintains the current appropriated amount for health insurance at $11,650 per eligible FTP and temporarily removes funding for the employer's sick leave contribution rate. Funding for replacement items includes $278,900 for nine vehicles, computer hardware, laptops, and a server blade. The bill also provides funding for the equivalent of a 2% change in employee compensation for permanent state employees, with an additional 2% increase for those in the 20 job classifications most in need of equity adjustments. The bill funds six line items, which provide 1.00 FTP and $95,100 for a damage prevention program manager; 6.00 FTP and $573,100 for inspectors and support staff; $11,400 for an anonymous tip line; $110,000 for a school safety grant; $125,900 for a school safety analyst; and $580,100 to purchase a building in Blackfoot. Also included are adjustments to pay the Office of Information Technology Services for security software and data center office space located at the Chinden Campus; software licensing, server infrastructure, and storage to expand system capabilities on core systems and to maintain agency-specific software; and billings in excess of current appropriations. Repeals and adds to existing law regarding optometric physicians.

Consistent with the Governor's Licensing Freedom Act, this proposed legislation aims to implement a 2018 recommendation to organize the "Optometric Physician Licensing Act" in a manner consistent with the way legislation for regulated professions and occupations is written today. The proposal will also include the addition of an inactive license status; clarify that the Act does not apply to the sale of reading glasses and magnifiers; and add exemptions from licensure for federal employees who are practicing in the scope of their employment and for optometrists licensed in another state who are consulting with an Idaho optometrist or teaching a course. This legislation will also include an expanded scope of practice to allow optometrists to perform certain laser surgical procedures once those optometrists have met certain examination and experience requirements.

Adds to existing law to establish a source of transportation funding and to create the Economic Reserve and Investment Fund for the purpose of providing moneys for the Strategic Initiatives Program, General Fund revenue shortfalls, and expenses incurred as a result of a disaster.

This legislation creates a source of transportation funding for State and local roads while saving additional moneys for times of State revenue shortfalls or major disasters. Section 1, in part, creates an Economic Reserve and Investment Fund ("ERIF") for the purpose of providing moneys for: 1) the Strategic Initiatives Program; 2) meeting General Fund revenue shortfalls or 3) meeting expenses incurred as the result of a major disaster declared by the Governor. As background, both the Economic Recovery and Reserve Fund and the Budget Stabilization Fund were for meeting general revenue shortfalls, and expenses as a result of major disasters. The ERIF, which replaces the Economic Recovery and Reserve Fund, still has those purposes with the addition of funding the Strategic Initiatives Program. The Strategic Initiatives Program is a competitive transportation project grant program. The grant is administered by the Idaho Transportation Department ("ITD") and Local Highway Technical Assistance Council ("LHTAC"). The award is based on criteria including, but not limited to, projects enhancing safety, traffic mobility, repair and maintenance of bridges and purchase of right of ways. The ERIF will receive funds from the remaining moneys in the Economic Recovery and Reserve Fund. On or about July 1, 2020, the State Controller is directed to transfer $272,000,000 from the Budget Stabilization Fund to the ERIF. After the close of the fiscal year, on or about July 1, the State Controller shall transfer any General Fund excess to the ERIF. The General Fund excess shall be calculated by first providing for the carry forward ending balance or $60,000,000 — whichever is greater — plus an amount sufficient to cover encumbrances and reappropriation as authorized by the Legislature. On or about July 15, 2020, the State Controller shall transfer $38,200,000 to the Strategic Initiatives Program. The purpose of this legislation is to change Idaho Code prohibiting exploding targets during the designated fire season. Exploding targets refers to a device designed for use as a target consisting of a substance or substances capable of exploding or igniting when struck by a projectile. The use of these devices has caused catastrophic wildfires that have endangered lives, burned hundreds of thousandsofacresandcostmillionsofdollars. ThislegislationwouldexpandIdahoCodetoprohibitexploding targets on any state land, classify the crime as a misdemeanor, and reiteraters a judge's discretion for sentencing termsandcostrecoveryfordamages.
