This legislation amends Chapter 57, the Idaho Telehealth Access Act, to expand the use of asynchronous technology in delivering healthcare services through telehealth. Currently, Idaho law permits the use of asynchronous “store-and-forward” technology, but this definition does not accurately reflect advances in technology that allow providers to treat certain lower-acuity conditions without a real-time audio or visual component. This legislation also amends Section 54-1733 to permit asynchronous prescribing of legend drugs.
DEPARTMENT OF HEALTH AND WELFARE- Relates to the appropriation to the Department of Health and Welfare for the Division of Medicaid for fiscal year 2022.
This is a FY 2022 supplemental appropriation for the Division of Medicaid. It provides additional funds for contractually-required retrospective settlements, additional funds for held payments, and a recission due to the impacts of the public health emergency.

Amends existing law to revise provisions regarding address verification and registration of sexual offenders.
To accommodate more frequent postal delays, this bill changes deadlines to seven days for required actions after a one-way mailing from the Sex Offender Registry (see amendment to Section 18-8307(5)(c)) and to 14 days to receive and mail back a required address verification (see amendments to Sections 18-8308(1)(b) and 18-8308(2)(b)). Currently, when an address verification is not returned seven days after the registry’s mailing, the registry is required to notify the local sheriff to check on the individual. Postal delays are requiring the registry to ask sheriffs to check on individuals much more frequently than in the past because of the delay in the verification returning in the mail to the registry on time.

Amends and adds to existing law to provide that public records requests be made to the custodian of records, to provide for the Legislative Services Office to be designated as the custodian for legislative records, and to revise terminology.
This bill adds language to our current Public Records Act to designate a custodian of Public Record Requests. It provides that the Legislative Services Office is the custodian for Legislative Records and that requests for such shall be made to the Legislative Services Office.

Adds to existing law to provide that a resident in a health care facility has the right to essential caregiver visitation.
This bill would ensure that patients of hospitals, nursing facilities, group homes, and other similar health care facilities have the right to be visited by one essential caregiver of their choosing or the person holding their designated medical power of attorney.
Amends existing law to authorize training programs with certain private employers in telecommunications.
This bill allows Idaho Correctional Industries, under the supervision of the Board of Correction, to create an additional inmate training program for call center work and training. Numerous other correctional systems have similar successful programs.

Adds to existing law to provide for restrictions on actions arising from a regulated credit transaction primarily secured by a mortgage or deed of trust on residential real property.
This legislation establishes the notification process for a credit transaction that is secured by a subordinate lien on real property when the senior mortgage or other senior secured interest on real property comes under foreclosure.

Relates to the appropriation to the Division of Vocational Rehabilitation for fiscal year 2023.
This is the FY 2023 original appropriation bill for the Division of Vocational Rehabilitation. It appropriates a total of $29,370,900 and caps the number of authorized full-time equivalent positions at 151.00. For benefit costs, the bill increases the appropriated amount for health insurance by $850 to $12,500 per eligible full time FTP,includesaone-yearholidayofunemploymentinsurance, andadjustsworkerscompensationamounts. The billalsoprovidesfundingforpermanentemployeesfortheequivalentofa3%salarystructureshiftandprovides $1.25 per hour per eligible employee to be distributed based on merit for change in employee compensation. The bill funds one line item, which provide additional funds for an program specialist at the Council for the Deaf and Hard of Hearing.
