Amends existing law regarding the limitation of liability of landowners toward persons entering land for recreational purposes.
This legislation proposes to amend Idaho Code § 36-1604 to: improve readability; amend the definition of land to include water facilities, parks, and campgrounds; clarify the property interests held by an “owner”; and, clarify that recreational activities include traveling across the land owned by others for the purpose of recreating.

Appropriates and transfers $279,000 from the General Fund to the Pest Control Deficiency Fund for fiscal year 2021.
This bill reimburses the Department of Agriculture for prior fiscal year costs to survey and control pests on state and private lands. Idaho Code authorizes the use of deficiency warrants under certain circumstances. The agencies pay the bills and return to the Legislature during the next legislative session for the cash to reimburse those costs.

Amends existing law to remove obsolete language and to prohibit certain limitations on filing a complaint with the board.
This bill removes obsolete and outdated sections. This bill also ensures a dentist cannot limit a patient's right to file a complaint with the Board of Dentistry.

Amends existing law to remove hiring authority from various individual licensing boards.
This proposed legislation will centralize the hiring authority for certain management positions of the boards consolidated as a result of Executive Order No. 2020-10, with the Division of Occupational and Professional Licenses Administrator.

Amends existing law to provide that the sales tax from internet sales shall be distributed in the same manner as all other sales and use tax revenue.
As people continue to buy more online, our brick and mortar sales tax revenue and our general fund is jeopardized. One of the effects of the pandemic and Amazon moving into our state is that more people are choosing to shop online. Originally, it was believed that we would accrue approximately $50 million in the Wayfair Fund, instead we are looking at $180 million in the Wayfair Fund. This also means our counties and municipalities are not getting their share of collected sales tax. We need to move this online sales tax into the general fund sooner than we anticipated.

Amends existing law to revise Legislative Account distributions.
Funding for the Idaho Senate and House of Representatives is paid from the Legislative Account, which is authorized in Section 67-451, Idaho Code. The State Controller is directed to make four transfers from the General Fund into the account totaling $6,755,000 annually. A statutory change is required to increase the amount that is transferred each year and this legislation would increase the transfers by $1,756,000 annually. This would increase the annual total amount to $8,511,000, which is a 26% increase. This increase is necessary becauseyear-endfundbalanceshavebeendecliningsignificantlyoverthepastseveralyearsduetoanincreased numberofinterimcommittees, workinggroups, andaspecialsession. Previousincreaseswere29%inFY2002 and 21% in FY 2009. Based upon agreements between the Senate and House of Representatives, the Senate receives 37% of the transfers and the House receives 63%. The funds are perpetually appropriated and do not revert back to the General Fund at the end of each fiscal year. This bill includes an emergency clause which would make the increased transfers effective retroactively to January 1, 2021.

This legislation changes the cap on growth of property tax budgets to prevent increases that exceed the growth in income of citizens when there are periods of rapid growth combined with rapid increases in assessed value.
Amends existing law to provide that waterfront resort licenses shall remain valid and may be transferred in certain instances.
The purpose of this proposal is to remediate an ambiguity in the law relating to waterfront resort liquor licenses.
