The proposed legislation repeals the first sentence Section 41-1850(10), Idaho Code, and replaces it with language that would allow for a Certificate of Insurance to include reference to a contract number or description, or a project number or description. This inclusion would not convey any additional rights to the Certificate holder or replace or extend coverage on the policy. It would simply allow for contract or project descriptions to be referenced on the Certificate of Insurance. This legislation creates increased productivity for insurance agents and brokers by the elimination of some paper work.

This removes the sunset clause for section 23-604A (Medical Amnesty), which provides limited immunity from the misdemeanor charges of Consumption by a Minor, or Possession by a Minor. This measure was enacted to encourage minors to seek emergency medical help for themselves, or another without fear of prosecution. The law was enacted in 2016 with a 3-year sunset clause. This bill repeals the sunset clause.

Amends existing law to revise a provision regarding per diem rates for prisoners.

The purpose of this bill is to increase the daily rate for state sentenced prisoners housed in county jails from $45 a day to $55 a day for the first seven days of housing followed by $75 a day thereafter. The Idaho Department of Correction houses approximately 1,000 state prisoners in the county jails throughout the state on any given day. The daily rate has increased only ten dollars over the last 20 years. The average county cost of housing state prisoners in the county jails is over $81 dollars a day. It is appropriate to adjust this daily rate so that the county property taxpayers will not have to make up the cost difference in housing state prisoners.

The intent of this legislation is to amend the Idaho Building Code Act, Title 39, Chapter 41 to clarify that local jurisdictions are limited in their authority to adopt residential building codes different from building codesreviewed,amended,andadoptedbytheIdahoBuildingCodeBoard. ThelegislativeintentoftheIdaho BuildingCodeActistoprovideuniformityandconsistencyofresidentialbuildingcodesacrossjurisdictions of the state. This legislation more clearly defines the role of local jurisdictions in maintaining that intent.

Amends existing law to revise provisions regarding payment and deposit of county misdemeanor probation supervision fees and to provide for the reporting of certain payments.

The misdemeanor probation supervision program is to be a self-funded county program utilizing fees collected from probationers sentenced to the program. Fees collected from the probationers are to be used exclusively for misdemeanor probation services. Currently, not all of the supervision fees collected by the clerks of the court using the Odyssey Program are being used to fund misdemeanor probation as the supervision fees are being diverted, pursuant to the Idaho Supreme Court priority of payments list, to satisfy other costs, fines or fees that a probationer may be required to pay. This proposed amendment to Idaho Code § 31-3201D provides a mechanism to ensure that the supervision fees are used exclusively for misdemeanor probation services at the time the service is rendered. Allowing probationers to make their monthly payments to the board of county commissioners or its designee ensures that those payments are deposited, accounted for, and used to support misdemeanor probation supervision at the time supervision occurs rather than the fees being diverted to satisfy other costs, fines or fees pursuant to the Idaho Supreme Court's priority of payments list. A county may continue having the fees paid to the clerk of the court and having it distributed pursuant to the Idaho Supreme Court's priority of payments list. The amendment simply provides a county the option of having the fee paid to the board of county commissioners or its designee so that the supervision fee does not get diverted to first satisfy other costs, fines or fees pursuant to the priority of payments list.

Appropriates $39,656,800 to the Superintendent of Public Instruction for fiscal year 2019; limits the number of authorized full-time equivalent positions to 142.00; and provides direction on distributions.

This is the FY 2019 original appropriation bill for the Superintendent of Public Instruction. It appropriates $39,656,800 and caps the number of authorized full-time equivalent positions at 142.00. For benefit costs, the bill removes $1,450 per eligible FTP to bring the annual employer contribution for health insurance down to $11,650 by including a two-month employee and employer premium holiday, adds a 6.8% increase for life insurance, and adjusts funding for workers' compensation in amounts that vary by agency. For replacement items, $141,300 is provided, which includes 11 network servers for $99,000; five network switchesfor$13,000; fourUPSbackupsystemsfor$4,200; andothermiscellaneousequipmentfor$25,100. For statewide cost allocation adjustments, no change is provided, as Attorney General fees will increase by $600,riskmanagementcostswilldecreaseby$3,200,StateControllerfeeswillincreaseby$2,800,andState Treasurer fees will decrease by $200 for a net change of $0. An annualization of $1,000 is provided for the constitutional officers' pay increase from July 1, 2018, through December 31, 2018. The Superintendent's salary for calendar year 2018 is $107,357. The bill also provides funding for a 3% ongoing merit-based salary increase for permanent employees, to be distributed at the discretion of the Superintendent. The bill funds two line items, which provide $305,000 to support an increase in the number of students participating in proficiency assessments in line item 3 and $283,800 for a K-3 Reading Assessment in line item 6. This bill includes a total of $383,800 for a K-3 Reading Assessment ($100,000 is retained in the FY 2018 Base and $283,800 is added in line item 6). There is also $166,200 in the Division of Central Services of the Public Schools Educational Support Program appropriation that can be used for literacy programs. Upon approval of this bill, a grand total of $550,000 will be available for reading assessments in FY 2019.
