This legislation establishes a minimum statewide standard allowing residents of single-family homes to engage in limited household egg production, including keeping up to four (4) hens for household use or lawful small-scale sale consistent with existing Idaho food safety and cottage food laws. Eggs are a foundational, nutrient-dense whole food that supports protein intake, metabolic health, and family nutrition. By ensuring that families are not completely prohibited from producing a basic food staple, this bill strengthens food security, reinforces Idaho’s agricultural heritage, and promotes agricultural literacy and responsible food stewardship for future generations. The legislation preserves reasonable local government and homeowners’ association authority related to sanitation, nuisance, and multifamily dwellings, creates no new regulatory program, and does not expand existing cottage food laws.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE SENATE SENATE BILL NO. 1342 BY JUDICIARY AND RULES COMMITTEE AN ACT1 RELATING TO EGGS; AMENDING TITLE 25, IDAHO CODE, BY THE ADDITION OF A NEW2 CHAPTER 41, TITLE 25, IDAHO CODE, TO PROVIDE FOR THE HOUSEHOLD EGG PRO-3 DUCTION AND FOOD SECURITY ACT; AND DECLARING AN EMERGENCY AND PROVIDING4 AN EFFECTIVE DATE.5

Be It Enacted by the Legislature of the State of Idaho:6

SECTION 1. That Title 25, Idaho Code, be, and the same is hereby amended7 by the addition thereto of a NEW CHAPTER, to be known and designated as Chap-8 ter 41, Title 25, Idaho Code, and to read as follows:9 CHAPTER 4110 HOUSEHOLD EGG PRODUCTION AND FOOD SECURITY ACT11 25-4101. SHORT TITLE. This chapter may be known and shall be cited as12 "The Household Egg Production and Food Security Act."13 25-4102. LEGISLATIVE FINDINGS. The legislature finds that:14 (1) Many Idaho residents who live in single-family residences are cur-15 rently prohibited from producing eggs for household consumption due to local16 ordinances or restrictions;17 (2) Eggs are a basic food staple, and household egg production supports18 food security, self-reliance, and family resilience;19 (3) Agriculture is foundational to Idaho's economy and future. Modern20 nutrition guidance increasingly emphasizes whole, nutrient-dense foods and21 balanced diets that support metabolic health;22 (4) Eggs are a foundational nutrient-dense food that aligns with23 such dietary principles and contributes to household food quality and re-24 silience; and25 (5) This chapter supports agricultural literacy and responsible house-26 hold food production by establishing a minimum statewide standard to prevent27 total prohibitions on household egg production, while preserving reasonable28 local government and homeowner's association authority related to health,29 safety, and nuisance concerns.30 25-4103. DEFINITIONS. As used in this chapter:31 (1) "Hen" means a female chicken.32 (2) "Homeowner's association" has the same meaning as provided in sec-33 tion 55-3203, Idaho Code.34 (3) "Political subdivision" means a city, county, or other unit of lo-35 cal government within the state of Idaho.36 (4) "Single-family residence" means a detached residential dwelling37 designed for occupancy by one (1) household and does not include apartments,38 condominiums, duplexes, townhomes, or other multifamily dwellings.39

2 25-4104. HOUSEHOLD EGG PRODUCTION -- MINIMUM STATEWIDE STANDARD. (1)1 Notwithstanding any ordinance, resolution, rule, covenant, condition, or2 restriction to the contrary, an owner or occupant of a single-family resi-3 dence may keep up to four (4) hens for household egg production.4 (2) Additional hens may be kept as allowed by a political subdivision or5 homeowner's association.6 (3) Roosters are prohibited unless expressly permitted by a political7 subdivision or homeowner's association.8 (4) Eggs produced pursuant to this section may be sold, bartered, or ex-9 changed, provided such sales comply with applicable Idaho food safety and10 cottage food laws governing small-scale, home-based food production.11 25-4105. AUTHORITY PRESERVED. Nothing in this chapter shall be con-12 strued to prohibit a political subdivision or homeowner's association from13 adopting or enforcing reasonable regulations related to sanitation, enclo-14 sure, location, noise, odor, pest control, or nuisance prevention, or from15 limiting or prohibiting household egg production at multifamily dwellings,16 provided such regulations do not prohibit the household egg production au-17 thorized by this chapter.18 25-4106. PROSPECTIVE APPLICATION. This chapter applies prospectively19 only and does not affect any enforcement action, fine, penalty, or legal pro-20 ceeding that was final prior to July 1, 2026.21

SECTION 2. An emergency existing therefor, which emergency is hereby22 declared to exist, this act shall be in full force and effect on and after23 July 1, 2026.24
