This legislation creates a new chapter in Title 33, Idaho Code, to address the growing use of artificial intelligence (AI) in Idaho's public schools. The purpose of this legislation is to help Idaho schools use emerging technologies thoughtfully – preparing students for the future while protecting privacy, preserving local control, and keeping teachers central to the learning process. AI tools are already being used in classrooms, school offices, and educational software. These tools can help personalize learning, support teachers, and better prepare students for future jobs. At the same time, they raise important questions about student privacy, data security, academic honesty, and the role of teachers in the classroom. This bill directs the State Department of Education, with approval from the State Board of Education, to develop a statewide framework for the responsible use of AI in K-12 education. The framework will focus on safety, transparency, accessibility, and human oversight. The framework emphasizes safety, transparency, accessibility, and human oversight. In addition, the bill calls for the development of AI literacy guidance, educator professional development recommendations, and parent resources to improve understanding and transparency. Limited rulemaking authority is provided to support implementation. The goal of this legislation is to help Idaho schools use technology wisely – preparing students for the future while protecting privacy, maintaining local control, and keeping teachers at the center of learning.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE SENATE SENATE BILL NO. 1227 BY EDUCATION COMMITTEE AN ACT1 RELATING TO EDUCATION; AMENDING TITLE 33, IDAHO CODE, BY THE ADDITION OF A2 NEW CHAPTER 70, TITLE 33, IDAHO CODE, TO PROVIDE FOR LEGISLATIVE IN-3 TENT, TO PROVIDE FOR DEFINITIONS, TO REQUIRE THE STATE DEPARTMENT OF4 EDUCATION TO DEVELOP A GENERATIVE ARTIFICIAL INTELLIGENCE IN EDUCATION5 FRAMEWORK, TO REQUIRE LOCAL SCHOOL DISTRICTS AND PUBLIC CHARTER SCHOOLS6 TO ADOPT CERTAIN POLICIES, TO REQUIRE THE STATE DEPARTMENT OF EDUCATION7 TO DEVELOP CERTAIN STANDARDS, ASSESSMENTS, AND PROFESSIONAL DEVELOP-8 MENT, TO PROVIDE FOR PARENTAL AND COMMUNITY ENGAGEMENT, TO PROVIDE FOR9 PROCUREMENT REQUIREMENTS, AND TO PROVIDE FOR RULEMAKING; AND DECLARING10 AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE.11

Be It Enacted by the Legislature of the State of Idaho:12

SECTION 1. That Title 33, Idaho Code, be, and the same is hereby amended13 by the addition thereto of a NEW CHAPTER, to be known and designated as Chap-14 ter 70, Title 33, Idaho Code, and to read as follows:15 CHAPTER 7016 GENERATIVE ARTIFICIAL INTELLIGENCE IN EDUCATION17 33-7001. LEGISLATIVE INTENT. The legislature finds that generative18 artificial intelligence technologies are rapidly reshaping classroom19 learning, communication, and workforce expectations. It is the intent20 of the legislature to safeguard student privacy, protect the role of the21 educator, promote human-centered learning, increase transparency, and pre-22 pare Idaho students for success in an economy increasingly influenced by23 generative artificial intelligence technologies. It is the intent of the24 legislature that Idaho's public education system ensures the responsible,25 ethical, safe, and effective use of generative artificial intelligence26 tools in teaching, learning, and administration.27 33-7002. DEFINITIONS. For the purpose of this chapter:28 (1) "Generative artificial intelligence" or "generative AI" means ar-29 tificial intelligence models that use machine learning and are trained on30 large volumes of data that can generate new content. When prompted, gener-31 ative AI can create various outputs, including text, images, videos, com-32 puter code, and music. Generative AI does not include artificial intelli-33 gence models that have the primary goal of classifying data, such as those34 used in automated vehicles.35 (2) "Generative artificial intelligence in education" means the re-36 sponsible use of generative artificial intelligence technologies to support37 instruction, enhance student engagement, personalize learning, improve ad-38 ministrative efficiency, or assist educator decision-making while ensuring39 that human judgment remains the final authority.40

2 33-7003. GENERATIVE ARTIFICIAL INTELLIGENCE IN EDUCATION FRAME-1 WORK. (1) The state department of education shall develop a statewide2 generative artificial intelligence in education framework, subject to state3 board of education approval, for use in K-12 Idaho public schools. The4 framework shall:5 (a) Prioritize human-centered oversight, transparency, safety, and6 data security;7 (b) Provide guidance on instructional integration, academic in-8 tegrity, digital citizenship, and responsible student use;9 (c) Address accessibility, accommodations, and access to generative AI10 tools; and11 (d) Serve as the foundation for local school district and public char-12 ter school policies, professional development, procurement practices,13 and statewide standards as provided for in the provisions of this chap-14 ter.15 (2) The framework shall be reviewed and updated as needed through a16 process led by the state department of education, which shall convene edu-17 cation practitioners, industry partners, and workforce representatives to18 ensure the framework reflects emerging technologies, risks, and best prac-19 tices.20 33-7004. POLICY ADOPTION. Each local school district and public char-21 ter school shall adopt a policy governing the use of generative artificial22 intelligence by students and employees in school buildings, on school23 grounds, during school activities, and on school-issued devices. The policy24 shall:25 (1) Align with the statewide generative artificial intelligence in ed-26 ucation framework approved by the state board of education pursuant to the27 provisions of this chapter;28 (2) Define appropriate and prohibited uses of generative AI for in-29 structional, administrative, and communication purposes;30 (3) Include safeguards for student privacy, data security, accessibil-31 ity, and academic integrity; and32 (4) Comply with all applicable state and federal laws, including Idaho33 student data privacy requirements, the family educational rights and pri-34 vacy act, the children's internet protection act, and the children's online35 privacy protection act.36 33-7005. STANDARDS, ASSESSMENTS, AND PROFESSIONAL DEVELOPMENT. The37 state department of education, in consultation with educators, industry38 partners, and technology experts, shall develop and recommend to the state39 board of education the following:40 (1) Generative AI literacy standards for K-12 students, including the41 knowledge and skills required to understand what generative AI is, how it42 works, its appropriate and age-appropriate uses, and how to use it ethi-43 cally, securely, and transparently;44 (2) Assessment guidelines to evaluate student understanding of genera-45 tive AI concepts, ethics, and responsible use; and46 (3) A professional development plan to build educator capacity in safe47 and effective integration of generative AI technologies.48

3 33-7006. PARENTAL AND COMMUNITY ENGAGEMENT. The state department of1 education shall develop for parents and legal guardians a generative AI2 guidance document to support transparency and public understanding of gen-3 erative AI in public education.4 33-7007. PROCUREMENT AND TECHNOLOGY REQUIREMENTS. (1) All generative5 AI-related software, applications, and tools procured by local school dis-6 tricts and public charter schools shall comply with state and federal data7 privacy laws, including the family educational rights and privacy act, the8 children's internet protection act, and the children's online privacy pro-9 tection act. Vendors shall disclose whether products utilize machine learn-10 ing, predictive analytics, or generative AI and shall provide assurances re-11 garding data protection, algorithmic transparency, and responsible use.12 (2) The state department of education may establish a list of approved13 generative AI tools or develop model procurement guidelines for use by local14 school districts and public charter schools.15 33-7008. RULEMAKING AUTHORITY. The state board of education may pro-16 mulgate rules, subject to legislative approval, to implement the provisions17 of this chapter.18

SECTION 2. An emergency existing therefor, which emergency is hereby19 declared to exist, this act shall be in full force and effect on and after20 July 1, 2026.21
