The purpose of this joint resolution is to put a question to the citizens of Idaho if they want to repeal Article IX Section 5 of the Constitution of the State of Idaho (Also known as "The Blaine Amendment").

There is no estimated fiscal impact to the general fund. However, there's a rough estimate of cost of $200,000 for the Secretary of State to public proposed constitutional amendments and arguments as required by law. This cost is shared by other constitutional amendments proposed in a given ballot time frame.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE JOINT RESOLUTION NO. 7 BY STATE AFFAIRS COMMITTEE A JOINT RESOLUTION1 PROPOSING AN AMENDMENT TO THE CONSTITUTION OF THE STATE OF IDAHO RELATING TO2 THE PROHIBITION OF SECTARIAN APPROPRIATIONS; REPEALING SECTION 5, AR-3 TICLE IX OF THE CONSTITUTION OF THE STATE OF IDAHO, RELATING TO THE PRO-4 HIBITION OF SECTARIAN APPROPRIATIONS; STATING THE QUESTION TO BE SUB-5 MITTED TO THE ELECTORATE; DIRECTING THE LEGISLATIVE COUNCIL TO PREPARE6 THE STATEMENTS REQUIRED BY LAW; AND DIRECTING THE SECRETARY OF STATE TO7 PUBLISH THE AMENDMENT AND ARGUMENTS AS REQUIRED BY LAW.8 Be It Resolved by the Legislature of the State of Idaho:9
SECTION 1. That Section 5, Article IX of the Constitution of the State10 of Idaho, be, and the same is hereby repealed.11
SECTION 2. The question to be submitted to the electors of the State of12 Idaho at the next general election shall be as follows:13 "Shall Section 5, Article IX of the Constitution of the State of Idaho14 prohibiting sectarian appropriations be repealed?"15
SECTION 3. The Legislative Council is directed to prepare the state-16 ments required by Section 67-453, Idaho Code, and file the same.17
SECTION 4. The Secretary of State is hereby directed to publish this18 proposed constitutional amendment and arguments as required by law.19
