LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE JOINT MEMORIAL NO. 19 BY STATE AFFAIRS COMMITTEE A JOINT MEMORIAL1 TO THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CON-2 GRESS ASSEMBLED AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE3 STATE OF IDAHO IN THE CONGRESS OF THE UNITED STATES.4 We, your Memorialists, the House of Representatives and the Sen-5 ate of the State of Idaho assembled in the Second Regular Session of the6 Sixty-eighth Idaho Legislature, do hereby respectfully represent that:7 WHEREAS, the Tenth Amendment to the United States Constitution reserves8 to the states powers not delegated to the federal government, and education9 is not enumerated as a responsibility of the federal government; and10 WHEREAS, the U.S. Department of Education's creation in 1980 has led to11 significant federal overreach in education through burdensome regulations12 and one-size-fits-all mandates, many left unfunded despite the department's13 annual budget of $60 billion; and14 WHEREAS, as the least regulated state in the nation, Idaho would welcome15 the opportunity to extend its red tape reduction efforts to the field of pub-16 lic education where it is desperately needed; and17 WHEREAS, states and local communities possess unique knowledge of their18 students' educational needs and are best positioned to develop the curricu-19 lum and policies that reflect their values and priorities; and20 WHEREAS, President Trump has publicly expressed a desire to eliminate21 the U.S. Department of Education and rightfully put the states back in charge22 of education; and23 WHEREAS, the elimination of the U.S. Department of Education is not only24 a constitutional necessity, but will also cause taxpayer dollars to be spent25 more efficiently and lead to better student outcomes.26 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular27 Session of the Sixty-eighth Idaho Legislature, the House of Representatives28 and the Senate concurring therein, that the Legislature supports federal29 efforts to eliminate the U.S. Department of Education and urges the United30 States Congress to fully cooperate with these efforts.31 BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representa-32 tives be, and she is hereby authorized and directed to forward a copy of this33 Memorial to the President of the Senate and the Speaker of the House of Repre-34 sentatives of Congress and to the congressional delegation representing the35 State of Idaho in the Congress of the United States.36
