STATEMENT OF PURPOSE

This Concurrent Resolution recognizes the growing national debt as a legitimate threat to the United States of America and serves as an application by the State of Idaho to call a “Convention for proposing Amendments” under Article V of the United States Constitution, strictly limited to proposing a Balanced Budget Amendment to the States for Ratification. Idaho’s application for a “Convention for proposing Amendments” sunsets on December 31, 2033.

This legislation causes no increase or decrease in revenue, or additional expenditure of funds at the state or local level of government; therefore, this legislation has no fiscal impact. Sending a convention application to Congress will have no impact on the General Fund or any other subdivision funds. Should the balanced budget amendment campaign reach the thirty-four state applications required under Article V to call a “Convention for proposing Amendments,” Congress must issue the convention call. To participate in the convention, the Idaho Legislature would be compelled to pass a resolution to commission its delegation. That legislation would define the expenses associated with sending Idaho’s delegation to the convention.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 25 BY STATE AFFAIRS COMMITTEE A CONCURRENT RESOLUTION1 STATING FINDINGS OF THE LEGISLATURE AND REQUESTING THAT CONGRESS CALL A CON-2 VENTION FOR PROPOSING AMENDMENTS UNDER ARTICLE V OF THE CONSTITUTION OF3 THE UNITED STATES LIMITED TO PROPOSING AN AMENDMENT TO THE CONSTITUTION4 OF THE UNITED STATES REQUIRING THAT, IN THE ABSENCE OF A NATIONAL EMER-5 GENCY, THE TOTAL OF ALL FEDERAL OUTLAYS MADE BY CONGRESS FOR ANY FIS-6 CAL YEAR MAY NOT EXCEED THE TOTAL OF ALL ESTIMATED FEDERAL REVENUES FOR7 THAT FISCAL YEAR, TOGETHER WITH ANY RELATED AND APPROPRIATE FISCAL RE-8 STRAINTS.9 Be It Resolved by the Legislature of the State of Idaho:10 WHEREAS, the United States Congress has run up a debt so massive that11 it has endangered the United States government, the United States economy,12 United States national defense, and all 50 states; and13 WHEREAS, Article V of the Constitution of the United States mandates14 that upon the "Application of the Legislatures of two thirds of the several15 States" Congress shall "call a Convention for proposing Amendments"; and16 WHEREAS, historically when the states have come within one application17 of the two-thirds of the states, which is 34 out of the 50 states, necessary18 to call a convention to propose a specific amendment, Congress has acted to19 propose said amendment in order to prevent a convention from being called;20 and21 WHEREAS, President Ronald Reagan advocated the use of a "thirty-three22 state strategy" or "preemption" to pressure Congress to propose a balanced23 budget amendment for ratification by the states; and24 WHEREAS, the Legislature deems that an amendment to the Constitution of25 the United States that would require a balanced federal budget is necessary26 for the good of the American people.27 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses-28 sion of the Sixty-eighth Idaho Legislature, the House of Representatives and29 the Senate concurring therein, that the Idaho Legislature applies to Con-30 gress, under the provisions of Article V of the Constitution of the United31 States, for the calling of a convention of the states limited to proposing32 an amendment to the Constitution of the United States requiring that, in the33 absence of a national emergency, the total of all federal outlays made by34 Congress for any fiscal year may not exceed the total of all estimated fed-35 eral revenues for that fiscal year, together with any related and appropri-36 ate fiscal restraints.37 BE IT FURTHER RESOLVED that copies of this application must be transmit-38 ted to the President of the United States, the Secretary of the United States39 Senate, the Speaker and Clerk of the United States House of Representatives,40 and the members of the United States Senate and the United States House of41 Representatives from this state.42
2 BE IT FURTHER RESOLVED that copies of this application must also be1 transmitted to the presiding officers of each of the legislative houses in2 the several states, requesting their cooperation in this endeavor.3 BE IT FURTHER RESOLVED that this application constitutes a continuing4 application in accordance with Article V of the Constitution of the United5 States until the legislatures of at least two-thirds of the several states6 have made applications on the same subject, or until December 31, 2033,7 whichever occurs earlier. It supersedes all previous applications by this8 legislature on the same subject.9
