This legislation repeals existing code that preempts local regulation of auxiliary containers such as plastic bags restoring local control.

There is no fiscal impact to the General Fund or to county or other local government funds. This legislation gives local government control over the ability to govern regulation of auxiliary containers such as plastic bags which will have no impact on costs.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 812 BY RUBEL AN ACT1 RELATING TO THE REGULATION OF AUXILIARY CONTAINERS; REPEALING SECTION2 67-2340, IDAHO CODE, RELATING TO STATE PREEMPTION OF LOCAL REGULATION3 OF AUXILIARY CONTAINERS, INCLUDING PLASTIC BAGS; AND DECLARING AN EMER-4 GENCY.5
Be It Enacted by the Legislature of the State of Idaho:6
SECTION 1. That Section 67-2340, Idaho Code, be, and the same is hereby7 repealed.8
SECTION 2. An emergency existing therefor, which emergency is hereby9 declared to exist, this act shall be in full force and effect on and after its10 passage and approval.11
