This legislation makes changes to the funding formula for the Idaho Digital Learning Academy (IDLA), emphasizing its core mission of being a gap filler in our public school system. It addresses concerns about students being double funded in specific situations, overuse by certain schools and students, elementary school programs, driver’s education costs, private school, homeschool, and virtual school program use, and alignment with the statewide general fund cut. It allows districts to pay directly for IDLA enrollments in those situations in which the state will no longer pay. The total fiscal impact of this bill is intended to address the cut proposed in the governor's recommended budget.

This bill reduces the estimated IDLA appropriation from FY 27 and going forward by a total of more than $8,959,202, comprised of the following sources. LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 622 BY EDUCATION COMMITTEE AN ACT1 RELATING TO EDUCATION; AMENDING SECTION 33-1020, IDAHO CODE, TO REVISE PRO-2 VISIONS REGARDING IDAHO DIGITAL LEARNING ACADEMY FUNDING; AND DECLAR-3 ING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE.4

Be It Enacted by the Legislature of the State of Idaho:5

SECTION 1. That Section 33-1020, Idaho Code, be, and the same is hereby6 amended to read as follows:7 33-1020. IDAHO DIGITAL LEARNING ACADEMY FUNDING.8 (1)(a) An amount of four hundred forty-five dollars ($445) four hundred9 twenty-seven dollars ($427) per enrollment shall be distributed to sup-10 port the Idaho digital learning academy, created pursuant to chapter11 55, title 33, Idaho Code. For the purposes of this section, an "enroll-12 ment" shall be counted each time an Idaho school age child enrolls in13 an Idaho digital learning academy class and continues to be enrolled in14 such class past the deadline to withdraw, where such withdrawal would15 not result in the class appearing on such child's transcript in any way.16 A single child enrolled in multiple classes shall count as multiple en-17 rollments may be counted for only up to three (3) enrollments per school18 year, not including summer enrollments. Summer enrollments shall be19 included in the fiscal year that begins that summer. An enrollment20 shall be eligible for state funding only if:21 (i) The student is enrolled full time in an Idaho school district22 or public charter school that is not entirely virtual;23 (ii) The student is in grades 6 through 12;24 (iii) The class is not a driver's education class; and25 (iv) The student is not enrolled in a public school or public char-26 ter school that is located in a city with a population of more than27 fifty thousand (50,000) and is not enrolled in a custom section. A28 "custom section" means an Idaho digital learning academy class in29 which all enrollments are from one (1) school district.30 (b) If a student wants to enroll in an Idaho digital learning academy31 class that does not meet the criteria for state funding under this sec-32 tion, such student may enroll in such class if the school district or33 public charter school pays the fees for the class as set by the Idaho34 digital learning academy.35 (2) The state department of education shall make an estimated distri-36 bution of funds to the Idaho digital learning academy by no later than July37 31 of each fiscal year, consisting of eighty percent (80%) of the estimated38 funding for the fiscal year. The balance of all remaining funds to be dis-39 tributed, pursuant to the calculations in this section, shall be distributed40 by no later than May 15 of the same fiscal year. The state department of41 education shall reconcile the enrollments prior to the May 15 payment and42

2 withhold or recover any costs necessary to align the funding with verified1 enrollments. The joint finance-appropriations committee shall consider2 adjusting the per enrollment amount each legislative session by a percent-3 age increase equal to the percentage increase approved for salary increases4 for instructional and pupil service staff pursuant to section 33-1004B,5 Idaho Code, and for administrative and classified staff pursuant to section6 33-1004E, Idaho Code.7

SECTION 2. An emergency existing therefor, which emergency is hereby8 declared to exist, this act shall be in full force and effect on and after9 July 1, 2026.10
