Schools are safer and more conducive to learning when bullying incidents are firmly addressed. This proposed legislation would ensure that families whose students are involved in a serious bullying incident are notified so they can respond accordingly.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 515 BY EDUCATION COMMITTEE AN ACT1 RELATING TO EDUCATION; AMENDING SECTION 33-1631, IDAHO CODE, TO REVISE PRO-2 VISIONS REGARDING REQUIREMENTS FOR HARASSMENT, INTIMIDATION OR BULLY-3 ING INFORMATION AND PROFESSIONAL DEVELOPMENT AND TO MAKE TECHNICAL COR-4 RECTIONS; AND DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE.5
Be It Enacted by the Legislature of the State of Idaho:6
SECTION 1. That Section 33-1631, Idaho Code, be, and the same is hereby7 amended to read as follows:8 33-1631. REQUIREMENTS FOR HARASSMENT, INTIMIDATION AND OR BULLYING9 INFORMATION AND PROFESSIONAL DEVELOPMENT. (1) School districts and public10 charter schools shall undertake reasonable efforts to ensure that informa-11 tion on harassment, intimidation and or bullying of students, as defined in12 section 18-917A, Idaho Code, is disseminated annually to all school person-13 nel, parents, and students, including an affirmation that school personnel14 are authorized and expected to intervene or facilitate intervention on be-15 half of students facing harassment, intimidation or bullying.16 (2) School districts and public charter schools shall provide ongoing17 professional development to build the skills of all school staff members to18 prevent, identify, and respond to harassment, intimidation and or bullying.19 The state board of education shall promulgate rules, subject to legislative20 approval, regarding the content of the professional development required by21 this subsection.22 (3) District School district and public charter school policies shall23 include a:24 (a) A series of graduated consequences that may include, but are25 not limited to, referral to counseling, diversion, use of juvenile26 specialty courts, restorative practices, on-site suspension, and ex-27 pulsion for any student who commits an act of bullying, intimidation,28 harassment, intimidation or bullying or an act of violence or threats of29 violence. Guidelines for such policies will shall be set forth in the30 rules of the state board.; and31 (b) In compliance with all federal and state laws protecting student32 privacy, a procedure for the mandatory reporting of any incidents of ha-33 rassment, intimidation or bullying that result in a student being sus-34 pended from school pursuant to section 33-205(6), Idaho Code, to the35 parents or legal guardians of both the alleged victim and the alleged36 offender involved in the incident.37 (4) Annually school districts shall report bullying incidents to the38 state department of education in a format set forth in rule by the state39 board. District policy shall designate persons to whom bullying reports are40 to be made and a procedure for a teacher or other school employee, student,41
2 parent, guardian or other person to report or otherwise provide information1 on bullying activity.2
SECTION 2. An emergency existing therefor, which emergency is hereby3 declared to exist, this act shall be in full force and effect on and after4 July 1, 2026.5
