Amends and adds to existing law to provide for a sales and use tax rebate on certain road materials for governmental entities that contract for road construction.
This proposed legislation provides a mechanism for governmental agencies to receive a rebate for sales and use taxes that are sometimes collected and paid on road materials used in construction, repair or replacements of highways, streets, roads, and or alleys. Currently sales and or use taxes are collected differently on road materials depending upon who owns the vehicles that are placing the road materials on the ground. Consequently, monies that are set aside for transportation are being funneled off and deposited into the general fund. This legislation will help to ensure that monies designated for transportation get used for transportation.
Adds to and amends existing law to provide for advance enrollment in or registration at a public school or charter school by dependents of military members.
This Legislation amends Title 33 Section 524 and Title 33 Section 5206 to allow children of military families, with documentation of a military service member's pending relocation to our state, access to preliminary registration, enrollment, or application to a Local Education Agency (LEA) at the time that the process is open to the general student population. Proof of residency requirements are temporarily waived until the student begins school. At that time, the student has a period of ten (10) school days to provide proof of residency in the LEA.

Stating findings of the Legislature and supporting a collaboration among the three branches of the state government, local governments, and community partners in developing and implementing a statewide strategic plan to improve the Idaho behavioral health system.
This resolution supports the establishment of a three-branches of government collaboration to develop and implement a statewide strategic plan to improve the behavioral health system in Idaho.
Amends existing law to revise provisions regarding correctional facilities and prisoners.
An inmate has sued the Board of Correction in federal court alleging a right to paid employment under Section 20-209, Idaho Code, for prisoners in custody of the Board of Correction. On October 31, 2019, a federal judge certified a question to the Idaho Supreme Court asking for the Supreme Court to determine whether the Board of Correction is required to provide employment for all prisoners under that law, and if so, what is the minimum the Board of Correction must do to implement that mandate. On November 26, 2019, the Idaho Supreme Court issued an order accepting the certified question. The question is now pending before the Idaho Supreme Court. This bill seeks to clarify that while the Board of Correction may provide employment to prisoners, that Section 20-209 does not create a right to employment. The bill includes an emergency clause so that it takes effect immediately upon enactment, making the state’s policy clear to the courts in the pending cases.

Relates to the appropriation to the Department of Commerce for fiscal year 2021.
This is the FY 2021 original appropriation bill for the Department of Commerce. It appropriates a total of $37,487,800 and caps the number of authorized full-time equivalent positions at 43.00. For benefit costs, the bill maintains the current appropriated amount for health insurance at $11,650 per eligible employee and temporarily removes funding for the employer's sick leave contribution rate. The bill also provides for the equivalent of a 2% change in employee compensation for permanent state employees, with an additional 2% increase for those in the 20 job classifications most in need of equity adjustments. The bill funds two line items, which provide $113,100 for a broadband coordinator; and a reduction of the federal appropriation by $5,000,000. Also included are adjustments to pay the Office of Information Technology Services for security software and data center office space located at the Chinden Campus; and software licensing, server infrastructure, and storage to expand system capabilities on core systems and to maintain agency-specific software. Lastly, the ongoing General Fund appropriation is reduced by 2%.

Amends existing law to revise the income tax credit for food sales.
This legislation will increase the grocery tax credit from $120 to $135 per person for individuals age 65 and older and from $100 to $135 per person for all others. The average individual pays approximately $125 per year in sales tax on groceries. This change will essentially offset the sales tax paid on groceries by all Idaho citizens.
Amends existing law to provide that new specialty license plate programs shall not be established for the benefit of entities other than the State of Idaho.
This legislation states that no new special license plate or special license plate program shall be established for the benefit of any entity that is not the State of Idaho or an agency of the State of Idaho after July 1, 2020. After that date any special license plate program that has a nonprofit agency as a recipient of the proceeds from the sales of such plate, if fewer than one thousand (1000) plates are issued in the first year of the special plate's existence, fewer than one thousand five hundred (1500) plates are issued in the second year of the special plate program'sexistence,orfewerthantwothousand(2000)platesinthethirdoranysubsequentyearofeachspecial plate program's existence, the department of transportation will discontinue that special license plate program. The personalized license program will remain the same as it now operates.

Amends existing law to provide that all ballots shall be sealed and stored until after the recount period has passed.
This legislation clarifies that all ballots shall remain sealed and secure once they have been counted on Election Day until the recount period has passed or a recount has been completed.

Stating findings of the Legislature and authorizing a study committee to develop a strategy for viable intrastate commercial air service in Idaho.
This concurrent resolution would authorize Legislative Council to appoint one member from the Senate and onememberfromtheHousetoaninterimcommitteeto: 1.) studyintrastatecommercialairservice; 2.) appoint additional members from the public with knowledge or work experience in commercial air service operations; and 3.) develop a long-term strategy for sustainable intrastate commercial air service in the State of Idaho.

Amends existing law to revise provisions regarding uncontested city elections.
Currently cities are the only local taxing authority that hold an election if all seats are uncontested. This legislation eliminates the requirement to hold an election if only one person files a declaration of candidacy or if there is only a write-in declaration for each office in a city election.

Amends existing law to clarify provisions regarding the availability of real estate brokers and to remove provisions regarding broker and branch manager absences.
The purpose of this proposed legislation is to eliminate a section of the code which requires a broker's physical presence in the office at certain intervals. Brokers are required to properly supervise their sales associates, regardless of their location. Technology advances have made it possible for brokers to supervise contracts electronically, the physical presence requirement created unnecessary restrictions for the business models of some brokerage companies. In order to protect the consumer in a real estate transaction, language was added to clarify the broker's responsibility to be reasonably available to answer questions and complaints

The purpose of this legislation is to change Idaho Code prohibiting exploding targets during the designated fire season. Exploding targets refers to a device designed for use as a target consisting of a substance or substances capable of exploding or igniting when struck by a projectile. The use of these devices has caused catastrophic wildfires that have endangered lives, burned hundreds of thousandsofacresandcostmillionsofdollars. ThislegislationwouldexpandIdahoCodetoprohibitexploding targets on any state land, classify the crime as a misdemeanor, and reiteraters a judge's discretion for sentencing termsandcostrecoveryfordamages. Thislegislationdoesnotapplytoprivatepropertyoranypublicorprivate shooting range that has a permit or governmental approval.
