STATEMENT OF PURPOSE

The purpose of this bill is to clarify the standard of review used by courts in reviewing decisions made by local governments and land use boards. Currently, the law is very vague about how courts are to proceed, particularly in cases involving land use policy. This bill sets forth the criteria for appealing a local decision, and sets out the standards by which such decisions are to be judged on appeal.
