This bill relates to federal income tax deductions for state and local taxes (SALT). Currently there is a $10,000 limitation on the federal deduction for SALT. In 2020, the IRS released Notice 2020-75 approving the availability and functionality of a SALT limitation workaround for pass-through entities (PTEs). This bill provides a workaround in the Idaho Code for owners, partners, members, and shareholders in partnerships, LLCs and S corporations in PTEs by allowing the PTE to elect to pay Idaho tax at the PTE level. This bill declares an emergency providing for retroactive application to January 1, 2021 for tax reporting purposes.

Adds to existing law to provide for utility tokens and to establish a financial technology sandbox.
The purpose is to establish the Idaho Utility Token Act, which permits the creation of open blockchain utility tokens for consumptive use. This also establishes a Financial Technology Sandbox to allow a person to make an innovative financial product or service available to consumers during a sandbox period, initially up to 24 months,throughawaiverofexistingstatutoryandrulerequirementsbythedirectorofthedepartmentoffinance.
Adds to existing law to provide for classification of digital assets as property and to provide for the application of the Uniform Commercial Code to digital assets.
Amends existing law to provide that school boards shall have the authority to adopt policies and procedures regarding student clubs and organizations.

Amends existing law to revise residency requirements for former members of the United States Armed Forces.
Amends existing law to provide funding for full-day kindergarten and to provide that students in full-day kindergarten shall be counted as full-time students for purposes of enrollment counts.
This purpose of this bill is to provide funding for optional full-day kindergarten, providing local districts and charter schools with more flexibility to pay for optional full-day kindergarten without relying on student tuition and supplemental levies. Disparity in kindergarten funding has led to a statewide patchwork of full-day kindergarten opportunities. This bill would offer parity statewide so if school districts and families decide that optional full-day kindergarten is appropriate for their children, funding would not be a barrier to their choice in education.
Amends existing law to revise provisions regarding income tax rates and the Tax Relief Fund and to provide for a onetime income tax rebate.
This 2021 Tax Relief bill reduces all income tax brackets, setting the top individual and corporate tax bracket to 6.5% retroactive to January 1, 2021. This provides Idahoans with $169.4 million in ongoing tax relief. This bill also provides a one-time sales tax/income tax rebate, returning $220 million to Idaho taxpayers. A rebate check will be sent to 2020 personal income tax filers providing a minimum amount of $50 for each taxpayer and dependent or 9% of income taxes paid in 2019 whichever is greater.

Amends existing law to revise provisions regarding the order of candidate names on certain ballots.
Candidate names for federal, state, county, and city offices are rotated on election ballots. For all other offices candidate names appear on the ballot in a random, but fixed order. The purpose of this legislation is to rotate candidatenamesonballotsinotherraceswherethenumberofregisteredvoterswithinapoliticalentityexceeds 100,000.
