Be It Enacted by the Legislature of the State of Idaho:16

SECTION 1. That Section 49-202, Idaho Code, be, and the same is hereby17 amended to read as follows:18 49-202. DUTIES OF DEPARTMENT. (1) All registration and driver's li-19 cense records in the office of the department shall be public records and20 open to inspection by the public during normal business hours, except for21 those records declared by law to be for the confidential use of the depart-22 ment, or those records containing personal information subject to restric-23 tions or conditions regarding disclosure. If the department has contracted24 for a service to be provided by another entity, an additional fee shall be25 charged by that contractor whether the service is rendered during normal26 business hours, other than normal business hours or on weekends.27 (2) In addition to other fees required by law to be collected by the de-28 partment, the department shall collect the following:29 (a) For certifying a copy of any record pertaining to any vehicle li-30 cense, any certificate of title, or any driver's license ....... $14.0031 (b) For issuing every Idaho certificate of title .............. $14.0032 (c) For furnishing a duplicate copy of any Idaho certificate33 of title ................................................... $14.0034 (d) For issuance or transfer of every certificate of title on a new or35 used vehicle or other titled vehicle in an expedited manner (rush ti-36 tles), in addition to any other fee required by this section .... $26.0037 (e) For recording a transitional ownership document, in addition to any38 other fee required by this section ........................... $26.0039 (f) For furnishing a replacement of any receipt40 of registration ............................................. $5.0041

Such private contractor shall collect the27 fee prescribed and remit the fee to the department. The contractor shall28 also collect and retain the additional fee charged for his services.29 (5)(a) The department shall pay three dollars ($3.00) of the fee col-30 lected by a county assessor or other authorized agent of the department31 as provided in subsection (2)(a) through (f) of this section, and four32 dollars ($4.00) as provided in subsection (2)(g) of this section, to33 the county assessor or sheriff of the county or authorized agent of34 the department collecting such fee, which shall be deposited with the35 county treasurer and credited to the county current expense fund when36 collected by the county. When fees are collected by the department or an37 authorized agent of the department, such fees shall be deposited with38 the issuing entity. The remainder of the fees collected as provided in39 that subsection shall be paid by the department to the state treasurer40 and placed in the state highway account.41 (b) The fee collected under subsection (2)(k) of this section for a VIN42 inspection shall be placed in the city general fund if conducted by a43 city peace officer, in the county current expense fund if conducted by a44 county peace officer, shall be retained by the special agent authorized45 to perform the inspection, or paid to the state treasurer and placed to46 the credit of the Idaho state police if conducted by the Idaho state po-47 lice or in the state highway account if conducted by the department.48 (c) The fee collected under subsection (2)(o) of this section for fil-49 ing release of liability statements shall be retained by the county as-50

3 sessor of the county collecting such fee and shall be deposited with the1 county treasurer and credited to the county current expense fund. Any2 fees collected by the department for filing release of liability state-3 ments shall be retained by the department. However, the fees provided4 for in subsection (2)(o) of this section shall not apply when a transac-5 tion is filed electronically with the department.6 (d) The fee in subsection (2)(m) of this section shall not apply when7 the Idaho-based motor carrier or its representative obtains and prints8 the document using internet access.9 (e) The fee collected under subsection (2)(p) of this section for mo-10 tor carriers shall be paid by the department to the state treasurer and11 placed in the state highway account. The director and the director of12 the Idaho state police shall jointly determine the amount to be trans-13 ferred from the state highway account to the law enforcement fund for14 motor carrier safety programs conducted by the Idaho state police pur-15 suant to the provisions of section 67-2901A, Idaho Code.16 (6) The department as often as practicable may provide to law enforce-17 ment agencies the record of suspensions and revocations of driver licenses18 via the public safety and security information system (ILETS).19 (7) The department shall provide the forms prescribed in chapter 5 of20 this title, shall receive and file in its office in Ada county all instru-21 ments required in chapter 5 of this title to be filed with the department,22 shall prescribe a uniform method of numbering certificates of title, and23 shall maintain in the department indices for such certificates of title. All24 indices shall be by motor or identification number and alphabetical by name25 of the owner.26 (8) The department shall file each registration received under a27 distinctive registration number assigned to the vehicle and to the owner28 thereof.29 (9) The department shall not renew a driver's license or identification30 card when fees required by law have not been paid or where fees for past pe-31 riods are due, owing and unpaid including insufficient fund checks, until32 those fees have been paid.33 (10) The department shall not grant the registration of a vehicle when:34 (a) The applicant is not entitled to registration under the provisions35 of this title; or36 (b) The applicant has neglected or refused to furnish the department37 with the information required in the appropriate form or reasonable ad-38 ditional information required by the department; or39 (c) The fees required by law have not been paid, or where fees for past40 registration periods are due, owing and unpaid including insufficient41 fund checks.42 (11) The department or its authorized agents have the authority to re-43 quest any person to submit to medical, vision, highway, or written examina-44 tions, to protect the safety of the public upon the highways. The depart-45 ment or its authorized agents may exercise such authority based upon evi-46 dence which may include, but is not limited to, observations made.47 (12) The department shall revoke the registration of any vehicle:48 (a) Which the department shall determine is unsafe or unfit to be oper-49 ated or is not equipped as required by law;50

4 (b) Whenever the person to whom the registration card or registration1 plate has been issued shall make or permit to be made any unlawful use of2 the same or permit their use by a person not entitled thereto;3 (c) For any violation of vehicle registration requirements by the owner4 or operator in the current or past registration periods;5 (d) Whenever a motor carrier requests revocation, or whenever an inter-6 state carrier's federal operating authority has been revoked;7 (e) For failure of the owner or operator to file the reports required8 or nonpayment of audit assessments or fees assessed against the owner by9 the department or the state tax commission pursuant to audit under the10 provisions of section 49-439, Idaho Code;11 (f) Identified by any city or county administering a program estab-12 lished by ordinance for the inspection and readjustment of motor vehi-13 cles (which program is part of an approved state implementation plan14 adopted by both the state and federal governments under 42 U.S.C. 7410)15 as having failed to comply with an ordinance requiring motor vehicle16 emission inspection and readjustment; provided that no vehicle shall be17 identified to the department under this subsection unless:18 (i) The city or county certifies to the department that the owner19 of the motor vehicle has been given notice and had the opportunity20 for a hearing concerning compliance with the ordinance and has ex-21 hausted all remedies and appeals from any determination made at22 such hearing; and23 (ii) The city or county reimburses the department for all direct24 costs associated with the registration revocation procedure.25 (13) The department shall not reregister or permit a vehicle to oper-26 ate on a special trip permit until all fees, penalties and interest have been27 paid.28 (14) The department shall institute educational programs, demonstra-29 tions, exhibits and displays.30 (15) The department shall cancel a driver's license or identification31 card when fees required by law have not been paid or where fees are due, owing32 and unpaid including insufficient fund checks, until those fees have been33 paid.34 (16) The department shall examine persons and vehicles by written,35 oral, vision and skills tests without compulsion except as provided by law.36 (17) The department shall employ expert and special help as needed in37 the department.38 (18) The department shall compile accident statistics and disseminate39 information relating to those statistics.40 (19) The department shall cooperate with the United States in the elimi-41 nation of road hazards, whether of a physical, visual or mental character.42 (20) The department shall place and maintain traffic-control devices,43 conforming to the board's manual and specifications, upon all state highways44 as it shall deem necessary to indicate and to carry out the provisions of this45 title or to regulate, warn, or guide traffic. No local authority shall place46 or maintain any traffic-control device upon any highway under the jurisdic-47 tion of the department except by the latter's permission. The placement and48 maintenance of such a traffic-control device by a local authority shall be49

5 made according to the board's manual and specifications for a uniform system1 of traffic-control devices.2 (21) The department may conduct an investigation of any bridge or other3 elevated structure constituting a part of a highway, and, if it shall find4 that the structure cannot with safety to itself withstand vehicles travel-5 ing at a speed otherwise permissible under this title, shall determine and6 declare the maximum speed of vehicles which the structure can safely with-7 stand, and shall cause or permit suitable signs stating the maximum speed to8 be erected and maintained before each end of the structure.9 (22) Whenever the department shall determine on the basis of an engi-10 neering and traffic investigation that slow speeds on any highway or part of11 a highway impede the normal and reasonable movement of traffic, the depart-12 ment may determine and declare a minimum speed limit below which no person13 shall drive a vehicle except when necessary for safe operation or in compli-14 ance with law, and that limit shall be effective when posted upon appropriate15 fixed or variable signs.16 (23) The department shall regulate or prohibit the use of any con-17 trolled-access highway by any class or kind of traffic which is found to be18 incompatible with the normal and safe movement of traffic.19 (24) The department shall erect and maintain traffic-control devices on20 controlled-access highways on which any prohibitions are applicable.21 (25) The department and local authorities are authorized to determine22 those portions of any highway under their respective jurisdictions where23 overtaking and passing or driving on the left side of the roadway would be24 especially hazardous and may by appropriate signs or markings on the roadway25 indicate the beginning and end of those zones and when signs or markings are26 in place and clearly visible to an ordinarily observant person, every driver27 of a vehicle shall obey those directions.28 (26) The department and local authorities in their respective juris-29 dictions may in their discretion issue special permits authorizing the30 operation upon a highway of traction engines or tractors having movable31 tracks with transverse corrugations upon the periphery of the movable tracks32 or farm tractors or other farm machinery, the operation of which upon a high-33 way would otherwise be prohibited under this title or title 40, Idaho Code.34 (27) The department and local highway authorities within their respec-35 tive jurisdictions may place official traffic-control devices prohibiting,36 limiting or restricting the stopping, standing or parking of vehicles on any37 highway where such stopping, standing or parking is dangerous to those using38 the highway or where the stopping, standing or parking of vehicles unduly in-39 terferes with the free movement of traffic thereon.40 (28) On any informational material printed after July 1, 1995, by or at41 the order of the department and distributed to counties, school districts42 or individuals for the purpose of assisting a person to successfully pass43 a driver's license test, the department shall include material about the44 state's open range law and responsibilities, liabilities and obligations of45 drivers driving in the open range.46 (29) All employees, agents, and contractors of the department who have47 access to the source systems used by the division of motor vehicles shall be48 required to complete data security compliance training and to pass a federal49 bureau of investigation criminal background check. The department shall ad-50

6 minister access to and provide for the training required pursuant to this1 subsection.2

SECTION 2. That Section 49-402, Idaho Code, be, and the same is hereby3 amended to read as follows:4 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each5 pickup truck, each neighborhood electric vehicle and each other motor ve-6 hicle having a maximum gross weight not in excess of eight thousand (8,000)7 pounds and that complies with the federal motor vehicle safety standards as8 defined in section 49-107, Idaho Code, shall be:9 Vehicles one (1) and two (2) years old .........................$69.0010 Vehicles three (3) and four (4) years old ......................$57.0011 Vehicles five (5) and six (6) years old ........................$57.0012 Vehicles seven (7) and eight (8) years old .....................$45.0013 Vehicles over eight (8) years old .............................$45.0014 There shall be twelve (12) registration periods, starting in January15 for holders of validation registration stickers numbered 1, and proceed-16 ing consecutively through December for holders of validation registration17 stickers numbered 12, each of which. Each registration period shall start on18 the first day of a calendar month and end on the last day of the twelfth month19 from the first day of the beginning month. Registration periods shall expire20 at midnight on the last day of the registration period in the year designated21 by the validation registration sticker. The numeral digit on the validation22 registration stickers shall, as does the registration card, fix the reg-23 istration the registration card. The registration period is fixed by the24 registration card under the staggered registration system for the purpose of25 reregistration and notice of expiration.26 A vehicle that has once been registered for any of the above-designated27 periods shall, upon reregistration, be registered for the period bearing the28 same number month, and the registration card shall show and be the exclusive29 proof of the expiration date of registration and licensing. Vehicles may be30 initially registered for less than a twelve (12) month period, or for more31 than a twelve (12) month period, and the fee prorated on a monthly basis if32 the fractional registration tends to fulfill the purpose of the monthly se-33 ries registration system.34 (2) For all school buses operated either by a nonprofit, nonpublic35 school or operated pursuant to a service contract with a school district for36 transporting children to or from school or in connection with school-ap-37 proved activities, the annual fee shall be twenty-four dollars ($24.00) and38 shall be subject to staggered registration for the purpose of reregistration39 and notice of expiration.40 (3) For all motorcycles and motor-driven cycles that comply with the41 federal motor vehicle safety standards, operated on the public highways, the42 annual fee shall be nineteen dollars ($19.00) and shall be subject to stag-43 gered registration for the purpose of reregistration and notice of expira-44 tion.45 (4) For operation of an all-terrain vehicle, utility type vehicle or46 motorbike, excluding a motorbike with an engine displacement of fifty (50)47 cubic centimeters or less, on city, county or highway district roads or48 highways open to such use, a restricted vehicle license plate fee pursuant49

7 to section 49-450, Idaho Code, shall be paid. In addition, the certifi-1 cate of number fee specified in section 67-7122, Idaho Code, shall be paid2 as provided in section 67-7122, Idaho Code. The certificate of number and3 restricted vehicle license plate exemption provided in section 49-426(2),4 Idaho Code, applies to all-terrain vehicles, utility type vehicles, motor-5 bikes and motorcycles used for the purposes described in section 49-426(2),6 Idaho Code. Nonresidents shall be allowed to purchase a restricted vehicle7 license plate and validation sticker pursuant to section 67-7124, Idaho8 Code, for an all-terrain vehicle, utility type vehicle, or motorbike.9 (5) For all motor homes, the fee shall be as specified in subsection (1)10 of this section and shall be in addition to the fees provided for in section11 49-445, Idaho Code.12 (6) Registration fees shall not be subject to refund.13 (7) A financial institution or repossession service contracted to14 a financial institution repossessing vehicles under the terms of a secu-15 rity agreement shall move the vehicle from the place of repossession to the16 financial institution's place of business on a repossession plate. The17 repossession plate shall also be used for demonstrating the vehicle to a18 prospective purchaser for a period not to exceed ninety-six (96) hours. The19 registration fees for repossession plates shall be as required in subsection20 (1) of this section for a vehicle one (1) and two (2) years old. All other21 fees required under chapter 4, title 49, Idaho Code, shall be in addition to22 the registration fee. The repossession plate shall be subject to staggered23 registration for the purpose of reregistration and notice of expiration.24 (8) A wrecker or towing business engaged in the process of towing motor-25 ized vehicles that have been wrecked, abandoned, salvaged or may be disabled26 may apply for a wrecker plate to be displayed on those vehicles being towed,27 provided the power unit is properly registered under this chapter. The reg-28 istration fees for wrecker plates shall be as required in subsection (1) of29 this section for a vehicle one (1) and two (2) years old. All other fees re-30 quired under chapter 4, title 49, Idaho Code, shall be in addition to the reg-31 istration fee and shall be subject to staggered registration for the purpose32 of reregistration and notice of expiration.33 (9) In addition to the annual registration fee in this section, there34 shall be an initial program fee of twenty-five dollars ($25.00) and an an-35 nual program fee of fifteen dollars ($15.00) for all special license plate36 programs for those license plates issued pursuant to sections 49-404A,37 49-407, 49-408, 49-409, 49-414, 49-416, 49-418 and 49-418D, Idaho Code. For38 special plates issued pursuant to section 49-417E, Idaho Code, there shall39 be an initial program fee of seventy dollars ($70.00) and an annual program40 fee of fifty dollars ($50.00). For special plates issued pursuant to sec-41 tions 49-406 and 49-406A, Idaho Code, there shall be an initial program fee42 of twenty-five dollars ($25.00) but there shall be no annual renewal fee.43 For special plates issued pursuant to sections 49-415D, 49-417, 49-417A,44 49-417B, 49-417C, 49-417D, 49-418A, 49-418B, 49-418C, 49-419, 49-419A,45 49-419C, 49-419E, 49-420, 49-420A, 49-420B, 49-420C, 49-420D, 49-420E,46 49-420J, 49-420K, 49-420L, 49-420M, 49-420N, 49-420O, 49-420P, 49-420Q,47 49-420R, 49-420S, and 49-420T, and 49-420T 49-420U, Idaho Code, and unless48 otherwise expressly provided for in this chapter, any new special plate49 program effective on and after January 1, 2013, pursuant to section 49-402D,50

8 Idaho Code, there shall be an initial program fee of thirty-five dollars1 ($35.00) and an annual program fee of twenty-five dollars ($25.00). The fees2 contained in this subsection shall be applicable to all new special plate3 programs and shall be subject to staggered registration for the purpose of4 reregistration and notice of expiration. The initial program fee and the5 annual program fee shall be deposited in the state highway account and shall6 be used to fund the cost of administration of special license plate programs,7 unless otherwise specified by law.8 (10) Any vehicle that does not meet federal motor vehicle safety stan-9 dards shall not be registered and shall not be permitted to operate on public10 highways of the state, as defined in section 40-117, Idaho Code, unless oth-11 erwise specifically authorized.12 (11) In addition to annual registration fees as provided in this sec-13 tion, registrants may pay a fee to purchase an Idaho state parks passport14 authorizing resident motor vehicle entry into all Idaho state parks. Reg-15 istrants may pay the fee for a one (1) year or two (2) year period of time.16 The fee shall be ten dollars ($10.00) for one (1) year and twenty dollars17 ($20.00) for two (2) years. All fees collected pursuant to this subsection18 shall be deposited into the park and recreation fund and shall be subject to19 appropriation. Fees collected pursuant to this subsection shall not be con-20 sidered a motor vehicle registration fee as provided in section 17, article21 VII of the constitution of the state of Idaho.22

SECTION 3. That Section 49-402A, Idaho Code, be, and the same is hereby23 amended to read as follows:24 49-402A. UTILITY TRAILERS -- REGISTRATION, FEES AND TRANSFERS. (1)25 The department shall register a utility trailer for a period of one (1) year26 for a fee of five dollars ($5.00).27 (2) The department may register a utility trailer for a five (5) year28 period or for a ten (10) year period, and shall issue a license plate with29 the year of expiration designated by a validation sticker the registration30 card. Five (5) year registrations shall cost twenty dollars ($20.00) and ten31 (10) year registrations shall cost thirty dollars ($30.00) and shall be sub-32 ject to staggered registration for the purpose of reregistration and notice33 of expiration.34 (3) If ownership or interest in the trailer transfers as a result of a35 sale, neither the registration card nor plate can be transferred to another36 person. The registration card and plate shall remain in the possession of37 the transferor and may be transferred to another utility trailer owned by the38 transferor, and shall be valid until expiration of the original registra-39 tion.40

SECTION 4. That Section 49-402E, Idaho Code, be, and the same is hereby41 amended to read as follows:42 49-402E. RENTAL FLEET REGISTRATION. (1) As used in this section43 "rental fleet" means more than twenty-five (25) motor vehicles that are:44 (a) Owned by a rental company;45 (b) Offered for rental without a hired driver through a rental agree-46 ment; and47

9 (c) Designated by the registered owner of the motor vehicle as a rental1 fleet vehicle at the time of registration.2 (2)(a) On and after the effective date of this act, an owner that reg-3 isters a motor vehicle, weighing sixteen thousand (16,000) pounds or4 less, under the provisions of chapter 4, title 49, Idaho Code, may ob-5 tain an alternative special registration card and rental car stickers6 for the license plates if the motor vehicle is owned by a rental company7 and maintained in the rental company's rental fleet.8 (b) Although annual registration shall be required for each fleet ve-9 hicle, the registration card and rental car stickers for the license10 plates issued under paragraph (a) of this subsection are valid for the11 life of the motor vehicle while the motor vehicle is maintained in the12 rental fleet.13 (3) An owner that receives the alternative special registration card14 and rental car stickers for the license plates issued under this section15 shall renew the annual registration. If registration is not renewed, the16 registration shall be canceled.17 (4) In addition to the registration fees collected under chapter 4, ti-18 tle 49, Idaho Code, the department shall also collect an additional two dol-19 lars ($2.00) for the initial registration for each vehicle registered under20 this section, which shall be deposited in the state highway account.21

SECTION 5. That Section 49-411, Idaho Code, be, and the same is hereby22 amended to read as follows:23 49-411. DEALER AND MANUFACTURER PLATE -- FEES. (1) Any person conduct-24 ing the business of manufacturing, buying, selling or dealing in vehicles,25 and licensed as a manufacturer of or a dealer in vehicles, and owning and op-26 erating any such vehicle upon any highway may, in lieu of registering each27 vehicle, obtain from the department upon application on the proper form and28 payment of the required fee, and attach to each vehicle, one (1) number plate29 as required for different classes of vehicles in section 49-434, Idaho Code.30 The special number plate shall bear a distinctive number assigned to the man-31 ufacturer or dealer, the name of this state, which may be abbreviated, and32 the year for which the plate is issued, together with words which may be ab-33 breviated or a distinguishing symbol indicating that the plate is issued to a34 manufacturer or dealer.35 (a) Dealer license plates shall be limited to two (2) license plates36 for up to twenty (20) vehicles sold during the previous dealer licensing37 period and one (1) license plate for each ten (10) additional vehicles38 sold during the previous dealer licensing period. Any new dealer who39 applies for a dealer license shall be eligible for the number of dealer40 plates requested based on the number of vehicles that the dealer esti-41 mates he will sell during the first year of licensure.42 (b) Upon renewal of a dealer's license, the department may audit vehi-43 cle sales from previous years to determine the number of dealer plates44 that will be authorized for the current dealer licensing period.45 (2) The fee to validate a dealer or manufacturer number plate shall be46 twelve dollars ($12.00) for each validation sticker.47 (3) All such fees shall be paid to the state treasurer and deposited to48 the state highway account.49

10 (4) Laden dealer or manufacturer plates shall be available to licensed1 dealers and manufacturers operating vehicles with laden loads in further-2 ance of their business pursuant to section 49-1627(5), Idaho Code. Such3 plates shall be exempt from the limit provisions of subsection (1)(a) of this4 section. The operating fee for a laden dealer or manufacturer plate will5 be equal to the fees for commercial vehicles pursuant to section 49-434(1),6 Idaho Code, for twenty-six thousand (26,000) pounds. Laden dealer and man-7 ufacturer plates are limited to a maximum combined gross vehicle weight of8 twenty-six thousand (26,000) pounds. Temporary weight increase permits may9 be purchased pursuant to section 49-432(2), Idaho Code.10

SECTION 6. That Section 49-412, Idaho Code, be, and the same is hereby11 amended to read as follows:12 49-412. VEHICLE DEALER LOANER PLATE. (1) A dealer, owning a vehicle13 may obtain, upon application to the department upon a proper form and payment14 of the fee required, and display on a vehicle loaned to a customer, a loaner15 vehicle number plate. The plate shall be the same design and numbering sys-16 tem as the plate issued for passenger vehicles or motorcycles.17 (2) The fee for each loaner plate or registration sticker card shall be18 as provided in section 49-402(1), Idaho Code, for new vehicles.19 (3) All such fees shall be paid to the state treasurer and deposited to20 the state highway account.21

SECTION 7. That Section 49-428, Idaho Code, be, and the same is hereby22 amended to read as follows:23 49-428. DISPLAY OF PLATE AND STICKERS. (1) License plates assigned to24 a motor vehicle shall be attached, one (1) in the front, if the vehicle is25 equipped with a front license plate mounting bracket, and the other in the26 rear, with the exception of the following:27 (a) The license plate assigned to a motorcycle, all-terrain vehicle,28 utility type vehicle, motorbike or semitrailer and the license plate29 assigned to a motor vehicle operated by a manufacturer, repossession30 agent or dealer shall be attached to the rear.31 (b) Vehicles displaying year of manufacture, old timer, classic car,32 street rod, or custom vehicle license plates shall be allowed to display33 one (1) plate attached to the rear of the vehicle.34 (c) The license plate attached to a tractor shall be attached to the35 front.36 (d) The wrecker plate shall be displayed on the vehicle being towed in37 such a manner as to be visible when the vehicle being towed is approached38 from the rear.39 License plates shall be displayed during the current registration year. The40 annual registration sticker for the current registration year shall be dis-41 played on each license plate, except for trailers, semitrailers, and com-42 mercial vehicles over twenty-six thousand (26,000) pounds under the provi-43 sions of sections 49-434 and 49-435, Idaho Code. For the purposes of this44 title, the license plates together with the registration stickers card shall45 be considered as license plates for the year designated on the registration46 sticker card. For purposes of this chapter, a validation sticker issued to47

11 the operator of an all-terrain vehicle, utility type vehicle, or motorbike1 under the provisions of sections 67-7122 and 67-7124, Idaho Code, shall be2 considered the registration sticker.3 (2) Every license plate shall at all times be securely fastened to the4 vehicle to which it is assigned to prevent the plate from swinging, be at a5 height not less than twelve (12) inches from the ground, measuring from the6 bottom of the plate, be in a place and position to be clearly visible, and be7 maintained free from foreign materials and in a condition to be clearly legi-8 ble, and all registration stickers shall be securely attached to the license9 plates and shall be displayed as provided in section 49-443(4), Idaho Code.10

SECTION 8. That Section 49-434, Idaho Code, be, and the same is hereby11 amended to read as follows:12 49-434. OPERATING FEES. 12 (a) For trailers and semitrailers, the nonexpiring registration fee1 shall be ninety-nine dollars ($99.00). The license plate shall remain2 on the trailer or semitrailer until the registration is canceled or re-3 voked. No part of the fee is subject to refund. However, the registrant4 may transfer the nonexpiring plate and registration to another trailer5 or semitrailer titled to the registrant if the original registration6 date is prior to July 1, 2009. The registration document shall be the7 official record of the status of the nonexpiring registration, and no8 registration fee shall be required after the initial registration is9 paid. No validation sticker shall be issued for license plates assigned10 under this section. The owner may be issued an electronic copy of the11 registration card issued pursuant to this section.12 (i) Registration of a trailer or semitrailer based in another ju-13 risdiction may be issued when the registrant provides a valid ju-14 risdiction title or ownership document and certification state-15 ment, and no title transfer will be required.16 (ii) Periodic verification will be made to confirm ownership sta-17 tus. Failure of the owner to comply with the verification request18 to confirm ownership within thirty (30) days shall result in can-19 cellation of the permanent plate registration.20 (b) Idaho-based trailer manufacturers may purchase trailer and semi-21 trailer registration from the department. The manufacturer may issue22 the annual registration to foreign-based purchasers utilizing a manu-23 facturer's certificate of origin or manufacturer's statement of origin24 as proof of ownership. If the foreign-based purchaser subsequently ob-25 tains an Idaho nonexpiring registration as provided in paragraph (a) of26 this subsection prior to annual registration expiration, the amount of27 the annual registration fee shall be applied to the nonexpiring regis-28 tration fee provided that the customer acquires a title for such vehi-29 cle.30 (c) For rental utility trailers, the registrant may prepay the annual31 registration for an additional one (1), two (2), three (3) or four (4)32 years, but in no event shall the optional registration period extend33 beyond five (5) years. The fee shall be as specified in subsection34 (3)(b) or (c) of this section. The owner shall be issued a registration35 card or may request such card to be sent electronically. The expiration36 date shall be reflected on such registration card. The license plate37 shall become void if the owner's interest in the rental utility trailer38 changes during the five (5) year period. If the owner fails to enter39 the rental utility trailer on the annual renewal application during40 the five (5) year period, the registration record shall be purged. Any41 unrenewed plate shall be returned to the department if it is not entered42 on the renewal application.43 (5) A fleet registration option is available to owners who have44 twenty-five (25) or more commercial or farm vehicles or any combination45 thereof. Such owners may register all of their company vehicles with the46 department in lieu of registering with a county assessor. To qualify, the47 fleet must be owned and operated under the unified control of one (1) person48 and the vehicles must be physically garaged and maintained in two (2) or more49 counties. Fleet registration shall not include fleets of rental vehicles.50

13 The department shall provide a registration application to the owner, and1 the owner shall provide all information that the department determines is2 necessary. The department shall devise a special license plate numbering3 system for fleet-registered vehicles as an alternative to county license4 plates. The fleet registration application and all subsequent registration5 renewals shall include the physical address where a vehicle is principally6 used, garaged and maintained. The fleet owner shall report the physical7 address to the department upon initial registration, on each renewal, and at8 any time a vehicle registered under this option is permanently transferred9 to another location.10 (6) If the ownership of a vehicle changes during the registration pe-11 riod, the original owner may transfer the plate to another vehicle. The re-12 maining fee shall be credited against the cost of the new registration. Re-13 funds may be given for any unexpired portion of the vehicle registration fee14 if the plate is not transferred by the owner to another vehicle. Any re-15 quest for refund shall include surrender of the license plate and registra-16 tion document, if a physical document was issued. Owners of vehicles regis-17 tered under the international registration plan may request a refund of the18 unexpired portion of the Idaho vehicle registration fee by presenting ev-19 idence from the base jurisdiction that the license plate and registration20 document, if a physical document was issued, have been surrendered. A li-21 cense plate shall not be transferred to another owner when the ownership of22 a vehicle changes. The owner shall obtain a replacement plate, if required,23 and a printed or electronic registration document when a plate is lost, de-24 stroyed, or becomes illegible.25 (7) An administrative fee of four dollars ($4.00) shall be paid and de-26 posited to the state highway account on all registrations completed by the27 department under subsection (1) or (8)(a) of this section. Vehicles regis-28 tered under subsection (8)(b) of this section shall pay the fee provided in29 section 49-435(2), Idaho Code.30 (8) There shall be paid on all commercial and farm vehicles having a31 maximum gross weight in excess of sixty thousand (60,000) pounds, a regis-32 tration fee based upon the maximum gross weight of a vehicle as declared by33 the owner and the total number of miles driven on roads and highways in the34 state, county, city and highway district systems in Idaho, and if registered35 under the international registration plan (IRP), in all other jurisdic-36 tions. The appropriate registration fee shall be determined as follows:37 (a) If the owner registers vehicles under the international registra-38 tion plan (IRP), the appropriate mileage column shall be determined by39 the total miles an owner operated a fleet of vehicles on roads and high-40 ways in the state, county, city and highway district systems in Idaho41 and in all other jurisdictions in the preceding year, as defined in sec-42 tion 49-117, Idaho Code, and by the maximum gross weight of each vehicle43 within a fleet.44 (b) If the owner registers vehicles under the international registra-45 tion plan and determines that the average international registration46 plan fleet miles, calculated by dividing the total IRP fleet miles in47 all jurisdictions by the number of registered vehicles, is less than48 fifty thousand one (50,001) miles, the owner may apply to the depart-49 ment for refund of a portion of the registration fees paid, consistent50

14 with the fee schedules set forth in this section. The department shall1 provide an application for the refund. The permit so issued shall be specific to the motor vehicle21 to which it is issued. No permit or fee shall be transferable or appor-22 tionable to any other vehicle, nor shall any such fee be refundable.23 (e) Any commercial or farm vehicle registered for more than sixty thou-24 sand (60,000) pounds up to one hundred six thousand (106,000) pounds25 traveling fewer than two thousand five hundred (2,500) miles annually26 on roads and highways in the state, county, city and highway district27 systems in Idaho shall pay an annual registration fee of two hundred28 fifty-five dollars ($255). The provisions of section 49-437(2), Idaho29 Code, shall not apply to vehicles registered under this paragraph.30 (9)(a) During the first registration year that the fee schedule in sub-31 section (8)(c) of this section is in use, an owner shall use the mileage32 data from the records used to report the mileage use fee in the immedi-33 ately preceding year as the basis for determining the appropriate reg-34 istration fee schedule.35 (b) Any owner who registers a motor vehicle for the first time and who36 has no mileage history for the vehicle shall estimate the miles to de-37 termine the appropriate fee schedule in subsection (8)(c) of this sec-38 tion. When estimating the miles, the owner shall provide a statement on39 the application of the method used to arrive at the estimated miles.40 (c) Any owner using any fee schedule other than the highest fee sched-41 ule under subsection (8)(c) of this section shall certify at the time of42 registration that the miles operated in the preceding year do not exceed43 the schedule applied for. Any owner using a fee schedule under subsec-44 tion (8)(c) of this section that is less than the highest schedule shall45 maintain records to substantiate the use of the schedule as required by46 section 49-439, Idaho Code.47

16 (10) An owner registering under subsection (8)(a) or (8)(c) of this sec-1 tion may elect to pay the full annual registration fee at the time of regis-2 tration or renewal of registration, or an owner may pay at least one-quarter3 (1/4) of the annual registration fee due. The remainder of the annual Idaho4 registration fee shall be paid in three (3) equal installments on dates as5 billed by the department.6 (11) An owner registering or renewing a registration under subsection7 (8) (a) of this section electing to use installment payments as provided in8 subsection (10) of this section shall pay all of the fees due to other IRP ju-9 risdictions in addition to one-quarter (1/4) of the Idaho fee due at the time10 of registration or reregistration. The remainder of the annual Idaho regis-11 tration fee shall be paid in three (3) equal installments on dates as billed12 by the department.13 (12) If any vehicle or combinations of vehicles haul nonreducible14 loads, as authorized under the provisions of section 49-1004, Idaho Code,15 and weigh less than the starting weights per axle configuration listed in16 column 1 of section 49-1004(2), Idaho Code, then and in that event there17 shall be paid for that vehicle, in addition to the other fees required in this18 section, an additional use fee of 2.1 mills per mile for each two thousand19 (2,000) pounds or fraction thereof of the maximum gross weight in excess of20 those set forth in section 49-1001, Idaho Code.21

SECTION 9. That Section 49-443, Idaho Code, be, and the same is hereby22 amended to read as follows:23 49-443. LICENSE PLATES TO BE FURNISHED BY DEPARTMENT -- FORM AND24 CONTENTS. (1) The assessor or the department shall furnish to every owner25 whose vehicle is registered or licensed by that office, pursuant to sections26 49-402 and 49-402A, Idaho Code, one (1) license plate for vehicles regis-27 tered under the provisions of section 49-406, 49-406A or 49-408, Idaho Code,28 or a motorcycle, trailer, truck-tractor, or semitrailer; one (1) restricted29 vehicle license plate for all-terrain vehicles, utility type vehicles and30 motorbikes licensed pursuant to this chapter; and two (2) license plates31 for every other motor vehicle. If a vehicle is issued one (1) plate only,32 that plate shall be displayed in accordance with the provisions of section33 49-428, Idaho Code. For vehicles registered under the provisions of section34 49-407, Idaho Code, the applicant shall provide one (1) plate to be displayed35 on the rear of the vehicle.36 Commencing January 1, 1992, the color and design of the plates shall be37 comparable to the color and design of the statehood centennial issue of li-38 cense plates with blue numerals and letters on a multicolored red, white and39 blue background. Each license plate must bear upon its face the inscriptions40 "Famous Potatoes" and "Scenic Idaho." The restricted vehicle license plate41 for all-terrain vehicles, utility type vehicles and motorbikes shall be a42 white background with black numerals and letters, with "Idaho Restricted Ve-43 hicle" and the year of its expiration on its face and no other inscription.44 The restricted vehicle license plate shall be the same size required for the45 motorcycle license plate.46 Every license plate shall have displayed upon it the registration num-47 ber assigned to the vehicle and its owner and the name "Idaho," which may be48 abbreviated. The plates issued under the provisions of section 49-402(1),49

17 Idaho Code, and the required letters and numerals, including an identifica-1 tion of the county in which the motor vehicle to which the plates will be af-2 fixed is registered, shall be of sufficient size to be plainly readable from3 a distance of seventy-five (75) feet during daylight, and each license plate4 and registration sticker shall be treated with a fully reflectorized mate-5 rial according to specifications prescribed by the board.6 (2) License plates shall be valid for a period of ten (10) years begin-7 ning with the date of issuance of new plates. At the end of the ninth year,8 the registered owner shall receive notice of the date upon which the plates9 will expire.10 For specialty license plate programs discontinued pursuant to the11 provisions of section 49-402C, Idaho Code, a registrant with a specialty12 license plate currently registered under the program may use such license13 plate for up to ten (10) years from the date of issuance. This provision14 is intended to permit the use of the specialty plate by the registrant re-15 gardless of the number of persons who purchase the specialty plate. The16 registrant shall be required to pay the special plate program fees provided17 for specialty plates pursuant to this chapter. Such fees shall be deposited18 into the state highway account. For purposes of section 49-434, Idaho Code,19 as it applies to commercial vehicles, and section 49-435, Idaho Code, the20 department shall provide new plates bearing the same number or, upon request21 from the registered owner, the next available number.22 (3) If a license plate number has expired as provided in subsection (2)23 of this section and is not renewed within sixty (60) days of its expiration,24 the plate number shall be available for use by another registrant. To obtain25 a specific number in the recycled license plate number file, the owner of a26 registered vehicle may contact the county regarding availability.27 The provisions of this subsection shall apply only to vehicles regis-28 tered under the provisions of section 49-402(1), Idaho Code, and section29 49-434(1), Idaho Code, as it applies to noncommercial vehicles.30 (4) License plates issued for vehicles required to be registered in31 accordance with the provisions of sections 49-402 and 49-402A, Idaho Code,32 shall be issued color-coded red, white or blue registration validation33 stickers showing the year of registration. Each registration validation34 sticker shall bear a number from 1 through 12, which number shall correspond35 to the month of the calendar year in which the registration of the vehicle36 expires and shall be affixed to the lower right-hand corner of the plates37 within the outlined rectangular area.38 (5) (4) License plates for utility trailers registered under the pro-39 visions of section 49-402A, Idaho Code, that are issued for five (5) or ten40 (10) years and license plates for rental utility trailers registered under41 the provisions of section 49-434, Idaho Code, that are issued for up to five42 (5) years shall use the design in effect on the date of manufacture. If a de-43 sign change occurs, plates from the effective date of the design change shall44 be manufactured using the new design. Unexpired plates need not be reissued45 to conform to a design change.46 (6) (5) For license plates that are lost, stolen, mutilated, or il-47 legible, the owner shall apply for a duplicate or substitute. The assessor48 shall also furnish for each registration, and to validate the license plate,49 a pressure-sensitive, uniquely numbered, color-coded red, white or blue50

18 registration sticker, except for trailers and semitrailers registered under1 the provisions in section 49-434, Idaho Code. License plates issued for2 state, county and city motor vehicles shall be valid for ten (10) years pur-3 suant to subsection (2) of this section and remain on the vehicle for which4 issued from year to year and need no renewal or validation sticker.5 (7) (6) Whenever a vehicle is completely destroyed by fire or accident6 and the operator submits satisfactory proof of that destruction to the de-7 partment or appropriate assessor's office, or the owner wishes to transfer8 the remaining registration, use increment and fees shall be transferred to9 the replacement vehicle for a service transfer fee of five dollars ($5.00),10 which fee shall be retained by the registering authority. None of the origi-11 nal fees shall be subject to refund.12 (8) (7) The department shall furnish a printed or an electronic copy of13 the registration card to every owner whose vehicle is registered under sec-14 tions 49-434 and 49-435, Idaho Code.15 (9) (8) The board shall have authority to require the return to the de-16 partment of all license plates and registration stickers cards upon termina-17 tion of the lawful use of them by the owner.18 (10) (9) The board may promulgate such rules as are necessary to imple-19 ment the provisions of this section.20

SECTION 10. An emergency existing therefor, which emergency is hereby21 declared to exist, this act shall be in full force and effect on and after22 July 1, 2026.23
